Rationale ‘The transfer from one station to another is important to ensure equity of teacher deployment and to comply with government legislations and regulations on employee welfare. The Schools Division Office of Palawan, being large and with schools which are geographically dispersed, is faced with issues on deploying teachers who are not from their municipality or nearby added to the unavailability and/or in some instances oversupply of qualified teachers who are from the locality, hence the concern also in the application of Localization law. This division acknowledges the commitment and sacrifice of those teachers who are assigned in the far-flung areas and/or in areas which are not their own place, all in the name of service to the school children and the community In reference to DepEd Order No. 22, s. 2013, the Schools Division Superintendent may effect the transfer of teacher either voluntary or in the exigency of the service. The purpose of this policy is to put in place the process and procedure in facilitating the transfer of teachers, according to existing laws, rules, and regulations and in response to the need of the schools in this division. Il. Seope This policy covers all the teaching personnel in the Schools Division Office of Palawan who are intending to transfer to other school, district, or within the division. Teachers who are from outside the jurisdiction of DepEd Palawan shall follow the incumbent office’s protocols in their intent, However, action and processing of the same shall follow the applicable process stated in this policy IIL Definition of Terms Exigency of Service. Refers to a situation where service is urgently needed and where any delay in its execution and delivery will adversely affect the outcome of the service to clients and its effective and efficient delivery. Need. The identified number of teacher in a school based on DepEd teacher- ratio standard as a result of Teacher Needs Analysis. New Teacher-Items. A teacher item that is declared vacant as a result of promotion, transfer, retirement, death, IV. Policy Statement Pursuant to applicable laws, rules, regulations, and guidelines, the transfer of teachers may be made on account of either the exigency of the service or voluntary. Per Central Office Memorandum DM-PFO-2017-1216 entitled Allocation of the 3rd and Last Batch of New Teaching Positions for Kindergarten to Grade 12 for School Year (SY) 2017- 2018, the Schools Division Superintendent shall have the authority to move senior high school teachers within the division where there is exigency or need of their services since they are division- based plantilla teachers. The transfer of teachers in the exigency of service may be made even without the consent of the teacher in the following cases: a, When the pupil-student ratio of the school is below 35:1 for elementary and 27:1 for secondary level, except when the school is implementing multi-grade classes; b. When there is considerable decrease in enrolment in certain schools arising from evacuation due to armed conflict, natural disasters, resettlement of farailies, closure of large private firms in the area, and other similar circumstances; or c. When the teacher is declared excess by the principal/school head and his/her expertise/area of specialization is needed in another school /district/ division. ‘The following may serve as guide in the decision on who to transfer in the exigency of service: a. Teachers who were last to be hired (Last In, First Out); ». Residents of the barangay or municipality where the school is located; c. Residents of the barangay or municipality of the proposed recipient school: or d. Secondary school teachers teaching subjects other than their areas of specialization; e. Senior High School teachers who are excess in the incumbent school and whose major of specialization is needed in another school. (SHS policy provides for the division-wide and non-school specific deployment policy). In case of voluntary transfer, the following situations should be given a priority: a. When the teacher is declared excess by the School Head and/or his/her expertise/area of specialization is needed in another school/district/ division. b. The teacher has served for more than three to five years outside of his/her home/ barangay / municipality c, The teacher is a bonafide resident of the barangay, municipality, city, or province where the school is located (RA No. 8190, Localization Law), as evidenced by the teacher's voter’s ID. @ tov. satiador . The teacher is joining his/her husband/wife in the same school (RA No. 4670, Magna Carta for Public School Teachers); ¢. She is a nursing mother (PD No. 603, Child and Youth Welfare Code); £. The teacher is a Solo Parent (Solo Parents’ Welfare Act of 2000 RA 8972) g. The teacher’s life is in danger due to armed conflict, hostilities, or other similar circumstances in the area where the school is located; or h. He/She is in poor health condition, as evidenced by pertinent medi effect. records to that V. Procedures ‘The following procedure shall be observed for voluntary transfers: 1.1 Starting July 26, 2021 the teacher may submit a letter addressed to the Schools Division Superintendent on his/her intent to transfer to another school. The list of transferees based on the assessment will then be presented to the Schools Division Superintendent for the issuance of Order of Transfer. For transfers in the exigency of the service as defined in this policy, the following procedure shall be observed: 2.1 Within the First Quarter of the Year, the School Head may recommend the transfer of teacher/s to the Schools Division Superintendent. The Number of teachers and current enrolment of the school should be attached for reference purposes. aN 3. For reasons of danger to life and health, the teacher may submit a letter of request addressed to the Schools Division Superintendent. For Senior High School transfer applicants, the ASDS in charge of SHS, through the Human (SS. resource Management Office (HRMO) and the Planning Unit, conducts Teacher Needs Analysis (INA) of both the incumbent and the recipient schools. Thereatter, the HRMO notifies the teacher of the action on his/her transfer. In case of several applicants applying in the same school, the point system for Junior HS shall apply. 6. Depending on the gravity of reason or cause, the SDS may cause the transfer any time or according to his/her authority. VI. Monitoring and Evaluation ‘The Administrative Officer V /Human Resource Management Office (HRMO) and the Planning Office, in consultation with the Office of the Assistant Schools Division Superintendents, shall regularly monitor the implementation of this policy. The Planning and Research unit of the School Governance and Operations Division shall study, evaluate th¢ efficiency of the mechanisms and recommend amendment and/or revisions/changes in the policy, when necessary.
