GENERAL POWER OF ATTORNEY

TO ALL TO WHOM THESE PRESENT SHALL COME,

WHEREAS, the “Orra Realtors Private Limited” a company incorporated under


the provisions of Companies Act, 1956, and having its registered address at Unit
No.2, Trade Centre, Kamala City, Senapati Bapat Marg, Lower Parel, Mumbai –
400 013, (herein after referred to as “Executant”)

WHEREAS, “M/s Lotia Kunj Co-operative Housing Society Ltd.” is the owner
of all that piece and parcel of land bearing Plot No.510/A, admeasuring 974
sq.yards equivalent to 814 sq,mtrs of SS.NO. VII of Khar bearing CTS No. E/184
of village Bandra Taluka Andheri along with R.C.C structure till three floors
standing thereon in the registration district of and sub-district of Mumbai Suburban
situated, lying and being at 16th Road, Khar (West), Mumbai- 400 052 ,(hereinafter
referred to as “the Society”).

WHERAS, the Society shall act as a Confirming Party to this General Power Of
Attorney.

WHEREAS, Through a Development Agreement dated 30/05/2014, registered


with the sub registrar of Assurances Andheri under Serial No. BDR4/4558/2014
executed between M/s Lotia Kunj Co-operative Housing Society Ltd, and Orra
Realtors Private Limited, the Executant has acquired development rights to
redevelop the premises of the Society situated at Plot No.510/A, admeasuring 974
sq. yards equivalent to 814 sq.mtrs of S.S.NO. VII of Khar bearing CTS No. E/184
of village Bandra (hereinafter referred to as "Said Property").

WHEREAS, through the consent terms filed in Suit (L) No.3845 of 2020 In the
High Court of Judicature at Mumbai, the validity of the Development Agreement
dated 30/05/2014 has been further extended from 15/02/2022 till 14/02/2024.

WHEREAS, the Society has passed a resolution dated 23/06/2022 wherein the
Society has specifically agreed that the Executant shall execute a DM agreement
with “Aumm Builcon LLP”, having address at Ground Floor, Nakshtra, Pali Hill
Road, Bandra West, Mumbai 400050, that the Aumm Builcon LLP shall be
Development Manager/Project Manager for the redevelopment of the said
property.

WHEREAS, for the purpose of completion of the new building standing on the
said property and for reasons of convenience it is necessary for the Builder to
appoint a development manager and project manager and confer upon them the
powers stated hereinafter.

BY THIS POWER OF ATTORNEY, We do hereby appoint "Mr. Ansh Sanjiv


Malik", director of “M/s Aumm Builcon LLP” having address at Ground Floor,
Nakshtra, Pali Hill Road, Bandra West, Mumbai 400050 as the Development
Manager/Project Manager to exercise, execute and perform any of the following
acts namely:-

1. To obtain building permission, revised permissions and any other


permission/s for the building to be constructed on the said property.

2. To apply for, deal with, appear before and obtain from the concerned
authorities all the necessary sanctions or approvals including intimation of
disapproval, completion certificate, occupation certificate and all such
orders, certificates, permissions, extensions, modifications, clearance,
exemptions, concessions as may be necessary for the full, free, uninterrupted
and exclusive redevelopment of the said property.

3. To obtain all the necessary approvals in the name of the Society from all
concerned statutory and local authorities including but not limited to BMC,
revenue authorities, Government of Maharashtra and all its ministers and
departments, Government of India and all its ministers and department,
Defense Establishment including the MOEF, AAI, DGCA, Air Force airport
authority, concerned public/statutory authorities/private utilities, MHADA,
MCGM, HPC with respect to the redevelopment of the said property.

4. To deal with all the statutory authority in respect of the redevelopment as


may be required for obtaining land clearance and all permissions and
concerns relating to the open space deficiency, staircases, lift and lobby
enclosure of balcony, infrastructure redevelopment, sales, high- rise
approval, civil aviation, layouts trinity, project layout, basement, sewerage,
fungible FSI and as may be required for smoothly and efficiently carrying
out the completion the entire redevelopment and construction of the said
property.

5. To make, sign, execute, submit and address all applications, Forms,


declarations, documents, undertakings, papers, plans, writings, indemnity
bonds, letters, communications, returns, representations, statements, terms,
conditions, etc., two or before all competent authority is a statutory
authorities including like MCGM, MHADA, MOEF, MMRDA, urban
redevelopment department of the State of Maharashtra, Revenue and Forest
Department of the State of Maharashtra, the MCZMA, The Tata power Co
Ltd. Brihanmumbai electricity supply and transport undertaking BEST,
Mahanagar Telephone Nigam Ltd (MTNL), Mahanagar Gas Ltd MGL
Commissioner of police and other police authorities, Maharashtra pollution
control board, and/or all public and private suppliers, provide us of utilities
and service, and also the payment from them of all approvals, permissions,
sanctions, exemptions and order as may be necessary to carry out and/or
implement any of the terms provisions and purpose here in content with
respect to the re-development of the said property.

6. To apply all relevant and statutory permissions for redevelopment our


society from Brahan Mumbai Mahanagar Palika, RTO, Fire Authorities,
Environmental Authorities, Civil Aviation Authority, CRZ Authorities, All
departments thereof, Slums Rehabilitation Authority, MHADA and any
other authority for the purpose of redevelopment of society building.

7. To handover any area affected by any reservation or D.P road on the said
property to concerned authorities and avail appropriate benefits like TDR,
FSI and utilize the same on the building to be constructed on the said
property.
8. To purchase/acquire any floating FSI or TDR, staircase premium and carry
out additional construction on the said property. To construct additional
floor after obtaining the revised sanctioned plan. The Society or the Builder
will not have any objection and will not claim any additional consideration.

9. To appoint Advocate, Solicitor, Architect, Engineer, Contractors for the


construction of the building on the said property.

10.To carry out and complete the construction work in accordance with the plan
sanctioned and approved by the BMC.

11.To carry out survey and measurement of the said property.

12.To get water, sewer and electricity connection on the said property.

13.To acquire at least 12 car parking space on the said property.

14.To market and sell, dispose off or lease and otherwise deal with the
Flats/Shops/Offices/Units constructed on the said property except flats
allotted and provided to the members of the Society by entering into
Agreement for Sale, Lease Agreement, Mortgage Deed or any other
Agreement with New prospective purchasers at such price, terms and
conditions as it deem fit and proper.

15.To collect all outstanding charges from the existing members of M/s Lotia
Kunj Co-operative Housing Society Ltd.

16.To collect the following charges from the New prospective purchasers of the
Flats/Shops/Offices/Units except all the existing members of M/s Lotia Kunj
Co-operative Housing Society Ltd:

a. All deposits, fees and taxes from new purchasers flat/unit for
obtaining electricity connection.

b. All deposits, fees and taxes from new purchasers flat/unit for
obtaining water connection from BMC.

c. Fees for formation of the Society, Legal charges from new purchasers
flat/unit to be constructed on the said property

d. Development and betterment charges from new purchasers of flat/unit


to be constructed on the said property.

e. Stamp duty, registration charges, GST and/or any other government


levy from new purchasers of flat/unit to be constructed on the said
property.

f. Any other amount payable by the new purchasers of flat/unit to be


constructed on the said property under an Agreement for Sale.
