DECISION
For final disposition of this Terminating Authority is the Termination Case for
Violation of Section VII para A Sub p (1)(B) of NAPOLCOM MC 2017-035 (Lack of
Aptitude against Pat Neil Mark Cruz assigned with the PNP Maritime Group pursuant
to NAPOLCOM Memorandum Circular No. 2007-009.

Pat Cruz3. He was then ordered to return to his unit (MG) pursuant to SO 05-145-
2021.
On May 12, 2021, Pat Cruz was formally charged for violation of Section VII
para A sub p(1)(B) of PNP MC 2017-035 (Lack of Aptitude in Service), in relation to
NMC No. 2007-009. Said case was docketed under TPC No. 024-051221.
Subsequently, respondent was summoned and directed to submit his Answer in
affidavit form accompanied by documentary evidence in support of his defense.
This Termination Board is of the view that the PNP could not force Pat Cruz to
marry the complainant against his will. Otherwise, it is tantamount to coercion.
Relatively, the Board is of the view that Pat Cruz could not be held answerable for
the alleged breach to promise to marry the complainant. That this Termination Board
generally looked in disfavor the retraction of testimonies previously given by affiants.
However, after careful deliberation, this Termination Board considered the
reconciliation of the two parties’ as well as the well-being of their child.
This Termination Board recognizes the family as the basic foundation of the
nation, its solidarity should be strengthen and the State should promote its
development as provided and protected by the Philippine Constitution. This Board is
of the view that the subsequent reconciliation and the dismissal of the criminal case
against respondent had rendered the instant case moot and academic.
So Ordered.
