ADVERSE CLAIM

I, CAROLYN C. TORRES, of legal age, Filipino, and

a resident of P-1, Sumilihon, Butuan City, Philippines,
UNDER OATH, hereby depose and state –

1.That I am the President/Chief Executive Officer of

Colian Development Corporation, duly organized
Domestic Corporation with principal place at The
holy Sherperd Park, P-1, Sumilihon, Butuan City,
Philippines

2.That I am executing this adverse claim on behalf of

the Corporation duly with all legal authority from
the Board1.

3. On behalf of Colian Development Corporation, I

interposed said Corporation’s claim of ownership
over those parcels of land covered by TCT nos. RT-
37896, RT-37897, RT-37898, RT-37850 and RT-37854,
all situated in Brgy. Sumilihon, Butuan City

4.That said lands have been acquired by the

Corporation and duly delivered by the titleholders
to the exclusive possession, use and enjoyment of
the Corporation, under a duly executed Deed of
Conditional Sale2.

5.Presently, said lands form part of the memorial

park owned and developed by the Corporation.

6. With said Deed of Conditional Sale still legally

effective, binding and enforceable between the
parties and in order to protect its interest,
Colian Development Corporation deems it necessary
to register its interest amounting to ownership
over those parcels of land covered by TCT nos. RT-
37896, RT-37897, RT-37898, RT-37850 and RT-37854,
all situated in Brgy. Sumilihon, Butuan City.

 7. I, on behalf of and with all authority from Colian
Development Corporation, respectfully request the
Registry of Deeds of Butuan City to register the
foregoing adverse claim in its registry and to
annotate the same in the above-mentioned
certificates of title and in its derivative
titles..

8.The titleholders of the said properties may be

notified of this adverse claim at their residence
at Langihan Road, Butuan City.

9.I execute this Affidavit to attest to the truth of

the foregoing.
