CASE & COURT MANAGEMENT PLAN FOR


DISTRICT JUDICIARY PUNJAB
Introduction:

The efficiency in service delivery of an organization depends upon the


readiness of its members to support efforts that are intended to bring
improvement. Judiciary is no exception to it. The Judiciary in Pakistan is
grappling with the issue of burgeoning workload of both civil and criminal cases
in District Judiciary. The heavy pendency in district courts of the Punjab cannot
be reduced unless some scheme is evolved for the case and court management.
This plan is an effort for improvement and it focuses on rationalization of work
load as per the available human resource, categorization of cases, docket
management and constitution of specialized courts, to advance the disposal
strategies.

Background:

The endeavours for improvements started in the year 2001 when the
bifurcation of civil and criminal work was directed in the Courts of Civil Judges-
cum-Magistrates vide notification No. 1672/RHC/JOB dated 26.11.2001. Later
on, vide notification no. 8216/RHC/JOB dated 02.05.2002, scheme of bifurcation
for civil and criminal work was also directed qua the courts of District/Additional
District & Sessions Judges. Most of the districts have rationalized bifurcation
strategy for civil and criminal cases; but mere bifurcation of the civil and criminal
work is not the ultimate solution unless some specific case management plan is
devised to achieve the desired objective of clearing the backlog of cases.

Audit of Cases: In August 2016, an audit of the pending case load (1.2
Million cases) was got conducted in district courts to devise strategies for:

Categorization of Cases:

Categorization of cases has been finalized, keeping in view of data collected


through the Audit of Cases, by the District Judiciary Advisory Committee.

Case & Court Management Plan:


Model Courts:

To start with the case management strategy, criminal model courts were
initially established in four districts of the Punjab in February, 2017 to deal with
specific category of cases i.e. Murder Cases, Narcotics Cases and other Sessions
Cases. Thereafter, civil model courts were established in four districts, in the
month of May, 2017. The model courts disposed of a large number of old cases in
a short span of time and thereby materialized the objective of speedy
administration of justice.

ADR Centres:

ADR centres have been established in all the district courts of the Punjab for
amicable settlement of disputes pending in courts, as one of the methods to cope
with the heavy backlog of cases pending in courts.

The results encouraged for a large scale Case Management Plan, in the
whole Punjab. Therefore, Lahore High Court is initiating the establishment of
specialized courts, as per nature/category of cases, in district judiciary, in
addition to the bifurcation of work into civil and criminal sphere.

Specialized courts:

Specialized courts may be defined as tribunals of narrowly focused


jurisdiction to which all cases that fall within that jurisdiction are clubbed. Judges
who serve in specialized courts are considered specialists, rather experts, in field
of law that falls within their jurisdiction.

Objectives:

The objectives of establishing specialized


courts may be listed as under:

i. Development of expertise
ii. Improvement in efficiency
iii. Rationale distribution of work
iv. Clarity in goals and objectives
v. Better management of Docket
vi. Allocation of work as per expertise
vii. End of discretion and discrimination
viii. Capacity building in particular jurisdiction
ix. Accurate assessment of quantitative and
qualitative work
x. Expeditious disposal of cases through focus
on alike cause of action
xi. Release of pressure on Courts of general
jurisdiction
xii. Collaboration with other departments for
better service delivery to the public at large.

Rationalization Policy:

The Case Management Plan for civil and magisterial courts has been
formulated to rationalize the existing strength of officers, pending case load and
reasonable time required for proper dealing with a case in a logical and coherent
manner, in view of nature, category and complexity of the matter involved therein.
The purpose of the case management plan is speedy disposal of cases with focused
jurisdiction.

