QUESTION

In August 2019, the naked body of Nora Anne Quoirin a Franco-Irish teenager, 15, who
suffered from learning difficulties, was found in a ravine near the Dusun holiday resort,
Pantai, where her family was staying in Seremban, about 70 kilometres (44 miles) south of
Kuala Lumpur.
With above case discuss what are the element, process, plan, search and evidence collected in
this case. Also what the role played by the investigation officer in coordinating to solve this
case. Write your essay chronologically of the event.

Nora Anne Quoirin is now deceased, aged 15 years,who lives in London with her
French father and Irish mother. Nora Anne Quoirin was born on 31st May 2004 to Sebastian
Marie Phillipe Quoirin and Meabh Josephine Quoirin . She was their first child. She had two
younger siblings, Innes Julia and Maurice Arthure . Nora Anne was born with
holoprosencephaly ( HPE ), an abnormality of brain development. This brain malformation
before the inquiry started had shown that the severity of HPE varies widely among the
affected individuals. The more severe malformation identified, the more problem or
complication will be faced by the effected individual. Investigator do not propose to discuss it
in detail. It is not my expertise. For instance, when Nora was born she could not breathe well
because her nasal of passages were too close together. And she had one distinctive feature
which was a single incisor. So, instead of having two front teeth, just one which we, with the
help of a dental surgeon had disguised somewhat for her physical appearance by balancing
out the length of her other tooth. Normally that single incisor is longer and wider. So, while
these facial features are quite subtle, they’re nonetheless distinctive. Nora’s brain was not
fused, but she had a smaller brain. They associated with holoprosencephaly is a microcephaly
particularly small brain. Nora Anne attended Garratt Park School in September 2015. She
was with the school until July 2019 .Garratt Park School is a state special school caters solely
for children aged from 11 to 19 years with special educational needs and disabilities. Its
curriculum is different from the one in a mainstream school. She arrived at the school at the
age of 11 in September 2015, Nora Anne presented as a child functioning in term of reading
at the age of 6 and 5 months. She had a math age of 4 years and 10 months and she had an
expressive language age of 5. Nora Anne as a child with poor balance, poor posture and
difficult to take part in some activities.She struggled to maintain a position sensibly. So, for
instance that meant that writing was a real challenge. Nora really couldn’t write. And her
hand writing for instance was like a very small child. And she couldn’t write more than a
very basic sentence.
On 2 nd August 2019 , Nora Anne Quoirin came to Malaysia for a two week holiday
with her family.The journey in all was about 19 hours. Mr . Quoirin and the children flew
from London Heathrow to Abu Dhabi and then from Abu Dhabi to KLIA . Mr.Quoirin and
his three children arrived at KLIA on the 3rd of August 2019 at 10 o’clock in the morning
where they then met up with Mrs. Quoirin who was flying from Singapore. Then a driver, a
local Malaysian man arranged by the Dusun picked the family up from KLIA to the Resort.
The journey took them less than an hour. And perhaps 45 minutes. Nora Anne stayed awake
on the road. The Quoirin family arrived at the Resort in the afternoon. The day was hot.
There, they were entertained by Nor Asmaq binti Lokman, manager of the Resort who then
brought them to their accommodation at the Sora House, an open air concept. Nora’s family
check in at the Sora House, The Dusun Resort, Pantai, Negeri Sembilan, which is a 30 minute
drive from the state capital Seremban and located in the foothills of the Titiwangsa mountains
and next to a forest reserve. And then ,decided to go for a walk. To just explore the trails
where within the resort. Nora’s family didn’t go far they walk for about 30 minutes around
the resort and very slowly because they were quite surprised at how tricky it was. Then ,
Nora’s family decided to go the second pool the bottom pool which is bigger. Nora was quite
tired at this point and didn’t really want to stay in the water. Nora had gone to sleep upstairs
with her two younger siblings, presumably in her own room.  At night , before going to bed
the children refused to wear any clothing. They all slept in their underwear because it was so
hot.
The next morning, 4 th August 2019, at about 8.00 a.m. Nora Anne’s father, Sebastian
Marie Phillipe Quoirin discovered Nora Anne missing from her bed . Nora’s family searched
for her outside the Sora House. They were later joined by the staffs of the Resort and some
other tourists but yielded no result still. Mrs. Quoirin only noticed that the window with
broken latch was open when she got back to the Sora House. In the meantime, Haanim
Ahmed Bamadhaj, owner of the Resort went to the Pantai Police Station to lodge a missing
report at about 11.08 a.m.. Nothing in the report mentioned any possible abduction neither the
opened window with missing latch. The police had then carried out initial searches for the
missing Nora Anne in response to the said report. Simultaneously, the police had activated
criminal investigation into her disappearance. The Department of Foreign Affairs confirms it
is providing assistance to the Nora’s family, and police are aided in their search of the
surrounding jungle by sniffer dogs. A search team of around 119 people that included
firefighters and police officers from Negeri Sembilan's K9 unit was initially deployed to look for
the Nora. Another 40 officers from the Police General Operations Force have since joined the
search as efforts intensified. Search teams were assisted by local Orang Asli people, who have
knowledge of the jungle terrain, while two shamans also joined the operation .  
On 5 th August 2019 , a British charity said that Malaysian police were treating
Nora's disappearance as a potential abduction, but officers denied there was any foul play
involved. The Lucie Blackman Trust, a charity supporting missing people abroad, said police
believed the teenager could have been taken. Malaysian officials said they do not suspect foul
play, and it is revealed that Nora’s father raised the alarm when he discovered her missing at
8am local time. Nora’s aunt, Aisling Agnew, said Nora has learning and developmental
disabilities, making her especially vulnerable and adding to the family’s belief that she did
not disappear voluntarily. Nora's family said they believed her to have been abducted.
Unfortunately, closed-circuit television (CCTV) cameras at the Dusun Resort were limited to
the reception area, thus no footage of Nora on the night of her disappearance is available.
Sergeant Kong San, who has 20 years experience with sniffer dogs, said he knew the hound
had failed to pick up the scent because of its behaviour and gait.
On 6 th August 2019 , Malaysian police said Nora left her bedroom of her own accord
after collecting evidence from Nora’s siblings. Police chief Datuk Mohamad Mat Yusop said
