Terms and Conditions of Employment

Payroll Terms and Conditions


Timesheets
• Where applicable, all staff are required to sign Supervisor’s/Client’s confirmation sheet upon completion
of shift (this acts as a cross reference with the Client for your hours).
• You must not leave your shift until your Supervisor or the Client advises you that it is okay to do so.
• You must be flexible with sign off times. If you are only able to work until a certain time, please
inform the Agency before you confirm your shift in the Online Portal.
• Submit timesheets in the Online Portal at the completion of every shift.
• All breaks must be recorded on your timesheets. Most breaks are unpaid depending on the length of
your shift and availability in accordance with the Fair Work legislation. Details are available on the Fair
Work Ombudsman’s website: Fair Work Information: Breaks
• Travel Time is automatically added to your timesheet, you do not need to add this to your shift time on
the Online Portal.

Payment
• The Company is responsible for all payroll liabilities including: payroll, superannuation, worker’s
compensation and all other employer related obligations.
• The Company pay cycle begins Monday AM and concludes Sunday PM.
• Your Pay Advice is emailed to you prior to your Pay being deposited into your bank account every
Friday.
• All payments comply with the Hospitality Industry (General) Award 2020.
• Should you have a question regarding your payment or you believe that it is incorrect, please contact
our accounts depart on accounts@cliffordwallace.com.au as soon as possible.

General Employment Terms and Conditions


Online Portal Usage
• It is your responsibility to ensure that all your personal records including your email address, phone
number and address are kept up-to-date. Changes are to be made in the Online Portal and
communicated to the Agency Office by emailing bookings@cliffordwallace.com.au.
• You are required to upload a professional (head and shoulders) photo to your Profile on the Online
Portal. Your hair should be well groomed and no visible jewelry or tattoos.
• You are required to submit your availability every week on the Online Portal, preferably 4 weeks in
advance, and most importantly keep it updated whenever it changes.
• If you are showing as available in the Online Portal you must be contactable and prepared for work.
If things change you must update your availability accordingly
• You are required to keep The Agency informed of any Holidays or planned leave in advance (including
student holidays). Staff on a student visa must provide a letter from their school confirming holiday dates
before they can be allocated extra hours.
• It is your responsibility to accept bookings promptly and check booking details in the Online Portal. Make
sure you are prepared for your shift and know the booking address, public transport options, event
orders (found in booking attachments) and uniform.

the After-Hours Mobile 0411 854 289 outside Office Hours only (Monday – Friday 6.00pm – 8.30am
Saturday, Sunday & Public Holiday)

• Any matter requiring urgent attention or response from The Agency must be communicated to The
Agency by phone call only – no SMS or emails are acceptable.
• You are to arrive at every shift at least 15 minutes prior to scheduled start time.
• If you are running late and will not be on site 15 minutes prior to your start time, please call The Agency
(Office or After-Hours Mobile; whichever is applicable) – do not email or SMS.
• Shifts are allocated based on staff availability, staff suitability to the job, individual staff performance and
Client demand.
• Most jobs have a minimum booking time of 4 hours. On some occasions a 3-hour minimum call will
apply. Staff will be advised of shorter minimum calls in advance and may choose to accept or reject.
• If working for other agencies that supply staff for the same client as The Agency does, you may only
accept shifts for this Client from one agency.
• If staff are required to travel more than 1 hour from Sydney CBD (Town Hall) a travel allowance will be
paid additional to the working hours at the equivalent rate. Staff will be advised in advance if travel time
is included.
• It is expected that you contribute towards the cost of petrol when accepting a lift with another staff
member (generally $5 – $10 is considered appropriate).
• Shift finishing times may vary according to Client requirements and you may be asked to leave earlier or
later than your scheduled finish time. You are required to be flexible regarding finish times.

Staff Obligations
• Staff identified as requiring further training may be requested to attend skills reinforcement training.
• ENGLISH must be spoken at all times - on shifts and when attending the Agency Office.
• Every staff member is obliged to carry a valid New South Wales RSA card on all shifts (a Statement of
Attainment is not a valid document).
• Use of MOBILE PHONES is not permitted on shift. All mobile phones must be switched off or on silent
mode and left in your bag.
• No items are to be taken from the venue (decorations, alcohol, promotional items etc.). Removing items
from the venue may be considered stealing and, as such, a prosecutable offence.

