GENERAL INSTRUCTION: Kindly fill-out this form by following the instructions stated per sub-criteria.
CRITERIA
I. EFFICIENCY IN OPERATIONS
A). Observance of
Settlement The records of the Lupong Tagapamayapa of Barangay Abiera, Sebaste, Antique is under the custody of the Barangay
Procedure and Secretary who also serves as the Lupon Secretary. She keeps and maintains a record book of all complaints filed before the

Settlement Lupong Tagapamayapa. The record book contains all the cases filed, consecutively numbered based on the order in which
Deadlines they were filed and received. Other information included in the record book were the names of the parties, date and time
filed, and nature of case.
1) a) Proper
Recording Like other Lupong Tagapamayapa, the Lupon Secretary of Barangay Abiera serves as the frontline service provider as far as
of every filing of lupon cases are concerned. When a client with an intention to file a case before the Lupon approached the Barangay
dispute Hall, the Lupon Secretary entertained him/her and conduct initial questioning to determine whether or not the case falls
within the jurisdiction of the Lupong Tagapamayapa and if the Barangay is the proper venue. Upon ascertaining the
jurisdiction and the venue, the Lupon Secretary assists the complainant in accomplishing KP Form No. 7 or the complaint
form. She thereafter affixed her initials under the name of the lupon chairman. Her initials gives information to the Lupon
Chairman that she has reviewed the complaint and that based on her initial review the case is a lupon case and the venue is
Barangay Abiera, Sebaste. The Lupon Chairman thereafter reads the complaint and if found to be in order, she will received
the case, instruct the payment of the filing pay in the amount of Php 20.00 and service fee of Php 30.00 save for cases
wherein the complainant is an indigent, and the docketing of the case.
After the filing and the payment of filing pay, the Lupon Chairman orders the issuance of the Notice of Hiring to the
Complainant(s), Summon to the Respondent(s) and Subpoena to the witness(es), if any. The issuance service of this
correspondence was all made on the day the complaint was filed or the next working day. For the year 2019, the following

All the Notice of Hearing, Summons, and Subpoena were properly served by a member of the Barangay Tanod and was
received by the person concerned. No substituted service nor service by registered mail was made for the year 2019 and
2020.
To ensure that the records of cases are intact, the Barangay practices the one folder-one case filing system. Included in the
folder of cases are the following documents:
1. KP Form 7- Complainant’s Form

2. KP Form 8- Notice of Hearing
3. KP Form 9- Summon for the Respondent

4. KP Form 16- Settlement Agreement

5. Minutes of the settlement proceedings
6. Monitoring Report of Compliance to Settlement Agreement (Devised by the Barangay)
7. Certificate of Compliance to Settlement Agreement (Devised by the Barangay)
8. Other pertinent documents as it may apply to the case (eg. KP Form 13- Subpoena
As part of the Barangays’ effort to save copies of important documents even during disaster, copies of pertinent documents
of all the cases were properly scanned and saved in a single-file pdf format and is stored in the googledrive. Only the Lupon
Chairman and the Lupon Secretary has the access to the google drive to ensure confidentiality of records.
The Lupon Chairman authorizes the issuance of the certified true copies or duplicates of the records of cases if the same is
being requested by the parties themselves or their lawyers, in instances where the case was properly filed in court. The
expenses incurred in the reproduction and certification of the records of cases is being shouldered by the requesting
party/ies.

2) Settlement After the case was received and properly recorded by the Lupon Secretary, the Lupon Chairman scheduled the initial
and Award confrontation and orders the issuance of Summons to the Respondent/s, Notice to the Complainant and Subpoena to
Period witnesses, if any using the KP Forms 9, KP Form 8 and KP 13 respectively. The above mentioned documents were served to
the proper party/ies or person/s on the same day the complaint was filed or the following day if the time does not warrant
its issuance on the same day as provided in the table above.
Consistent with the provisions of Katarungang Pambarangay Rules, the Lupon Chairperson holds the initial confrontation of
mediation of parties not later than 5 days from the service of summons. Said mediation proceedings shall run for 15 days

from the initial confrontation. However, in the case of Barangay Abiera, Sebaste, Antique, for the year 2019, most of the
cases filed were resolved on the first or initial meeting. No cases were forwarded to the Pangkat ng Tagapagkasundo for
conciliation. Likewise no case was issued with certificate to file action.