a search of the girl’s room at the resort did not turn up any evidence of a criminal element in
her disappearance.The police focused on three main criminal elements in the investigation on
the case .Nilai police station chief Inspector Mohd Nor Nikman Ahammed , who is the 46th
witness, said the first element was on the deoxyribonucleic acid (DNA) of the blood stains on
the ground floor toilet and sweat samples found on the top floor of Sora House, where the
teenager and her family stayed after arriving in Malaysia  . Samples were also taken from
nine vehicles, as well as a wooden hut near where the victim’s body was found and none had
Nora Anne’s DNA.The second element of the investigation, was on fingerprints of the
occupants of Sora House, employees and occupants of The Dusun Resort, members of the
public who were in the area and the Nora’s family members.In this case, there are 11 reports
on fingerprints,when testifying in the inquest proceeding to determine the cause of Nora
Anne’s before Coroner Maimoonah Aid, which enters the 23rd day today.Mohd Nor Nikman,
33, who was the case investigating officer then, said fingerprints were also taken from the
windows , door, as well as the banister of the staircase at Sora House.The investigator said
the recording of witness statements was the third element in the investigation and a total of 91
witness statements were recorded, including by the climber who found the Nora’s body,
deceased, family members of The Dusun owner, its customers and visitors, as well as
members of the public who participated in the search and rescue operation for the victim.
On 7 th August 2019 , a team of divers searched a river in the forest near the resort. A
helicopter, two drones, sniffer dogs and 214 people from various government agencies have
already been deployed in the search for the girl. Che Zakaria Othman, deputy police chief of
Negeri Sembilan state where the resort is located, said around 20 witnesses including family
members had been interviewed. Police confirm that forensic experts took 8 fingerprints from
the window panel of Nora’s bedroom. At the location, the forensic team collected three
swabbings believed to be perspiration samples, three hair samples belonging to the missing
person . Deputy Superintendent C. Tharmalingam of Bukit Aman’s Crime Scene
Investigation Unit then said he utilised luminol to detect trace amounts of blood that may
have been wiped clean prior to his arrival at The Sora House where Nora was last seen before
she disappeared on August 4, 2019. Tharmalingam told the court he managed to obtain small
droplets of such samples on the floor of a bathroom adjacent to the main bedroom on the
ground floor through the luminol spray he had used. Tharmalingam explained that he had
assumed the missing Nora may have been injured during a scuffle and would therefore leave
a blood trail after taking into account the possibility of foul play elements.
On 8 th August 2019 ,The search team uses a recording of Nora's mother calling her
name in the hope that a familiar voice might draw out the timid youngster if she is in the jungle.
Officials play a recording of the girl's mother calling "Nora, Nora darling, I love you .
mummy's here", through loudspeakers.Voices of other family members have also been recorded
and will be used. Police believe the girl is still in the area of jungle where the search is focused.
The 29th witness, Muhammad Firdaus Kamarudin, 35 years old release a statement related to
Nora investigation case .I was then on my way to work at the Gunung Berembun water plant
by motorcycle at about 7pm and that was when I saw, at a glance, a woman with long brown
hair of medium build ,fair skin and without her clothes taking a bath with her back facing me
in a river in the area on Aug 4. He could not see the face of the said girl and he testified that it
was a common occurrence in that area .
On 9 th August 2019 ,  Police find footprints in the jungle as the search stretches into
its fifth day with the imminent threat of heavy rain and thunder hampering efforts. Posters
with Nora’s picture attached have been handed around the local area in the hope that
someone recognises the teenager. They even consider the unlikely theory that mystical forces
played a part in Nora’s disappearance, paying respect to local folklore. The Nora’s family
release a statement describing their daughter as ‘not like other teenagers. She have cognitive
issue but also a physical issue. She couldn’t manage zips or buttons particularly buttons with
any ease. She couldn’t manage any activity for instance, where she had to move her hands
behind her back. She couldn’t twist an object or try to open anything with any force. She is
not independent and does not go anywhere alone. Nora can read like a young child, but she
cannot write more than a few words. Then , nine drones equipped with heat detection
technology are deployed, as authorities step up the search for Nora.
 On 10 th August 2019 , further details of Nora’s condition are published in a second
statement. She has a good memory, but she cannot understand anything conceptual. She is
unable to do maths and so things like money are impossible to manage. She can wash and
dress herself and struggles to wash her hair. She cannot make or receive phone calls
independently. She couldn’t hold a phone closely to her ear. Nora’s teacher said that we
communicated using phone with video because it was too hard for Nora to coordinate hand to
mouth activity . On the 6 th day of search, 317 people are took part in the search effort,
which is limited to a specific 4km radius around the property she went missing from, with
concern growing as police do not know how much longer she can survive after being missing
for a week. Nora's mother, Meabh, thanks the hundreds strong search party for their efforts in
looking for her daughter. Nora’s mother said , we see you working so hard and also praying
with us and being with us and we know you have given up your time especially at a special
festival time. It means the world to us, and we are so grateful for everything that you are doing
for us, she says .In a statement, police said that they have narrowed the search area as they
step up their efforts. Police also confirm they are looking into people with criminal backgrounds
around the area and have searched the homes of hotel employees. 
On 11 th August 2019 , Nora is missing for a week, with hundreds of rescuers still
involved in the search operation. Malaysian authorities activate a hotline for the public to call
in and give tip-offs in the search for Nora. A reward of RM50,000 (US$11,900) has been
offered by the family of Nora Quoirin to help find the missing Irish teenager who went missing
from a Malaysian resort more than a week ago. Nora’s mother said that Meabh Quoirin Nora is
our first child. She has been vulnerable since the day she was born. She is so precious to us, and
our hearts are breaking. Nora’s parents are appealing to anyone who has information about Nora
to help us to find her. The police have been working extremely hard to bring Nora home. She
added that the RM50,000 was donated by an anonymous Belfast based business.  

