AFFIDAVIT OF HEIRSHIP
WITH SPECIAL POWER OF ATTORNEY

That WE, APOLINARIA SINAGPULO DESEBAYLA, of legal age, Filipino, and


with residence at Purok 17, Batangan, Valencia City, Bukidnon; JUNARD
SENAGPULO DESEBAYLA, of legal age, Filipino, and with residence at Purok 17,
Batangan, Valencia City, Bukidnon; and MIANN DESEBAYLA CAGOL, of legal age,
Filipino, and with residence at Purok 17, Batangan, Valencia City, Bukidnon; after
having been sworn to in accordance with law do hereby depose and say:
That We, are the legal and legitimate heirs and no other of the deceased
ERNESTO DESEBAYLA, who died on July 31, 1996 at his residence located at
Valencia City, Bukidnon; with no known debts or whatsoever to anyone and no will of
testament;
That the said deceased, at the time of his death, left a certain parcel of land in
a portion of the Transfer Certificate Title No. AT-7049 or Collective CLOA Number
00369255 awarded by the Department of Agrarian Reform, under Reynaldo C.
Desebayla, et al., with Lot No. 402, Bsd-10-001360 (OLT) with an area of 71,577
square meters, located at Barangay Kahaponan, Valencia city, Bukidnon.
That we are executing this affidavit in order to attest to the truth of the
foregoing statements and for whatever legal purpose this may serve best;
That We, Junard Senagpulo Desebayla, and Miann Desebayla hereby name,
appoint and constitute, Apolinaria Sinagpulo Desebayla as our true and lawful
Attorney-In-Fact, for and in our names, with full power and authority to do and
perform any or all of the following acts:

1. To represent us regarding the issuance of individual title over the subject


landholding mentioned above;

2. To transact whatever documents pertinent to above mentioned transaction,


and to sign, execute any documents that may be necessary, proper or
convenient by our said Attorney-in-fact in relation to the same;
3. To receive the individual owner’s duplicate copy of title covering the said
landholding the moment the same is ready or available for release;

GIVING AND GRANTING unto our said Attorney-In-Fact full power and
authority to do, execute and perform every act and thing whatsoever requisite and
necessary to be done in and about the premises, as fully to all interest and purposes
we might or could do if personally present, and hereby ratifying and confirming all that
our said attorney (his/her delegate or substitute), shall lawfully do or cause to be
done by virtue of this presents.