The plan has been chalked out for each district keeping in view:

a) pending case load of a particular category of cases


b) special jurisdiction of Senior Civil Judge (Judicial)
c) special jurisdiction of Senior Civil Judge (Guardian)
d) the peculiar factors and dimensions of the district

Considerations for Constituting Specialized Courts:

Specialized/category wise civil courts have been constituted on the basis of


the following methodology:

i. “Special Court” (Multiple Category Cases) necessarily includes inherent


jurisdiction of Senior Civil Judge (Judicial) i.e. Land Acquisition,
Environmental, Insolvency and Overseas Pakistani cases.
ii. “Special Court” (Multiple Category Cases) docket also includes other
category of cases, i.e. TMA, Board/University, WAPDA, NADRA, Rent
cases etc., where the case load of inherent jurisdiction is less than 500
cases.
iii. Separate Court has been constituted for a particular category of cases
(WAPDA, NADRA, Rent etc) where the workload thereof so justifies.
iv. Separate court for a set of jurisdictions has been constituted e.g.
Government department cases.
v. Guardian, Succession and Family cases have been considered as one set
of jurisdiction. Senior Civil Judge (Guardian) shall be the Judge Family
Court where the pendency does not justify the creation of more than one
family court. He will hear succession petitions instead of the Senior Civil
Judge-Judicial (special court) or regular civil court.
vi. Special courts have been constituted on the basis of data (up to
30.06.2017) of regular cases only.
vii. Miscellaneous applications/other cases and Execution Petitions are to be
distributed among the courts hearing the relevant category of cases.
viii. One specialized court can be constituted for multiple categories of cases
i.e. WAPDA, NADRA, Rent etc.

ix. Pending case load of Punjab is more than 1.2 Million and the working
strength of Civil Judges-cum-Judicial Magistrates is 1125; the docket of
courts has been rationalized so far it is practicable.
x. Presiding Officers of the specialized courts may be interchanged/rotated
periodically by the District & Sessions Judges.

Note: The plan has been devised for the headquarters; however,
specialized/category-wise courts may be constituted at Sub-Divisions of
the districts also by the District & Sessions Judges, if the working
strength of officers and pendency of cases there so allow.

i. One specialized sessions/district court can be constituted for one


category i.e. for Murder cases, Narcotics cases, Appeals etc and one
specialized courts for multiple category can also be constituted.
ii. A specialized murder cases court can be constituted on the basis of
50-70 murder cases work load and allocation of work to the other
specialized sessions courts shall be equal to 50-70 murder cases as
per the criteria mentioned above e.g. One trial court civil/criminal
shall be constituted on 210 case load and one appellate court (civil)
shall be constituted on 350 case load and accordingly.

Execution of the Plan:

i. Senior Civil Judges (Administration) and Mediators-ADR have not been


considered while rationalizing the workload but they have been included in
total required strength of a district.
ii. Senior Civil Judge (Judicial) being the Presiding Officer of the special court
shall not work as mediator.
iii. Specialized Courts in districts shall be established as per the annexure
relevant to the respective district.
iv. Once the specialized courts are established, the cases shall be transferred in
bulk immediately. Resultantly, the Cause list of the transferred cases shall
be generated and displayed in the transferee court (specialized court).
Intimation as to transfer of cases shall be made through posters, local

electronic and print media and notice-boards in judicial complexes and bar
rooms.

Nomenclature of Courts:

The specialized courts shall be identified through the special category of the
cases dealing with e.g.

i. Govt. Cases Court/NADRA Court/WAPDA Court etc.: (If there are more than
one specialized courts that shall be identified as Govt. Cases Court-I, Govt.
Cases Court-II ....)
ii. Regular Civil Court: (If more than one, that shall be identified as Regular
Civil Court-I, Regular Civil Court-II, Regular Civil Court-III....)
iii. Guardian/Family Court: (If more than one, that shall be identified as
Guardian/Family Court-I, Guardian/Family Court-II...)

Case Registration Number:

Presently, there is no uniformity in allocation of the case registration


number at the time of institution thereof. One registration number is assigned by
the office of District & Sessions Judge/Senior Civil Judge but that case number
does not continue rather the assignee court registers it with another number and
the case number undergo changes every time when it is transferred to some other
court. One case as such carries a series of numbers in its lifecycle and the number
initially allotted by the institution branch is lost in throng of numbers.

The institution branch number should play the role of a legacy number to be
carried on throughout the case lifecycle for tracking it from filing to disposal and
its continuity must be ensured to the record room and other branches i.e. copy
branch. In this scenario, every case needs to be identified with one number
assigned to it by the office of District & Sessions Judge/Senior Civil Judge and is
to be recognized with the same number throughout.

