AFFIDAVIT OF DESISTANCE

I,____________, of legal age, married, and a resident of Brgy. Brgy.

Sabangan, San Fabian, Pangasinan after having been duly sworn to in accordance
with law, hereby depose and state:

That I am the private complainant in ______________ for Estafa and

Violation of Batas Pambansa Bilang 22 against ________________G, which is
pending before the Office of City Prosecution Office, Dagupan City;

That after a thorough re-assessment of the obligation of said respondents

herein pertaining to the said checks subject matter of this complaint, I came to
discover that there was misaccounting and that the respondents have fully paid
their accounts even prior to my filing of the instant complaint;

That by reason thereof, I have lost interest in the further prosecution of the
above-entitled complaint and that I am requesting the Honorable Public Prosecutor
to cause the dismissal of the aforesaid complaint;

That I am voluntarily, intelligently and freely executing this affidavit to

attest to the truth of the foregoing statement and for all legal intents and purposes.

That I am busy with my work, usually traveling from one place to another in
order to tend dried fish and for this reason, I am no longer interested in the further
prosecution of this case;

That I could no longer contact the witness in this case considering the length
of time the incident transpired;

That I am not forced, coerced nor intimidated in executing this Affidavit of

Desistance;

That I am respectfully praying to this Honorable Court to consider this

Affidavit of Desistance for the dismissal of the instant case;
