Vitales ‘A RESOLUTION AUTHORIZING THE HONORABLE MAYOR MAR-LEN ABIGAIL S. BINAY AND/OR HER DULY AUTHORIZED REPRESENTATIVE TO NEGOTIATE, ENTER INTO AND SIGN A TERM OF PARTNERSHIP (TOP), AND ALL OTHER PERTINENT DOCUMENTS RELATIVE THERETO, FOR AND IN BEHALF OF THE CITY GOVERNMENT OF MAKATI, WITH DEPARTMENT OF HEALTH (DOH) - METRO MANILA CENTER FOR HEALTH DEVELOPMENT (MMCHD), REGARDING THE IMPLEMENTATION OF THE ANNUAL OPERATION PLAN (AOP) OF THE CITY GOVERNMENT OF MAKATI AND THE CARRYING OUT OF HEALTH SECTOR REFORMS OF THE UNIVERSAL HEALTH CARE (UHC) ACT, SUBJECT TO EXISTING LAWS, RULES AND REGULATIONS. (TY RESOLUTION Nt V “Ang Makati ay para sa kapwa ko taga Makati.” ¥WHEREAS, Section 15, Article II of the 1987 Philippine Constitution provides that “(T)he State shall protect and promote the right to health of the people and instill health consciousness among them."; WHEREAS, Section 11, Article XIII of the 1987 Philippine Constitution also provides, among others, that the State shall adopt an integrated and comprehensive approach to health development, which shall endeavor to make essential goods, health and social services available to all people at affordable cost; WHEREAS, it the policy of the City Government of Makati to provide the best possible health care to its constituents by strengthening the delivery of its health care programs and services; WHEREAS, Section 22 of Republic Act No. 11223, otherwise known as the Universal Health Care (UHC) Act, mandates the National Government to make available commensurate financial and non-financial matching grants, including capital outlay, human resources for health and health commodities, to improve the functionality of province-wide and city- wide health systems, provided that the grants shall be in accordance with the approved province-wide and city-wide health investment plans; WHEREAS, the FOURMmula One Plus for Health (F1 Plus), with its tagline “Boosting Universal Health Care”, is the strategic Framework for Health Sector Reform which aims to attain the goals outlined by the Philippine Government in the Philippine Development Plan, the Sustainable Development Goals, and The Ambisyon Natin 2040; WHEREAS, the City Government of Makati continuously implements health sector reforms consistent with the Universal Health Care Act and the FOURmuta One Plus for Health and has proven its capacity to utilize investment and sustain the reform process, among others; WHEREAS, Department of Health (DOH) - Metro Manila Center for Health Development (MMCHD) manifests its willingness to work jointly with the City Government of Makati to carry out the health sector reforms under the Universal Health Care Act; WHEREAS, a Term of Partnership (TOP), among other documents, between the City Government of Makati, and DOH-MMCHD is necessary in order to guide the parties in carrying out the abovementioned purpose; WHEREAS, Section 8 (a) (6) of R.A. No. 7854, otherwise known as the Charter of the City of Makati, provides that the City Mayor, as the chief executive of the city government, shall exercise those powers expressly granted to him by law, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for the efficient and effective governance of the City, and those which are essential to the promotion of general welfare such as to represent the City in all its business transactions and sign on its behalf all bonds, contracts, and obligations, and such other documents upon authority of the sangguniang panlungsod or pursuant to law or ordinance; WHEREAS, considering the reasonableness and absence of any legal impediment to the proposed partnership, the Sangguniang Panlungsod of Makati, pursuant to the abovementioned provision of law, hereby approves this Resolution. NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED BY THE SANGGUNIANG PANLUNGSOD OF MAKATI, METRO MANILA, BY VIRTUE OF THE POWERS VESTED IN IT BY LAW, IN SESSION ASSEMBLED, to authorize the Honorable Mayor Mar-len Abigail S. Binay and/or her duly authorized representative to negotiate, enter into and sign a Term of Partnership (TOP), and all other pertinent documents relative Page | 2thereto, for and in behalf of the City Government of Makati, with Department of Health (DOH) - Metro Manila Center for Health Development (MMCHD), regarding the implementation of the Annual Operation Plan (AOP) of the City Government of Makati and the carrying out of health sector reforms of the Universal Health Care (UHC) Act, subject to existing laws, rules and regulations. RESOLVED FURTHER, that copies of this Resolution be furnished to Office of the Mayor, Office of the City Administrator, Law Department, Makati Health Department (MHD), Ospital ng Makati (OSMAK), Budget Department, Accounting Department, Information and Community Relations Department (ICRD), Department of the Interior and Local Government - Makati City Field Office (DILG-Makati City), Department of Health (DOH) - Metro Manila Center for Health Development (MMCHD), and other departments, offices, and agencies concerned for their information, guidance and reference.