Magisterial Courts:

All the criminal cases (report u/s 173 Cr.PC )/Complaints shall be
registered in and routed through the office (institution branch) of the Senior Civil
Judge (Judicial) at the headquarter while in the office (institution branch) of CJ-I
at the sub-division and shall be numbered as follows:

PB-GRW/WZR-Crc.C-123-2018 (for criminal cases)

The assignee/transferee court shall index the number in his register as


follows:

PB-ATK-C.C-12345-2018/13-2018 (case reference number shall always be the


number assigned by the Senior Civil Judge)

Note: The registration number as per the scheme mentioned above shall start
from January, 2018.

Case Information Sheet (CIS):

The institution branches and courts are stamping the first page of the
pleading to assign the case number whereas there should have been a
separate cover page affixed by the office/branch at the time of institution to
note down the particulars of the case. So the case information sheet/cover
page is prescribed to be used from September, 2017.
Template of the CIS has been provided herewith.

Yellow Color Order Sheet:

To distinguish the order sheet from the other documents of the case file,
light yellow colour page shall be used for recording court proceedings.

Identification Of Year Wise Case Load & Disposal Target:

Delay in the dispensation of justice is a major challenge being faced by the


Judiciary in Pakistan. Institutional incapacities, in-built delay mechanisms in the
law as well as failings on the part of judges, officials, Bars, law enforcement
agencies and litigants may be mentioned as main causes of the crisis. However,
full potentials and capabilities of the Judges of District Judiciary need to be
employed to meet with the challenge and, at least, to perform their part, in the
system, for speedy administration of justice. The cases filed upto 31-12-2015
shall be treated as old and the courts shall prioritise disposal of old cases
mentioned in their respective Court Management Plan.

Court Room Number:

Civil and Sessions Courts in the district judiciary are provided furniture, IT
equipments, Electronics, Books, Curtains, Cushions etc; the said articles are
sometimes found misplaced, due to non-maintaining record of such articles with
reference to a specific court room.

All the District & Sessions Judges and the Senior Civil Judges
(Administration) in Punjab shall, therefore, mark numbers to all court rooms in
Civil and Sessions Courts at the headquarter as well as the sub divisions and
maintain record of the said articles with reference to the court room number. The
number of each court room shall be displayed at the door thereof.

The allocation of court rooms to the judges shall be made by the District &
Sessions Judge and any article may be shifted from one court room to the other
with his permission in writing and the necessary change in the record of articles of
both the court rooms shall be made accordingly.

Civil court room number shall be mentioned as CC-1. Civil Court Room No.
1 shall be assigned to the Court of the Senior Civil Judge (Judicial) and Court
Room No. 2 shall be assigned to the court of Senior Civil Judge (Guardian) and
rest of the numbers shall be allotted accordingly.

Session Court Room Number shall be mentioned as SC-1. Session Court


Room No. 1 shall be assigned to the court of District & Sessions Judge and rest of
the numbers shall be allotted accordingly.

Standardized Nameplate of Courts:

Standardized name plates (comprised of two parts) for the specialized courts
have been prescribed with font style “Arial” and size of plate “12 x 4 Court Name
Plate” (upper part) and “12x 3 Judge Name Plate” (lower part) Template of the
nameplate has been provided herewith.

Wearing Of Gown By Judges Of District Judiciary:

Uniform/proper dress code fosters traits which are necessary for a person
as an individual and organization as a whole to thrive and prosper. The need to
conform to a dress code is an integral part of the judicial system. Judges, in
different countries of the World, have been wearing such dresses that are sober
and dignified, with gowns, since long. Dress code of judges is not just a status

symbol but instils discipline and the confidence to fight for justice. All judges of
the District Judiciary shall, therefore, wear black gown with silver grey strip, from
September, 2017.

Uniform Of Staff:

Uniform fosters traits which are necessary for a person as an individual and
an organization as a whole to thrive and prosper. Wearing uniform by the
employees demonstrates identity of the organization. Uniform gives the employees
a professional and an executive look. It also gives the employees a sense of
belongingness. Wearing the same clothes leads to a feeling of team spirit. It
increases a feeling of loyalty and allegiance from the employees towards the
organization. It shows the organization is disciplined and so are its employees. All
the staff of the District Judiciary shall wear the prescribed uniform from
September, 2017. Templates of the Uniform have been provided herewith.

