AGREEMENT ON CHILD SUPPORT AND CUSTODY

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is entered by and between:

, of legal age, Filipino, married and a resident of Barangay, Pangantucan,

Bukidnon, herein to be referred to as Husband;

-and-

, of legal age, Filipino, married and a resident of Barangay Managok, Malaybalay

City, Bukidnon 8700, herein to be referred to as Wife;

WHEREAS, the parties were lawfully married on DECEMBER 12, 2013 at REGIONAL
TRIAL COURT BRANCH 9, City of Malaybalay, Bukidnon.

WHEREAS, the parties hereby agree to live separately and apart, subject to the terms
and conditions as set forth below.

WHEREAS, the parties have legitimate children namely:

MARCH 16, 2020 2 years old

WHEREAS, the parties intend to be civil with each other and have agreed the following:

THAT, the wife will have full custody of the legitimate children namely:
THAT, neither party may change his/her residence or that of any minor child of
the
parties without ____ days prior written notice to the other party.
THAT, the husband can visit and bring the children to his residence every
weekend only.

THAT, the husband shall timely send to the wife the following: SIXTY PERCENT
(60%) of his SALARY and SIXTY PERCENT (60%) of the VAN RENTAL PAYMENTS
for all children and every ____________ (week, month, etc.) as and for child support.

THAT, child support, as described above, shall continue until the first of the
following events:
(a) The child(ren) attains age 19;

 (b) The child(ren) dies;
(c) The custodial parent dies and the other parent assumes custody of the
child(ren).

THAT, The parties declare the following about their agreement regarding child
support:

(a) The parties are fully informed of their rights concerning child support,
including the right to have child support awarded in accordance with legislatively
determined guidelines;
(b) This agreement is being agreed to without coercion or duress;
(c) The agreement is in the best interests of the child(ren) involved;
(d) The needs of the child(ren) shall be adequately met by the stipulated
amount;

THAT, the personal property of the parties will be divided as follows:

(a) The wife can use the NMAX motor vehicle anytime at her option.
(b) The wife can use the HIACE GRANDIA VAN vehicle upon vacancy of the
vehicle from the car rental schedule.

WHEREAS, each party acknowledges that he or she respectively:

(1) is fully informed as to the facts relating to the subject matter of this
agreement, and as to the rights and liabilities of both parties;
(2) enters into this agreement voluntarily, free from fraud, undue influence,
coercion, or duress of any kind;
(3) is representing themselves in an “in pro per” status and is therefore not
represented by legal counsel;
(4) prior to executing this agreement, either party may have this agreement
reviewed by an attorney; and
(5) has read, considered, and understands each provision of this agreement.
