KNOW ALL MEN BY THESE PRESENTS:

WHEREAS, on February 14, 2016, Juan Pedro, executed a Real Estate


Mortgage in favor of the mortgagee, Development Bank of the Philippines,
which was duly annotated on the title of the mortgaged property on February
15, 2016 for in consideration of the sum of TWO MILLION FIVE
HUNDRED THOUSAND PESOS (PHP 2,500,000.00) Philippine currency,
over the registered real property and all improvements thereon,
including thereafter that maybe erected upon, described as follows:

Transfer Certificate of Title No. 12345

“A parcel of land (Block Lot 4 of the subd. plan, Psd-043425-062914,


being a port. of Psu-119423, LRC Rec. No. 301102), situated in the
Bo. San Vicente, Mun. of San Pedro, Prov. of Laguna. Bounded on
the SE., along line 1-2 by Rd. Lot 2; on the SW., along line 2-3 by Lot
40, Blk. 2 both of the subd. plan; on the NW., along line 3-4 by prop.

of Elvira Gerodias; & on the NE., along line 4-1 by Lot 42, Blk. 2, of
the subd. plan. Beginning at a pt. marked 1 on plan, being N. 12 deg.
17’W., 484.66m. from BLLM 1, Mun. of San Pedro, Laguna. Thence
S. 27 deg. 46’W., 4.00m. to pt. 2; N. 62 deg. 14’W., 13.00m. to pt. 3;
N. 27 deg. 46’E., 4.00 m. to pt. 4; S. 62 deg. 14’E., 13.00m. to the pt.
of beginning, containing an area of TWO THOUSAND NINE
HUNDRED TWENTY FOUR (2,924) SQ. METERS. All points
referred to are indicated on the plan & are marked on the ground by
PS. cyl. conc. mons. 15x60cm.”

WHEREAS, on May 20, 2017, the Petitioner-Mortgagee filed an


application for Extra-Judicial Foreclosure of Real Estate Mortgage under Act
No. 3135, as amended, alleging among others that the respondents-mortgagor,
Juan Pedro violated the terms and conditions set forth agreed and/or
stipulated in the Real Estate Mortgage Contract, which as of May 15, 2017,
the total indebtedness of the respondents-mortgagor already amounts
to TWO MILLION FIVE HUNDRED THOUSAND PESOS (PHP
2,500,000.00). Accordingly, demand letters for payment were sent but
the respondents- mortgagor, Juan Pedro ignored all the demand letters;

WHEREAS, pursuant to the provisions of Act No. 3135 as amended,


announcement/notice was made that the above-described property will be sold
at public auction on July 5, 2017 at 10:00 o’clock in the morning in front of
the Regional Trial Court, 4th Judicial Region, San Pedro, Laguna, to
the highest bidder for cash and in Philippine Currency to satisfy the debt;

WHEREAS, during the scheduled public auction sale on July 5, 2017,


at 10:00 o’clock in the morning, the above-described property was sold
at public auction and the highest bidder was the Petitioner-
Mortgagor, Development Bank of the Philippines, bidding the above subject
property in the amount of TWO MILLION FIVE HUNDRED
THOUSAND PESOS (PHP 2,500,000.00). Philippine currency
inclusive of other incidental expenses and which amount was NOT
however remitted to this Office but was merely charged/credited as full
satisfaction of the mortgage obligation;

NOW THEREFORE, the aforementioned property subject of the


above-entitled Foreclosure Case was sold, transferred, ceded, alienated and
conveyed to the herein Petitioner-Mortgagee, DEVELOPMENT BANK OF
THE PHILIPPINES, its successors or assigns under the guarantee prescribed
by law. The period of REDEMPTION of the above-described property will
expire within ONE (1) Year from the REGISTRATION of this Certificate of
Sale with the Register of Deeds of the Province of San Pedro.
