MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This MEMORANDUM OF AGREEMENT is made and executed by and between

CARANDANG LAW OFFICE, a Law Office engage in providing legal services involving civil,
criminal, labor, administrative and other legal matters; hereinafter called the LEGAL COUNSEL,
- AND –
______________________, Filipino, of legal age with resident address at Tagbilaran City,
Bohol hereinafter called the CLIENT.

WITNESSETH:

I. PURPOSE

The Legal Counsel is herewith to represent Client in “__________________________ Case”.

II. DURATION OF AGREEMENT

This agreement is made effective from the moment both parties signed this agreement and shall
remain effective until the case is disposed with finality or compromised or withdrawn by the legal
counsel for some valid reasons or the client decided to withdraw the representation of the legal
counsel in the aforesaid case;

III. ACCEPTANCE FEES AND OTHER LEGAL FEES

That the legal counsel hereby agrees to take the above-mentioned case provided that the client
pays the acceptance fee in the amount of FIFTY THOUSAND PESOS (Php 50,000.00); That upon
the execution of this contract, a down payment of _______________________________ and an
appearance fee of _________________________________) per hearing. That the remaining
balance of __________________________________________ shall be paid in an installment
basis.

That failure of the client to pay the aforesaid fees shall give the right of the counsel to withdraw
from the above-mentioned case at any stage of the proceedings if despite demand the client had
been reluctant to satisfy the obligation.

III. LEGAL COUNSEL’S DUTIES

That legal counsel accepts the agreement and shall take all reasonable steps in the aforesaid case
the legal counsel considers worth doing for the best interest of the client and without violating the
Constitution, law, legal ethics and legal procedure. It includes but not limited to preparation of legal
documents related to the case and enforcement of client’s rights. Furthermore, the Legal counsel
must keep with utmost secrecy and confidentiality all matters divulged by the client and should only
be revealed when permitted by the client. The staff or employees of the law office shall also cover
by such oath of confidentiality and shall endeavor to maintain and keep safe all papers, documents
and objects delivered by the client related to the aforementioned case. The legal counsel must also
inform the client of the developments or status of the case.

IV. CLIENT’S DUTIES

The client agrees to the following:
 To cooperate and be truthful with the legal counsel;
 To respond or properly communicate with the lawyer or Law office in matters relating to the
case;
 To keep the legal counsel abreast of the developments, current residences, contact
numbers of the client as well as the adverse party;
 To pay on time as agreed upon in this contract;
 To not insist or mandate the lawyer on what specific legal action to take that would violate
the Constitution, law or the Code of Professional Responsibility.
 To keep any information acquired in the office or in the course of discussion with the legal
counsel in secret or with utmost confidentiality unless permitted by the legal counsel or the
person concerned.
 To deliver pertinent or important documents required by the court or any tribunal where the
case is pending or that is required by the legal counsel;

V. VIOLATION OF TERMS OR AGREEMENT

That any deviation from the term by any party shall cause the rescission or annulment of this
contract. The client once he /she had delivered to the Law office or to the legal counsel the fees
mentioned above can no longer asked for refund unless the legal counsel have not done any steps
to ensure success in the case or had not appeared when required or requested by the client or was
not able to acquire the documents or paper asked for.