Id Cards For Retired Judges And Staff Of District


Judiciary:

Retired Judges and staff of the district judiciary face hardships in availing
the facilities available to retired public servants due to not having the identity card
of their status of being retired officers/official. The identity card for the retired
judges and staff of the district judiciary has been allowed to obviate this
incontinence.

Emblems of District Judiciary & Directorate of District


Judiciary:
Every organization has a distinct emblem/logo for its identification. The use
of emblem by an organization gives a sense of belonging and unity to all its

employees. The emblem specifies the goals of an organization and the people
working in it are guided thereby to achieve those goals. Emblems for the District
Judiciary Punjab as well as for the Directorate of District Judiciary have therefore
been prescribed.

Gender Diversity Policy:


WHEREAS recognition of gender mainstreaming and diversity has emerged

as „an inalienable and indivisible feature of all human rights and fundamental

freedoms1‟and has evolved as one of the core international values over the past

years as evidenced by various international and regional instruments e.g. the

Convention on the Elimination of all Forms of Discrimination against Women,

1979, the Beijing Platform for Action, 1995, the United Nations Millennium

Development Goals 2 , the European Convention on Human Rights and

Fundamental Freedoms and the Gender Policy of International Labour

Organization;

AND WHEREAS gender diversity and equality are grounded in the

fundamental law of our land as Article 25 of our Constitution commands that

there shall be no discrimination on the basis of sex and ordains that all citizens

are equal before law and are entitled to equal protection of law;

AND WHEREAS gender diversity in Punjab Judicial Service (District

Judiciary) attains even more importance as it should be reasonably representative

of the population it serves;

AND WHEREAS in order to stimulate gender diversity in District Judiciary of

Punjab on an institutional level, a policy is direly needed;

NOW, THEREFORE, the Hon‟ble Chief Justice and Judges of the Lahore

High Court, promulgate as follows:-

1. This policy shall be called as the Punjab Judicial Service, Gender

Diversity Policy, 2017.

2. That in the matters of initial recruitment to the posts of Civil Judges-

cum-Magistrates and Additional District and Sessions Judges, regard

shall be had, irrespective of the gender of the candidate, to personal

merit, experience, competence, performance, skills and abilities of the

candidate.

3. All Judges shall be provided opportunities to identify their additional

potentials and qualities and enhance their skills through trainings from

national and international institutions.

4. Female Judges from all tiers shall be given special representation in all

sort of administrative work and administrative committees of each

District.

5. Female judges shall be given adequate representation in all sort of

administrative work and in other district co-ordination committees in

every district i.e. Criminal Justice Committee etc.

6. The female judges shall be given adequate opportunity in all foreign

conferences and study tours to enhance their knowledge, capacity,

building and skills.

7. Female Senior Civil Judges shall be provided reasonable opportunities for

their posting as Senior Civil Judge in every District and they shall be

given sufficient opportunity as Senior Civil Judge in the new scenario of

appointment of Senior Civil Judge Administrative, Senior Civil Judge

Judicial and Senior Civil Guardian.

8. Judges especially the female judges of District Judiciary shall be given

sufficient representation in elevation as Judge of Lahore High Court.

9. Female judges shall be provided the court rooms having chamber and

wash rooms.

10. If it is not possible to provide residence to each judge, there shall be

rest houses for male and female judges separately.

Transfer Policy:
WHEREAS by virtue of Rule 4 of the Punjab Judicial Service Rules, 1994,

the Lahore High Court is the appointing authority of the members of Punjab

Judicial Service and by virtue of Rule 4(b)(xvii)(b) of Part A of Chapter 10, Volume

V, Lahore High Court Rules and Orders read with Revised Allocation of Business

issued vide Order no./HR dated 19-01-2017, the power to make postings and

transfers amongst the members of Punjab Judicial Service has been allocated to

the Hon‟ble Chief Justice;

AND WHEREAS the postings and transfers made hitherto amongst the

members of Punjab Judicial Service were not being governed by any well-defined

policy;

AND WHEREAS transparency and openness rekey ingredients to build a

strong and independent judicial institution and to create a conducive working

environment for the members of Punjab Judicial Service thereby contributing

towards betterment of system of dispensation of justice to the masses;

AND WHEREAS in order to promote equity, fair play, predictability,

objectivity and humanity/compassion in transfers of members of Punjab Judicial

Service and to avoid unnecessary disruption to the administration of justice and to

the lives of members of Punjab Judicial Service, a transfer policy is the need of the

hour;

NOW, THEREFORE, the Hon‟ble Chief Justice and Judges are pleased to

adopt the following policy:-

1. This policy shall be called as the Punjab Judicial Service Transfer Policy,

2017.