On 12 th August 2019 ,forensic team said that Nora Anne’s fingerprints were not found
in the open window. An obvious explanation is that they were not there because she did not
open the window. There were four prints which were incomplete and incapable of
comparison. There were four further prints which were capable of comparison, but there was
no match from the police database, or from the witnesses in the case whose fingerprints were
taken. This means that the police were not able to use this evidence to identify a suspect. It
also means that someone who is unidentified had touched the window from the outside. This
clearly leaves open the possibility that the owner of the fingerprints was involved in Nora
Anne’s disappearance. The location of the prints is in itself suspicious, as there is no clear
reason why anyone would need to touch the window from the outside. All of this leaves open
the very real possibility that a third party was involved in Nora Anne’s disappearance.There
were no relevant findings in respect of forensic evidence from the Sora House. It is submitted
that this is not determinative of the issue of whether a third party was involved in Nora
Anne’s disappearance. Several police officers from England, France and Ireland are helping
local police in the investigation. The search area has been extended to a 6km radius, according
to Negeri Sembilan police. 
Around 3.15pm on August 13, 2019, the Negeri Sembilan police contingent’s D10
(Forensic Laboratory Division) arrived at an oil palm plantation. Nora naked body was found
beside a small stream about 2.5km from the Dusun resort on Tuesday afternoon  after a 10 day
search . Forensic team discovered the nude corpse of a female child who we believed was a
foreigner based on her brown hair, light blue eyes and fair skin. Forensic team checks on the
body and found no traces of injuries except scratches on the legs and insect bites all over the
body . In affirming there were no serious injuries sustained, Udiasoorian said this was evident
when he conducted a detailed check of the body from head to toe. The investigator agreed
that this was based on his external observation of the body when it was found and that any
internal injuries sustained by Nora during the time of her disappearance had yet to be
ascertained.. Her family identifies her remains at a hospital morgue later that evening. Nora's
body was taken by helicopter to a local hospital where she was identified by her parents.At a
news conference, deputy inspector general of police Mazlan Mansor said that Nora's naked body
was found beside a small stream about 2.5km from the Dusun resort. The police did not say if
there were any signs of injury on her body .

