and PSSg Albert C Homerez

1. Reference: Memorandum dated June 30, 2023 from C, RLO 8 with

subject: “Endorsement re Request for Legal Assistance/Representation of PMAJ
IAN SALVADOR BPO and PSSg Albert C Homerez in Administrative Case No.
RIAS8-MP12-2023-030 for Grave Misconduct and Grave Neglect of Duty.”

2. This pertains to the request for legal assistance/representation of PMAJ

IAN SALVADOR B PO and PSSg Albert C Homerez, PNP member, presently
assigned at Regional Police Drug Enforcement Unit 8 and Merida MPS, LPPO in
relation to the complaint filed against them for Grave Misconduct and Grave Neglect
of Duty before the Regional Internal Affairs Service 8 docketed under Administrative
Case No. RIAS8-MP12-2023-030.

3. Based on records, at about 8:30 in the evening of April 13, 2023, at

Barangay Binabaye, Merida Leyte, joint elements of Merida MPS and RPDEU8 led
by PMAJ IAN SALVADOR B PO conducted a buy-bust operation against Rustom
Diano Sanoria (“Rustom”) and France Carlo Maraveles Pogonia. After the
consummation of the drug transaction, the poseur-buyer executed the pre-arranged
signal prompting the arresting officers to rush towards the suspects to effect arrest.
However, in the same instance, one of the suspects later identified as Rustom
sensed and noticed the approaching police operatives, immediately drew his firearm
of unknown caliber from his waist and fired towards the operating team, leaving
PSSG Homerez, with no recourse/option than to defend themselves by firing back
hitting the suspect in his lower left leg and was subsequently subdued. The other
suspect was also subdued and arrested. The wounded suspect was immediately
brought to the nearest hospital for medical intervention.

4. Due to this incident, an administrative case for Grave Misconduct and

Grave Neglect of Duty, respectively, for violation of Article 250 (Frustrated Murder)
of the Revised Penal Code was filed against the respondent. Hence this request for
direct legal representation.

5. After careful review of the documents submitted and endorsed C, RLO

8, this Division finds the said case to be service related/ connected, compliant with
the requirements set forth in PNP MC 2017-062 and is hereby recommended to be
approved. Further recommend PLTCOL ANNA LUISA A CENTINO to be designated
as Legal Counsel of the subject PNP personnel and be provided with necessary fund
support.

6. Respectfully recommend approval of paragraph 5 and signature on the

attached Memorandum for PLTCOL ANNA LUISA A CENTINO.
