ABSTRACT

At the present time, water use in Thailand for all kinds of purpose has been changed
dramatically due to the increase of water use by the population and socio-economic growth. It
therefore leads to shonage of water supply and disputes relating to use of water from each water
resources. From the above, it gives rise to the question that whether the purpose of the water

resources administration for the purpose of irrigation has been met.


This thesis is aimed to study problems and obstacles relevant to laws governing water

resources adrmnistration for the purpose of irrigation by the method of document research

covering textbooks, articles and research papers. The laws relating to water resources

administration for the purpose of irrigation of Japan and the Philippines are also considered in this
study.
It is found from the study that water resources have been used wastefully. Natural

water resources i.e. small lake, swamp and canal have also been invaded where necessary control
and measures as steps to be taken by authorities concerned still have not been adopted. The

problem of water supply for the whole country is increasingly worsened by controversies and
restraint as to water resources development. The existing governing laws are not adequately
effective to be used as a tool for dealing with problems arising from water resources
administration. This is partly resulted from that there are too many laws governing the use and the
conservation of water resources and overlap between some of those give rise to practical
problems. Furthermore, some of the laws regarding irrigation are arguably obsolete and fail to
respond to socio-economic changes.

To achieve the effective and sustainable water resources administration for the
purpose of irrigation. it is therefore. as proposed in this thesis, necessary to adopt measures as to
identifying the scope of right to the use of water and water charges and allocating general average

compensation to the damage caused by each water pollution source being situated along either the
natural water stream or irrigation system. It is suggested that the Private Lmgation Act B.E.2482,

the State Irrigation Act B.E.2485 and the Dyke Act B.E.2505are to be reformed by drafting the

new Irrigation Act B.E.. .particularly aimed to increase criminal penalties inchding the amount of
fine in response to the present money value. Furthermore, it is also proposed that the Water
Resources Act B.E.... should be enacted as a supreme law governing water resources

administration.