Maintenance of The Lupon Secretary serves as the custodian of all Katarungang Barangay related documents. She maintains all the
Records pertinent documents of every cases filed in an individual folder. These case folders contains all the copy of the complaints
(KP Form 7), notice of hearing (KP Form 8), summons to the respondents (KP Form 9), subpoena letter (KP Form 13),
settlement award (KP Form 16) and other documents and evidences presented and used during the settlement proceedings

that forms part of the records of the case. She likewise maintains an electronic or scanned copy of records of cases saved in
a single file PDF Format per case.
In addition to the records of the case, other records available under the custody of the Lupon Secretary are:
1. Records relating to the organization of the Lupong Tagapamayapa which includes KP Form 1-Notice to Constitute the
Lupon, KP Form 2-Appointment Letter, KP Form 3- Notice of Appointment, KP Form 4- List of Appointed Lupon
Members, and KP Form 5- Lupon Member Statement of Oath.
2. Copies of Reports- These are reports that are periodically submitted to the local courts and the DILG. The reports
were made using the format provided in KP Form 28- Monthly Transmittal of Final Reports and the Annual
Katarungang Pambarangay Report by the DILG.
3. Blank Copies of Katarungang Pambarangay Forms- These are the frequently used Katarungang Pambarangay Forms
such as the Form 7, Form 8, Form 9, and KP Form 13.
The hard copy of records was safely kept in a filing cabinet situated in the office of the Lupong Tagapamayapa while the
electronic or scanned copies were saved in the desktop computer which is solely for the use of the Lupong Tagapamayapa.
As a back-up to the electronic or scanned copies or records of cases saved in the desktop computer, copies of the same
records were also saved in a USB dedicated for the purpose.

C. Timely The Lupong Tagapamayapa of Barangay Abiera, through its Lupon Secretary makes sure that all the reportorial

Because of the Gabay Program the parties fully understand the process under the katarungang pambarangay and are fully
aware of the possible consequences should the settlement proceedings under Katarungang Pambarangay will not prosper.

Moreover, the Lupon Chairman also attributed its 100 settlement to the call a friend Program because the designated friend
of the parties who is acting as the bridge of the parties enforces the efforts of the lupon chairman in mediating the two
opposing parties.

III. CREATIVITY AND RESOURCEFULNESS OF THE LUPONG TAGAPAMAYAPA
A. Settlement
Technique For the year 2019, the following are the settlement technique indroduct by the members of the Lupong Tagapamayapa of
Barangay Abiera, Sebaste, Antique, to wit:
 Katarungang Pambarangay On the Go. Katarungang Pambarangay on the Go project is inspired by the Justice on
Wheels program of the Department of Justice. Under this initiative, when both parties resides in the same sitio or
purok, and both the complainant and the respondent agreed that their dispute will be settled on-site, the Lupon
Chairman and the Lupon Secretary shall conduct the mediation proceeding on-site. Commonly, the venue for onsite
settlement is the tanod outpost or any barangay structure located in that sitio or purok. This is to ensure that the
settlement will be conducted in a neutral grounds and that the venue shall not cause any discomfort to the parties.
This practice practically save the cost incurred by the parties in attending the proceeding and the time of travelling.

Furthermore, it also warrants the attendance of the parties because the settlement proceedings is being conducted
onsite.
 Pagpangamuyo (Ecumenical Prayer). Like any undertakings conducted by the Barangay, the Lupon Chairman or
the Pangkat Chairman starts the settlement proceedings with a prayer. Often, it is the Lupon Chairman or the
Pangkat Chairman as the case maybe that leads the prayer. However, it has been a practice of the Lupong
Tagapamayapa of Barangay Abiera that parties are encouraged to recite their own prayer based on his own religious
belief and practices. This initiative recognizes the diversity of the people in terms of religion. As such, they are
allowed to pray and practice what they believe.
 Gabay Program. The Gabay Project of Barangay Abiera focuses on guiding the parties of the cases to ensure
successful settlement. In Lupon Gabay Project, one lupon member is assigned to be the Gabay in every cases. The
Gabay’s main task is to conduct pre-mediation activities which includes but not limited to orient the parties of the
proceedings and processes under the Katarungang Pambarangay, cooling-off activities, gather information related to
the case, and submit to the Lupon Chairman relevant information that the lupon chairman can use in fully
understanding the case and settling the same. As a result, parties to the case were appraised of their roles and
obligations under the Katarungang Pambarangay and the proper decorum and behavior expected of them during the
settlement.
 Call a Friend. Under this practice, the parties may agree to call any person that could help in settling their disputes.
This person must be a common friend, a respected elder or any member of the community whom the parties believe
could bridge them towards settlement. Unlike the arbitrators in the arbitration proceedings, it is not the role or duty
of the “Friend” to decide and determine the settlement of the case. Its primary responsibility is only to aid the lupon
chairman settling the dispute between the parties. The friend to be designated must be agreed upon by the parties
themselves.

