Topic : Legal Bases of Philippine Educational System

1. Knowledge of the legal bases of education is a must to every teacher.


-It is important that a teacher must be knowledgeable of the legal bases in education because
it serves as our guide to know our rights and privileges as a teacher and as well as of our
students. Also, on how are we to perform our duties and responsibilities without violating
the right of every individual and to know of what are our limitations especially in dealing
with our students.

2. Distinguish right and privilege.


- A right is something that cannot be legally denied, such as the rights to free speech,
press, religion, and raising a family. The major example for this is the right to education
of all in elementary and high school by establishing free public schools all over the
country.
On the other hand, a privilege is something that can be given and taken away and is
considered to be a special advantage or opportunity that is available only to certain
people. Example for this are those students who want to get enrolled in exclusive schools
for they have the capability to support their financial expenses in it.
3. Is education a fundamental right or privilege?
- Education is not a privilege but a human right. As stipulated in R.A. 9155 or known as
the “Governance of Basic Education Act of 2021” education as a human right adheres
that:
 The right to education is legally guaranteed for all without any discrimination.
 States have the obligation to protect, respect, and fulfill the right to education.
 There are ways to hold states accountable for violations or deprivations of the
right to education.
It is fundamental for human, social and economic development and a key element to
achieving lasting peace and sustainable development. It is a tool in developing the
full potential of everyone and ensuring human dignity, and in promoting individual
and collective wellbeing.

4. What is quality education?


- Quality education entails the following issues such as appropriate skills development,
gender parity, provision of relevant school infrastructure, equipment, educational
materials and resources, scholarships, and teaching force.

5. The constitution explicitly provides that the state shall protect and promote the right of all
citizens to quality education. As an educator, how can you take part in implementing the
kind of education envisioned in our Constitution?
-in order to promote a quality education for all, I can take part in implementing the kind of
education envisioned in our constitution by doing well my duties and responsibilities as a
teacher. Possess a good moral character, a role model and worth emulating to my students
through awareness and practice of “Code of Conduct and Ethical Standards for Public
Officials and Employees” or known as R.A. 6713. Also, must be a licensed professional
teacher mandated in R.A. 7836 or known as “The Philippine Teachers Professionalization
Act of 1994” that raises a standard/qualification for a teacher. And lastly, not only possesses
a good attitude but also having the qualities of an excellent and effective teacher.
