Fazlur Rehman, Khawaja Asif call for early election

ISLAMABAD: In view of the short tenure of the collation government, Jamiat Ulema-e-Islam-Fazl (JUI-F)
chief Maulana Fazlur Rehman and the ruling PML-N’s senior leader Khawaja Muhammad Asif called for
early elections in the country.

Addressing an event last night, Maulana Fazlur Rehman said that the maximum tenure of the new
government is one year. Demanding immediate elections, Fazl said that JUI-F has its own identity and
narrative within the collation government.

We have toppled down the PTI-led government, he said, adding that now it is their responsibility to give
back the nation what they promised and struggled for.

Underscoring the need for necessary electoral reforms, the JUI-F leader said that unnecessary delay in
elections is not the narrative of his party.

At the outset of today’s hearing, the additional director general pleaded with the court that it was
requested to adjourn the proceedings till the appointment of a new Attorney General for Pakistan.

At this, CJP Umer Ata Bandial remarked that the attorney general had completed his arguments, adding
that if the new attorney general has to give arguments, he can do in the last. He said the political parties
were also waiting for their turn to give arguments in the case. PTI has also filed a petition, remarked the
judge.

Meanwhile, Babar Awan, PTI’s counsel, requested the court to issue notices to the parties in the case.

“Present your case first. Notices will be issued (later),” the CJP replied to the PTI’s counsel. The under
discussion case is relating to the constitutional questions, the CJP remarked, adding that the hearing is
being conducted openly and in front of all the political parties.

PTI’s Tanveer Ilyas likely to be elected unopposed as PM AJK

MUZAFFARABAD: The ruling PTI’s Sardar Tanveer Ilyas is likely to be elected unopposed as the new
prime minister of Azad Jammu and Kashmir today as the united opposition has boycotted the election
for the coveted post.

The seat of prime minister fell vacant after Abdul Qayyum Niazi resigned from office on April 14 after PTI
members filed a no-confidence motion against him.

Azad Jammu and Kashmir (AJK) President Barrister Sultan Mahmood convened the Legislative Assembly
session at 10:30am on Monday (today) to conduct election for the new Leader of the House.

According to sources, the Speaker of the Legislative Assembly, Chaudhry Anwar-ul-Haq, will complete
the election process of the prime minister.

As per the party position, PTI has 32, PPP 12, Muslim League 7, JKPP and Muslim Conference have one
seat each. PTI Chairman Imran Khan has nominated Sardar Tanveer Ilyas for the PM's post.

Verdict in Sri Lankan citizen’s lynching case expected today


LAHORE: An anti-terrorism court in Lahore is likely to announce its verdict in the brutal murder case of
Sri Lankan factory manager, Priyantha Kumara, who was tortured to death and his body was set ablaze
by a mob over blasphemy allegation on December 3, 2021.

Both the prosecution and the defence have concluded their arguments in the case that was heard on a
daily basis. The statements of the investigation officers and eyewitnesses have also been recorded.

Last year, a brutal mob beat to death and set alight Priyantha Kumara, a 48-year-old Sri Lankan citizen
and factory manager in Punjab’s city of Sialkot. The then prime minister Imran Khan had condemned the
vigilante violence and vowed to bring the perpetrators to justice.

During the trial, presided over by judge Natasha Naseem, the prosecution brought to court 46
eyewitnesses. Furthermore, it submitted as evidence the CCTV footage of 10 cameras installed at the
site of the murder, as well as videos taken from the mobile phones of 55 accused men.

The investigation and trial were completed by a five-member team headed by public prosecutor Abdul
Rauf Wattoo.

A total of 89 men have been indicted in the murder case, of which nine are minors.

Even today, one last hearing of the case will be conducted in Lahore’s Kot Lakhpat Jail, after which it is
expected that the judgment will be read out.

Punjab governor can’t decline oath to CM-elect, secretary tells Sarfraz Cheema
LAHORE: Punjab’s governor cannot decline to administer the oath to the chief minister-elect under any
circumstances, the principal secretary to governor told Omer Sarfraz Cheema after he postponed the
oath-taking ceremony of Chief Minister-elect Hamza Shehbaz a day earlier.

