MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement (“MOA”) executed and entered into this ___ day of _______
2020, in the City of ___________, by and between:

JOEL ORBISO TRUCKING, a company registered under the

laws of the Philippines, engaged in trucking industry,
represented by, JOEL ORBISO, hereinafter referred to as
“FIRST PARTY”;

-And-

The CITY OF TALISAY, a local government unit with address

at Talisay City Hall, Barangay Lawaan 3, Talisay City, Cebu,
Philippines represented by the City Mayor, GERARD
ANTHONY V. GULLAS, JR., hereinafter referred to as
“SECOND PARTY”;

WITNESSETH THAT:

WHEREAS, a program of work known as “AKSYON AGAD TASK FORCE CLEARING

DEBRIS AND GARBAGE” was approved by the SECOND PARTY for the clearing of debris and
garbage within the City of Talisay brought by the aftermath of the Typhoon Odette “

WHEREAS, the City of Talisay, Cebu, procures rentals of 3 dump trucks and 1
payloader for a period covering February 1-28, 2022 for use in clearing the debris and garbage
brought by typhoon Odette in the City of Talisay, Cebu;

WHEREAS, the procurement of the 2 dump trucks and 1 payloader were utilized for a
period of February 1-28 at P 10,000 per day per truck and amounting to an aggregate amount of
P 1,120,000.00;

WHEREAS, the FIRST PARTY had already provided the services and had submitted an
accomplishment report for the clearing of the debris and garbage covering the period of
February 1-28, 2022;

WHEREAS, the SECOND PARTY had certified per information of the office of the City
Engineer of the City of Talisay, Cebu, as to the non-availability of dump trucks and payloader
for the utilization of the clearing of debris and garbage;

NOW THEREFORE, for and in consideration of the foregoing, and the terms and conditions
hereinafter set forth, the Parties hereby agree and declare as follows:

I. The FIRST PARTY shall:

a. Shall submit an accomplishment report showing the details of its clearing operation
per program of work;

b. Submit documents showing their legal capacity to enter into a contract with the
SECOND PARTY;
 c. Submit a certification from the FIRST PARTY showing proof as to the non-
availability of dump trucks and payloader for the utilization of the clearing of debris
and garbage;

d. Submit other related documents and papers in compliance with the proper
procedure in the procurement of the dump trucks and payloader;

II. The SECOND PARTY shall:

a. The SECONDF PARTY shall determine the accomplishment of the FIRST PARTY in
the clearing of the debris and garbage within the City of Talisay, Cebu, as per
program of work;

b. The SECOND PARTY shall pay the FIRST PARTY the amount of P 1, 120,000 for the
services rendered in the clearing of the debris and garbage covering the period of
February 1-28, 2022;

III. Effectivity

This MOA shall take effect immediately upon signing by the parties.

IN WITNESS WHEREOF, the parties have signed this Memorandum Of Agreement

under the hand of their duly authorized representative at the date and place above written.
