Discuss the rationale of the prohibition against excessive, cruel, and inhumane
punishment.

 The prohibition of implementing excessive, cruel and inhumane punishment is simply to


value the rights and dignity of every individual, and to be more specific, it is to guarantee
the consideration of human rights. Thus, its inclusivity covers all the citizen of the state
including suspects and persons deprived liberty. The prohibition of the said punishments
also ensure that detention places like rehabs and prisons where the detainees and
prisoners are subjected to vouch the crime they have committed, should be free from such
inhumane punishment. Furthermore, in my opinion, the right against cruel and inhuman
punishment also complements to the Philippine constitution’s basic principle which states
that “The State values the dignity of every human person and guarantees full respect of
human rights”. With that, I can say that this prohibition is in accordance to what the
constitution is adhering to its citizen which is to value the right of each citizen as a human
being and respect their dignity and morale.