The principal secretary warned Punjab Governor Omer Sarfraz Cheema that he will violate the
constitution if he refuses to administer the oath to the newly elected chief minister.

Newly elected Punjab CM Hamza Shahbaz Sharif was to take the oath of his office on Sunday but
Governor Omar Sarfraz Cheema abruptly postponed the oath-taking ceremony, citing the Punjab
Assembly secretary’s report, the Lahore High Court’s instructions and the facts presented to him.

In his letter, the principal secretary said that no power was vested in the governor under the
Constitution or any law to set aside the election under any circumstances.

“The Punjab Assembly secretary had in all probability rendered himself liable to contempt proceedings
for a completely illegal report that smacks of mala fide,” read the letter.

The secretary told the governor the assembly secretary’s report had been found one-sided, biased and
politically motivated.

“I have no power under any provision of the Constitution, the law or the Rules of the Punjab Assembly
1997 to call into question the declaration of the result by the deputy speaker, who is duly authorised by
the Lahore High Court to conduct the election for the office of chief minister,” he added.

PTI moves SC seeking disqualification of its defiant lawmakers

On April 15, the PTI moved the top court seeking a lifetime disqualification of its defector lawmakers
under Article 63-A after then prime minister Imran Khan was voted out by the National Assembly
through a no-confidence motion.

The petition was filed under Article 184(3) of the Constitution, which gives the SC the right to enforce
fundamental rights.
A member who leaves a parliamentary party without resigning the National Assembly seat by
committing defection and changes loyalty in favour of another political party should never be treated as
righteous and honest and should be disqualified for life, argued the petition.

It recalled how the Supreme Court had held on a number of occasions that the Constitution was not a
random collection of legal principles but a comprehensive scheme for the enforcement of fundamental
rights.

The true spirit behind inclusion of an anti-defection provision could not be redeemed by treating the
vote of those members who have allegedly defected as a disputed vote liable to be excluded from the
final count till the determination of the issue of defection of the voting member in the manner provided
in Article 63-A of the Constitution.

JUIF and PMLN submit responses in SC

On March 25, The Supreme Court Bar Association (SCBA), JUIF and PMLN submitted their responses in
the apex court regarding their positions on Article 63-A and Article 95.

The SCBA said voting is an individual right of an MNA instead of a political party's collective right under
Article 95. It declared the MNAs' right to vote for the no-confidence motion against the prime minister
to be an individual capacity in its response over the presidential reference for the interpretation on
Article 63A of the Constitution Pakistan.
The JUI-F also submitted its reply over the reference, declaring Article 63A "undemocratic".
"Disqualification on voting against party policy would further weaken the already fragile democracy."

JUIF said that the article in question obliges the MNAs — who got elected as independent candidates —
to follow a political party if they join it after winning.

The PMLN said in its response submitted in the SC that Article 63A and Article 95 are clear and every
lawmaker has the right to vote. The party seconded JUIF's argument that the vote of every MNA will be
counted and that filing of the presidential reference is a premature and unnecessary move.

SC to resume hearing in presidential reference seeking opinion on Article 63-A

ISLAMABAD: A five-member larger bench of the Supreme Court (SC) will resume hearing in the
presidential reference seeking interpretation of Article 63(A) of the Constitution today.

The five-member bench headed by Chief Justice of Pakistan Umer Ata Bandial and comprising Justice
Ijazul Ahsen, Justice Mazhar Alam Khan Miankhel, Justice Munib Akhtar and Justice Jamal Khan
Mandokhel will hear the case.

In the last hearing, the SC had delisted the hearing of the presidential reference seeking interpretation
of Article 63(a) of the constitution till the appointment of a new Attorney General for Pakistan on April
12.

The Assistant Registrar (Fixation) however, through a statement, stated that the instant matter has been
delisted on the adjournment application filed by Ch. Aamir Rehman, learned Deputy Attorney General
for the reason that appointment of Attorney General for Pakistan is awaited.
It is pertinent to mention here that Attorney General Khalid Javed had tendered his resignation to
President Dr Arif Alvi after the government of PTI came to an end in the wake of the success of the no-
confidence motion against then prime minister Imran Khan.