A post mortem was carried out on 14th August 2019 by Dr Siew Sheue Feng and Dr
Hanif bin Mahmud the estimated time of death based on the postmortem changes is about 2
to 3 days but less than 4 days . Although there was disparity between the entomology report
which states that the deceased was dead at least 4 days prior to the collection of the larvae
from the cadaver, which put the time of death as the 10th of August 2019, for Dr Siew and Dr
Hanif, the difference was minimal and they would go by their finding because they were the
ones who examined the body, the finding was supported by the original photos of the
deceased taken by the police and Dr Hanif went to scene to view the body himself on the day
she was found. After the post mortem on the 14th we think we need to go to the scene to
expand those injuries on her legs and so because there are so many scratch marks caused by
the tree branches. So, we want to know how she can get those injuries. That why we ask the
police to bring us to visit back whether these injuries pattern is tally with the injury sustained
when she was there or maybe we want to make sure those injury she sustained over the area
and not people inflict on her.

Based on Nora’s post-mortem results, state police chief Mohamad Mat Yusop


revealed that the official cause of death was upper gastrointestinal bleeding due to duodenal
ulcer complicated by perforation, meaning there was internal bleeding in the intestines due to
an ulcer which was brought on by starvation. The cause of death was due to ruptured
intestines which could be because she had no food for a long period and also long-term stress
said by Mohamad .Perforation of a stomach ulcer can be life threatening if left untreated.
According to the Mayo Clinic, ulcers can be caused by a range of things, from H.pylori
bacteria in the digestive tract to certain medications. Extreme stress is not a direct cause, but
it can make an underlying ulcer worse .Nathaniel Cary, a forensic pathologist who performed
a second autopsy on the body of Nora Anne Quoirin in the United Kingdom, he agreed with
Malaysia’s findings that the teen died of intestinal bleeding due to starvation and stress. Her
mother, Meabh Quoirin, said she may have been abducted but police ruled out abduction,
saying they had found no sign of foul play. Cary said that the autopsy on the girl’s body had
been thorough, but the decomposition made it difficult to ascertain the circumstances of the
teenager’s death.He agreed that he could not dismiss the possibility that Nora Anne’s body
may have been placed there after her death as rescuers had previously searched the specific
location.Then , Nora’s family has sued the resort owner for alleged negligence. They said in
their lawsuit that there was no security at the resort and that the window with a broken latch
was found ajar the morning Nora disappeared.

In conclusion , in this case the fact that there were no marks is not conclusive of
whether a sexual assault may have taken place. There is no evidence of a violent sexual
assault. However, all pathologists were consistent in stating that there was no way that they
could discount the possibility that Nora Anne had been the victim of a sexual assault at some
time in the days between her going missing and her death. The DNA and physical evidence
show that Nora Anne was not the victim of sexual offences. Nora Anne was barefoot and
wearing only her underwear when she disappeared. That was the last clothes she was seen
wearing by her mother .There was no CCTV on site and no guard on patrol at the Resort.
Hence,investigator said that it is impossible in this kind of case and circumstances to have a
precise direction and time of Nora Anne before she was found at the palm oil plantation.
There was no one involved in the death of Nora Anne. No criminal element. It is more
probable than not that she died by misadventure . For instance , Nora had gone out of the
Sora House on her own and subsequently got lost in the abandoned palm oil plantation. The
Malaysian police had classified her disappearance as a missing persons case.
