Settlement Agreement
1 The parties have voluntarily agreed to the following as resolution to this complaint:
2 Respondent promises to make the following payments to complainant no later than the dates specified below:
First payment of $3,333.33 to be mailed no later than 10/24/21;
Second payment of $3,333.33 to be mailed no later than 11/24/21;
Third payment of $3,333.33 to be mailed no later than 12/24/21;
Fourth payment of $3,333.33 to be mailed no later than 1/24/22;
Fifth payment of $3,333.33 to be mailed no later than 2/24/22;
Sixth payment of $3,333.35 to be mailed no later than 3/24/22.
Total due complainant is $20,000.00.
If any payment is not made as per the terms of this agreement, then the entire remaining amount
immediately becomes due and payable in full.
Respondent agrees to deliver payment as follows: Sent by US Mail postmarked no later than the date
specified above.
3 Respondent agrees that complainant does not owe any more money on the contract that is the subject of
this complaint, all amendments to that contract, all work done under that contract and amendments to it.
4 If court action or arbitration is required to enforce this agreement, then the respondent waives all possible
defenses except for the defense that it has complied with the terms of this agreement.
5 Complainant accepts all items addressed in this complaint AS IS and assumes responsibility for any desired
or necessary corrections.
6 THIS AGREEMENT IS A SUBSTITUTED CONTRACT AND REPLACES ANY AND ALL PRIOR CONTRACTUAL
AGREEMENTS BETWEEN THE PARTIES.
7 Except for the obligations arising under this substituted contract, each party fully and unconditionally
releases the other party from all claims, complaints, suits or court actions, whether known or unknown,
arising from the contract that is the subject of this complaint, all amendments to that contract and all work
done under that contract and amendments to it.