Drug & Alcohol Policy


• No alcohol or illegal substances are to be consumed prior to, or on a job.
• If you are suspected of being under the influence of alcohol or an illegal substance on arrival at or during
a shift you will be removed from the shift immediately and asked to leave the premises.
• Smoking is not permitted during your shift or near the venue at any time.

Staff Cancellation of Shifts


• Staff cancelling shifts must advise the office via phone call as soon as possible (minimum 4h prior to the
start time). No SMS or emails will be accepted.

Client Cancellations
• When a shift is cancelled by the client 2 hours prior to start time, you will be paid for 2 hours
• When a shift is cancelled by the client at the start time, or if you have arrived at the venue or
commenced work, you are entitled to 4 hours pay

Grooming
• NO facial jewelry is allowed. One ear stud per ear (females), no earring for males.
• Females are to wear moderate make-up and no (or clear) nail polish.
• Always use deodorant; colognes and perfumes are to be used sparingly.
• Women to wear white or nude colour bra at all times.
• Hair longer than ear length is to be tied back in a high ponytail, longer than shoulder length into a bun
(male and female).

• Males must shave daily, before every shift (not the night before). Facial hair must be kept trimmed and
tidy at all times.

Uniform
• All Staff (except Chefs) are required to arrive to all shifts in full uniform (apron should be carried on
a hanger and in a CWA suit bag where applicable). Arriving at the venue in casual clothing is not
acceptable.
• Chefs are required to arrive to all shifts in smart casual clothing (uniform should be carried on a
hanger and in a CWA suit bag). Arriving to the venue in full chef uniform is not acceptable.
• Failure to arrive in your required uniform as outlined in the booking may lead to you being sent home or
if you require the Agency to send a spare uniform by Taxi to enable you to complete your shift, you will
then need to return the loaned uniform to Head Office prior to your next shift or you will be placed on
work hold until it is returned.
• Your uniform must be to be approved by CWA Office before your first shift. Your uniform must always be
clean and ironed.
• The required uniform for your shift is listed on the Online Staff Portal. If in doubt, please contact the
office.
• Uniform purchases can be made either from a hospitality uniform supplier or from the Clifford Wallace
Uniform Shop where we can offer payment options, including payment in full by credit card or paid by
deposit and two further installments by credit card or cash.
• Items purchased from The Agency can be returned to The Agency at the end of your employment and
may be eligible for refund or part refund (see Uniform Shop terms and conditions).

Standard Uniform Items – Front of House Staff:

• Black trousers (no jeans/tights/chinos or similar allowed)


• Plain long sleeved white business shirt / plain long sleeved black business shirt (no
patterns/pockets/logos or similar allowed)
• Black polished leather shoes and black socks (no ballet pumps/runners or similar allowed)
• Bottle opener with a cork screw (waiter’s friend)

Occasional Uniform Items

Items required for set-up shifts or on the request of The Agency’s Client may include but are not limited to:
• Black / White ‘BONDS’ style T-shirt with raglan sleeve and round neck

Resignation

• You are requested to give two (2) weeks’ notice before resigning. If you hold a highly specialized or
permanent position however, you are required to give at least four (4) weeks’ notice.
• Please submit a written notice of resignation for our records. We will reply with an acceptance notice
and inform your manager or supervisor of your resignation (where applicable).

Employee Code of Conduct
The Agency acts under strict adherence to policies that reflect Agency core values and the principles
that guide their execution. The Code of Conduct applies to all Employees and is designed to:

• Help Employees meet high standards of integrity and ethical behaviour


• Give Employees a basis for making day-to-day decisions
• Convey the behaviour expected of them as an Employee
• Be treated equitably and with respect;

Employment under this Agreement entitles the Employee the right to:

• Participate in an environment free from all forms of harassment, bullying and


discrimination;
• Have their privacy and confidentiality treated lawfully and with respect; and
• Submit their feedback to Management of The Agency provided this is done appropriately
and respectfully.

