I, DANIEL N. REYES, of legal age, Filipino, and a

resident of Albur, Libjo, Dinagat Province,
Philippines, UNDER OATH, hereby depose and state –

1.That I am the owner of that parcel of land lot

designated as Lot 36, Gss-13-000014= Lot 2043, cad-
84 situated in Tandang Sora, Butuan City containing
an area of 139 sq. meters;

2.That said land was illegally and fraudulently

titled under OCT no. 20170100044 in the BENERANDA
M. NAMOCATCAT, wife of CELSO NAMOCATCAT, an
employee of my late father who was allowed to stay
on said property;

3.That CELSO NAMOCATCAT , after admitting that said

land was illegally and fraudulently titled under
OCT no. 20170100044 by his wife, BENERANDA M.
NAMOCATCAT (who has now gone unto hiding) and the
fact that he and his wife only hold the property in
trust in my favor, has executed a deed of
reconveyance reconveying said land back to me.

Attached hereto is said Deed of Reconveyance,

marked as ANNEX “A”;

4.That in the meantime that the owner’s duplicate of

OCT no. 20170100044 has yet to be handed back to
me, for the protection of my interest in the
subject property and because of the danger that I
might lose said interest unless an adverse claim is
annotated in OCT no. 20170100044, I deem it
necessary to cause the annotation , by way of this
affidavit, of my adverse claim of ownership over
Lot 36, Gss-13-000014= Lot 2043, cad-84 situated in
Tandang Sora, Butuan City containing an area of 139
sq. meters;
 5.I respectfully request the Registry of Deeds of
Butuan City to register the foregoing adverse
claims in its registry and to annotate the same in
the above-mentioned certificates of title.

6.BENERANDA M. NAMOCATCAT’s last known address is at

of Brgy. Ambago, Butuan City , where notices may be
sent to her regarding this adverse claim.

7.I execute this Affidavit to attest to the truth of

the foregoing.
