Implementing the Rules and Regulations (IRR) of republic act no. 9266, an
act giving for a more responsive and comprehensive direction for the
enrollment, authorizing and hone of engineering, revoking for the reason
republic act no. 545, as revised, something known as “an act to control the
hone of design within the Philippines,” and for other purposes

Act I
Title, Policy Statement, Definition of Terms, and Scope of Practice

 Architecture - is the art, science or profession of
planning, designing and constructing buildings in their
totality taking into account their environment, in
accordance with the principles of utility, strength and
beauty;
 Architect – A person who is professionally and
academically qualified, registered and licensed under R.A
No. 9266 with a Certified of Registration and Professional
Identification.
 Architect of Record – An architect who is registered and
licensed under R.A. No. 9266, is directly responsible for
the total design of the project for client.
 Architect in charge of construction – a registered and
licensed architect under R.A. No. 9266, is professionally
responsible and liable for the construction supervision of
the project;
 Consulting Architect – the architect registered and
licensed or permitted to practice under R.A. No. 9266,
who recognized as professionally and academically
qualified with and exceptional or expertise in any branch
of architecture;
 General Practice of Architecture - architectural
designing, structural conceptualization, specifying,
supervising, and providing general administration and
responsible direction to the construction, enlargement, or
modification of buildings and building environments, as
well as architectural design in engineering structures, or
any part thereof;
 Scope of Practice of Architecture - includes offering
expert services related to site, physical, and planning as
well as the design, construction, expansion, conservation,
renovation, remodeling, restoration, or alteration of a
building or collection of structures.
 Authorship - refers to the author or authors who are
responsible for the development of a set of architectural
plans or specifications, whether they did it themselves or
someone under their direct supervision did it;
 Certificate of Registration - signifies a document with a
registration number that is given to a person by the
Professional Regulation Commission through the Board
of Architecture to prove that person has completed the
license exam and is authorized to work as an architect.
 Constract Documents - are the addenda, deletions, and
adjustments that are included into the contract documents
that are attached to the agreement.
 Copyright (or Copyright Ownership) - Unless there is a
written agreement to the contrary, copyright in a work of
architecture refers to the intellectual proprietary rights
held by an architect over any architectural documents or
work that they prepare. Copyright in a work of architecture
includes the right to control the construction of any
building that replicates the entirety or a significant portion
of the work in either its original form or in any form that
can be recognized as deriving from the original;
 Ownership - refers to the exclusive rights to an
architectural work, such as plans, designs, and other
documents, held by a person or juridical entity that
commissions the architect, whose ownership of an
architectural work is limited to using the architectural
documents to carry out or implement the work described
therein for just one (1) or the initial project;
 Sole Proprietorship - means an individual Architect
practicing and delivering architectural services, duly
registered with the DTI, BOA and the PRC.

Act II
Professional regulatory board of architecture: organization, powers, and
functions.

The Rule No. II of R.A. No. 9266 content includes the Professional
Regulatory Board of Architecture, referred to as the Board, a collegial body
under the supervision and administrative control of the Professional
Regulation Commission. The powers and functions of the board included
the competence of appointee that acknowledge its responsibilities as a
board member. Moreover, the commission may suspend or remove any
member on the following grounds that includes:
(a) Neglect of duty or incompetence;
(b) Violation or tolerance of the violation of R.A. No. 9266, or its
implementing rules and regulations or the Code of Ethical Conduct and
Standards of Professional Practice;
(c) Final judgment of crimes involving moral turpitude; and
(d) Manipulation or rigging of the architecture licensure examination results,
disclosure of secret and confidential information in the examination
questions prior to the conduct of the said examination or tampering of
grades.
The Commission in the conduct of the investigation shall be guided by Sec.
7(s) of R.A. No. 8981.

Act III
Examination, registration and licensure
The Rule III issues the requirements on processing the Professional
License as an Architect. Any person applying for examination shall
establish to the satisfaction of the Board prior to:
 A Filipino citizen or a citizen of a foreign country qualified to take the
examination.
 A good moral character
 A holder of the degree of Bachelor of Science in Architecture
 In Addition of specific record of at least 2 years or equivalent of
diversified architectural experience certified by licensed architect.
 A Master Degree holder is credited 1 year.
 Has not been convicted of any criminal offense involving moral
turpitude.
To be qualified in licensure examination for architects, a certain candidate
must obtain a GWA of 70%, with no grade lower than 50% in any given
subject.
The licensure examination for architects shall cover, but are not limited to,
the following subjects:
History and Theory of Architecture
• Principles of Planning and Architectural Practice
• Structural Design
• Building Materials, Architectural Specifications & Methods of Construction
• Utilities
• Urban Design and Architectural Interiors
• Architectural Design and Site Planning
Each one of the successful candidates in the examination must take an
oath of profession before any member of the Board, any government
official authorized by the Commission pursuant to Sec. 7(k) of R.A. No.
8981 or any person authorized by law to administer oaths. Prior to
Professional Architect, the Board shall issue a Resolution, subject to
approval by the Commission, in granting a petition for reinstatement to the
practice of architecture.