The intervention of the “friend” resulted to the speedy disposition and settlement of the cases.
 Lupon, Ikaw, Kumunidad kag Simbahan (LIKSI Program). Under the LIKSI Program, parties of the case are
required to render any community service to any community based activities sponsored by the Barangay, the Church
or Community Based Organization before they will be issued the Certificate of Full Compliance to the Settlement
Agreement which officially closed or terminates the case. This undertaking is envisioned to make the parties realize
that they are part of the community and that they can positively contribute to its betterment.
 Issuance of Certificate of Full Compliance to Settlement Agreement. One of the initiative of the Lupong
Tagapamayapa of Barangay Abiera is the issuance of the Certificate of Compliance to Settlement Agreement to
parties of the case. The issuance is made after the full satisfaction of the settlement agreement in cases where the
agreement has a specified date of completion, or upon recommendation of the Lupon Members based on their three
(3) months monitoring of the attitude and behavior of the respondents/complainant who pledge not to repeat the
acts complained again. The certificate is freely and voluntarily signed by the parties and duly attested by the Lupon
Chairperson. The issuance of the Certificate of Compliance to Settlement Agreement marks the official termination of
the case and signifies the closure of the case as far as Katarungang Pambarangay is concerned.
 Monitoring of Compliance to Settlement Agreement. The Lupon Tagapamayapa of Barangay Abiera has
designed a monitoring tool to check on the compliance of parties to the settlement agreement. Through this
initiative, Lupon member/s are tasked to monitor settlement compliance of parties residing in their respective sitios.
The 100% compliance to settlement agreement of cases is greatly attributed to this practice of the Lupong
Tagapamayapa of Barangay Abiera, Sebaste, Antique.
 Continuing Lupon Education. The Lupong Tagapamayapa of Barangay Abiera believes that the best way for them
to render quality service to its clientele is through continuously equipping their selves with the latest trends and

development in Katarungang Pambarangay. As such every month during their monthly meeting, a special topic on
Katarungang Pambarangay was discussed by the Lupon Chairman.
On the other hand for the year 2020, here are the innovative technique introduced by the Lupong Tagapamayapa of
Barangay Abiera, to wit:
 Itext ang Lupon. The Lupong Tagapamayapa of Barangay Abiera has designated a hotline number for Katarungang
Pambarangay purposes. Residents of the barangay can text this number for their lupon related concerns. These
concerns commonly includes their intention to file a lupon case, the process of filing, or just an immediate response
to small squabbles or disputes in the neighborhood. The Lupon Chairman or the Secretary replies to the text message
received by addressing the issues or needs raised by the sender. Generally, the reply includes instructions or courses
of action that the sender must take to file a lupon case. This practice is the Lupon’s response to the current situation
that limits face to face interaction.
 Libre Sakay para sa Katawhay. Libre Sakay para sa Katawhay (Free-ride for Peace) is a program designed to
ensure the attendance of the parties during settlement, aid in cutting the expenses of the parties, benefitting the
poor and the indigents. In this program, the barangay utilizes barangay service vehicle in conveying the parties from
their houses to the barangay hall and vice versa. This is also the Barangay’s strategy to ensure attendance of parties
especially that public transport is limited due to COVID situation.
 Bawal ang Nakikisawsaw Policy. This anchored on the “Policy on Confidentiality of all Katarungang Pambarangay
Proceedings”. Under this rule being implemented by the Katarungang Pambarangay of Barangay Abiera prohibits the
attendance of persons other than the parties and their instrumental witnesses in any stage of the settlement
proceedings. This regulation strengthens the trust and confidence of the parties to the Katarungang Pabambarangay
process and ensures that their disputes and its circumstances will never become a barangay gossip the following day.

The institutionalization of this program helps in reducing the number of attendees during KP Proceedings.

information drive propagate and promote the aims of Katarungang Pambarangay. It has developed its own IEC Materials written in local
to promote dialect, discussion of Barangay Justice System during community gatherings, and maintenance of social media platforms
Katarungang such as facebooks to widen the scope and reach of its advocacy campaigns. In a nutshell, the following are the sustained
Pambarangay information drive implemented by the Lupong Tagapamayapa of Barangay Abiera for the years 2019 and 2020:
Distribution of Katarungang Pambarangay Flyers written in local dialect. The Barangay has developed two advocacy
materials one (1) containing basic information regarding katarungang pambarangay, list of lupon members, citizens charter
in filing lupon cases and contact information of the barngay. Another material contains the list of criminal cases cognizable
under the katarungang pambarangay. The flyers and brochures where made available in the barangay hall at all times and
were distributed to the public during community or public gatherings.
Discussion of Katarungang Pambarangay Concerns During Barangay Assembly. The Barangay has allocated a slot
during Barangay Assembly for the discussion of Katarungang Pambarangay concerns. Here, the Lupon Chairman reports to
the public the accomplishment of Katarungang Pambarangay for the period covered. Also, Lupon Members are given the
opportunity to speak and discuss to the community members their plans programs and action.

Discussion of Katarungang Pambarangay Concerns During Association Meetings. The Lupong Tagapamayapa of
Barangay Abiera through the Lupon Chairman or the Lupon Secretary also utilized associatiation meetings to advocate
Katarungang Pambarangay. They often attends to association meetings like Senior Citizens Association, Pantawid Pamilyang
Pilipino Program Parent Leaders Association and the likes. Often the Lupon Chairman or the Lupon Secretary addresses
issues and questions raised by members of this organizations regarding katarungang pambarangay.
LGU Abiera Facebook Page. The Lupong Tagapamayapa also used the social media to widen the reach of their
Katarungang Pambarangay advocacies. Posted in the LGU Abiera Facebook page includes Katarungang Pambarangay Fast
Facts. Also posted in the facebook page is the soft copies of the Katarungang Pambarangay brochures and fyers, and
citizen’s charter on the filing of lupon cases.