Employees are required to behave at all times in a way that upholds the values and reputation of The
Agency. The employee agrees to:

• Act and make decisions based on equitable consideration of the relevant facts without
compromising their reputation or the reputation of The Agency.
• Take responsibility for decisions and actions and be professional, honest, consistent and
impartial.
• Consider people equally without prejudice or favour
• Appreciate the difference in others and welcome learning, teamwork, collaboration and
clear communication.
• Maximise service delivery while focusing on quality and customer needs
• Abide by the law and appropriate policies and procedures; and
• Observe and act in accordance to standards for safety

MISCONDUCT
The Agency is committed to handling all matters of underperformance, serious misconduct and
breaches of the code by enforcing Performance / Disciplinary processes, in line with Fair Work
Guidelines. These steps can include, however not necessarily in this order, and not limited to -

1. Invitation to investigation meeting


2. Meeting with the employee to discuss underperformance or incident
3. Formal disciplinary meetings
4. Formal warnings
5. Termination

Serious misconduct is any activity that causes serious and imminent risk to the health and safety of
another person or to the reputation or profits of The Agency (including but not limited to: theft, fraud,
assault, being drunk at work and refusing to carry out work duties).

Any breach of the Code may result in any of the outlined stages in the Progressive Discipline process
or Termination of Employment. All breaches are to be reported to The Agency’s and Human
Resources and Recruitment Co-Ordinator or Management who reserve the right to make decisions
and enforce fair and appropriate measures to resolve the matter in accordance with Fair Work and the
Australian Industrial Relations Commission.

TERMINATION

Employees may be subject to termination where an employee breaches their contract, engages in
illegal activities, disrupts workplace practice, performs below acceptable standards or causes damage
or financial loss to The Agency.

Confidentiality Agreement
The Employee acknowledges Confidentiality is of utmost importance when working for The Agency
and will endeavor to keep confidential information confidential.

The Employee must:

a. Hold confidential information in strict confidence and not disclose, or permit the disclosure
of Confidential Information except as with the prior written consent of The Agency;
b. Not disclose, or cause or permit the disclosure to any person of, any opinion in respect of
the Confidential Information;
c. Keep Confidential Information and any Documents secure and protected from any use,
disclosure or access which is inconsistent with this document; and
d. Promptly notify The Agency if they suspect, or become aware of, any unauthorised use,
storage, copying or disclosure of the Confidential Information.

The Employee also agrees not to discuss, comment upon, discredit, or disclose any information, in
any manner or form, directly or indirectly, to any person or entity, about:

a. The Employer or Clients, their staff and representatives;


b. Any aspect of Employer's or Client’s business and/or operations;
c. Any aspect of Employee's employment with Employer;
d. Any information the Employee may be exposed to while working for The Agency at a
Client’s work site

Further, the Employee shall not assist, or cooperate with, any other person or entity in committing any
act which, would constitute a violation of this Agreement.

Any violation of this section by either party shall be deemed a material breach of this Agreement and
could result in termination and/or legal action against the Employee. Any liability resulting from a breach
of confidentiality will be passed on to the responsible staff member as The Company does not take any
responsibility for acts listed above.

The obligations set forth in this paragraph shall survive any termination of the Agreement.

Exclusivity Agreement
The Employee acknowledges The Company will enforce an Exclusivity Agreement during
employment and a six (6) month Exclusivity Period following the termination of this Agreement with
The Agency. For the duration of the Exclusivity Period the Employee agrees that they must not:

a. Engage either directly or indirectly or enter into any commitment with any Client or Third
Party introduced to them by The Agency;
b. Provide paid or unpaid services to any Client introduced to them by The Agency
c. Use, store, copy or disclose the Confidential Information obtained through The Agency,
it’s Clients, staff or representatives.

The obligations set forth in this paragraph shall survive any termination of the Agreement.

c. The Company will conduct random and periodic VISA checks on all Employees through a
Government approved online platform.

limitation of 40h per fortnight from the date that employment starts with The Company and
contracted to The Agency.

e. All Company Employees on working holiday VISAs (subclass 417 & 462) will not exceed
working limitation of 6 months per employer from the date that employment starts with The
Company and contracted to The Agency.

Employee Agreement

This Employee Agreement (“Agreement”) is made and entered into by the undersigned

“Agency”) and (known as the “Employee”).
