OHS is particularly relevant to employees and volunteers. The purpose of the Work Health
and Safety laws (WHS laws) are to protect the health, safety and welfare of employees,
volunteers and other persons who are at, or come in to contact with a workplace.

Australian Standards and Australian/New Zealand Standards (the standards) are developed by an
independent organisation called Standards Australia. It prepares and publishes voluntary technical and
commercial standards which are sometimes adopted by occupational safety and health regulations.
Specifies requirements for the design, selection, construction and installation of fixed platforms,
walkways, stairways and ladders that are intended to provide safe access to places used by operating,
inspection, maintenance and servicing personnel.

affected by its work. The WHS Act places the primary duty of care and various other duties

PCBU is set out in section 5 of the WHS Act. This is a broad concept used to capture all types
of modern working arrangements.

Their duty of care: A 'person conducting a business or undertaking' (PCBU), who is usually
the employer, has the primary duty of care under the Work Health and Safety Act 2011
(WHS Act) to ensure the health and safety of workers and others at the workplace, so far as
is reasonably practicable. The PCBU is the legal entity carrying out a business or
undertaking and is important to the scheme of the new legislation as it is the primary duty
holder under HSWA. A PCBU is intended to be broad in its definition so that it covers all
work and business activities.
b. Officers
The officer’s obligation of due diligence relates to any duty or obligation that the PCBU may
have under the WHS Act or WHS Regulations, and is therefore potentially extensive in
scope.
However, a definition of ‘due diligence’ is provided, which may help an officer in finding
practical ways to comply with the duty. In particular, section 27(5) defines ‘due diligence’ as
including taking reasonable steps:
to acquire and keep up-to-date knowledge of work health and safety matters
to gain an understanding of the nature of the operations of the PCBU’s business or
undertaking and generally of the hazards and risks associated with those operations
to ensure that the PCBU has available for use, and uses, appropriate resources and
processes to eliminate or minimise risks to health and safety from work carried out
as part of the conduct of the business or undertaking
to ensure that the PCBU has appropriate processes for receiving and considering
information regarding incidents, hazards and risks and responding in a timely way
to that information

you move up or down the hierarchy.
The hierarchy is best represented with an inverted pyramid to illustrate how
effectivity of the control is reduced as you moved down the level. As you move
down the hierarchy or the inverted pyramid, the controls become less effective in
managing the risk.
The top-level in the inverted pyramid is the most effective in managing the risk,
and the lowest level is the least effective in managing the risk.
The level of risk can be determined based on the Hierarchy of Control Measures
(range of control methods used to eliminate or control hazards in the workplace)
by evaluating the risk against the hierarchy. It starts by looking at the risk and
asking if it can be eliminated, if yes, then the risk is totally eliminated, i.e. there is
no existing risk anymore. However, if it cannot be eliminated, you move to the next
control, which is the substitution – can the hazard where the risk is coming from
being substituted for something that is less hazardous? If yes, then we’ve reduced
the risk somehow, and this goes on down the entire hierarchy until the PPE control.
If the hazard could not be eliminated, substituted, controlled through engineering
adjustments, then it is established that the risk is still there, and the level of risk is
still very high.
Hazards should be re-assessed after the implementation of control measures, to
review if the risk has been reduced enough.