2. It shall come into force from September 01, 2017.

3. This policy shall govern the following tiers of Punjab Judicial Service as

defined in Rule 3 of the Punjab Judicial Service Rules, 1994:

a. District and Sessions Judges,

b. Additional District and Sessions Judges,

c. Senior Civil Judges-cum-Magistrates, and

d. Civil Judges-cum-Magistrates.

(Collectively referred to as „Judges‟)

4. Posting and transfer being an incidence of judicial service, the Judges are

liable to be transferred anywhere in the Province of Punjab including ex-

cadre and nothing contained herein shall create any right or interest in

favour of any member of Punjab Judicial Service in any post whatsoever.

5. Subject to clauses 6 and 7, the considerations for the transfer and posting of

a Judge will be as follows:

a. Competence,

b. Performance, and

c. Annual Transfer Report.

6. For the purposes of transfer and posting of an unmarried Female Judge, a

distance of 200 kilometres from district of domicile will be taken as an

additional consideration.

7. Notwithstanding anything contained in this policy, the interest of public and

that of the judicial system shall be the paramount consideration for the

purposes of posting and transfer of the Judges.

8. Notwithstanding anything contained in this policy, no Judge shall be posted

at a station which is situated within his/her District of Domicile, except

Lahore, Faisalabad, Rawalpindi and Multan for Female Judges and Lahore

for Male Judges.

9. Subject to the clauses of this policy and exceptions in the preceding clause,

a member of Punjab Judicial Service shall not be posted at a station if:

a. He/She owns landed property at that station of posting,

b. His/her in laws are residents of that station of posting, and

c. He/She has settled at that station for a period of last five years.

10. Following shall be the normal tenure of posting on a particular post

commencing from the date of joining for the Judges:

a. District and Sessions Judge One Year

b. Additional District and Sessions Judge Two Years

c. Senior Civil Judges Cum Judicial Magistrates One Year

d. Civil Judges-cum-Magistrates Two and a Half Years

11. The general transfers of Judges shall be made twice a year, preferably

in the months of March and August.

12. In case of posting of Civil Judges-cum-Judicial Magistrates and

Additional District and Sessions Judges appointed by initial recruitment,

they shall be posted at District Headquarters.

13. The authority may declare a station of posting as a Hard Station

considering the remoteness, lack of basic amenities and infrastructure. The

tenure and incentives for a member of Judicial Service posted at a Hard

Station shall be such as may be ordered from time to time.

14. Annual Transfer Report (ATR) shall be requisitioned from Judges in

the month of December on the prescribed form.

15. The station of posting of Additional District and Sessions Judges and

Senior Civil Judges–cum- Magistrates shall not be repeated. In the case of

Civil Judges-cum-Magistrates it can be repeated after a period of five years,

however, if a Judge has not completed his/her half or less term on a station,

he/she may be posted again on that station.

16. Where both husband and wife are Judges, effort shall be made first to

post them at the same station. If not possible, in the same District and if

that is also not possible, within the same Division.

17. Final academic session of the children of the members of Punjab

Judicial Service shall be a consideration at the time for transfer.

18. The representation, filed on any ground shall be decided within 15

days of its receipt in the office of Registrar with intimation to the judge

concerned.

19. Notwithstanding anything contained in this policy, the transfer and

posting of members of Punjab Judicial Service who are working as mediators

in ADR Centres shall be made in a manner as may be ordered from time to

time.

20. Judges with permanent physical disability shall be entitled to posting

at such places considered to be most suitable to them.

21. If a Judge or any of his near relatives (parents, spouse & children) and

parents in laws, in case of Female Judge, are suffering from terminal illness

he/she may be considered to preferential treatment for posting in a place

where proper treatment facilities are available.
