महोदय,
मला श्रीरामपुर वभाग येथे, उपकार्यकारी अभियंता ह्या पैदावार कार्यरत असताना तथाकथित ग़ैरकृत्याबाबत वरील
संदर्भ पत्र क्र. १ नुसार आरोपपत्र बजावण्यात आलेले होते। सदर आरोपपत्राची सखोल विभागीय चौकशी संदर्भ पत्र क्र. २
अन्वये चौकशी अधिकारी नियक्ति
ु करुन दिनांक १२. ०८. २०२२ रोजी करण्यात आली. सदर चौकशीमध्ये मला आरोपपत्र
संदर्भातील कागदपत्रे मिळाली नसल्याचे नमूद केल

चौकशी अधिकारी यांनी आरोपपत्राच्या चौकशी संदर्भातील चौकशीचे निष्कर्ष पत्र क्र. ३ नुसार सादर केलेला आहे .
सदर अहवालानुसार आरोपपत्रामध्ये ठे वण्यात आलेल्या सहा आरोपपंपैकी २ आरोप सिद्ध झाल्याचे चौकशी कळविले आहे .
आपण सक्षम अधिकारी ह्या नात्याने सदर चौकशी अहवाल स्वीकारून खालील शिक्षा प्रस्तावित केलेली आहे . "आपल्या
येणाऱ्या दोन (२) वार्षिक वेतन वाढ संचयी परिणामसह रोखणे."

आपण अहवालाच्या आधारे केलेली अवाजवी व ् कंपनीचे कोणतेही आर्थिक नुक्सान झालेले नसताना प्रस्तावित केलेली
शिक्षा मला मान्य नाही. मला सदरची शिक्षा मान्य नसल्याची कारणमीमांसा खालील प्रमाणे आहे .

१. मा. चौकशी अधिकारी यानी त्यांचा निष्कर्ष अहवाल'विसंगत मांडलेला आहे .

२. मा. चौकशी अधिकारी यानी प्रत्येक पुराव्याचे मूल्यमापन केलेले नाही.
३. मा. चौकशी अधिकारी यानी दोषरोपाच्या प्रत्येक आरोपा संदर्भातील निष्कर्ष व ् त्यामागील कारणे नोंदवलेली नाहीत. सबब
आपण चौकशी अधिकारी यांच्या निष्कर्षांवर अवलंबून राहून करण्यात आलेली शिक्षा ही अमान्य आहे .

करण्याची जबाबदारी ही व्यवस्थापनाची असताना सुद्धा व्यवस्थापनाने आरोप पुरव्यासह सिद्ध केलेले नाहीत. अशा वेळेस
स्वत:चे निर्दोषत्व आरोपित कर्मचाऱ्याने कैसे करावे व ् कशाच्या आधारावर करावे त्याबाबतचे विश्लेषण अथवा स्पष्टीकरण
चौकशी अधिकारी यांच्या अहवालात नाही. तसेच, चौकशी अधिकारी यानि कोणत्याही पुरव्याचा आधार न घेता त्यांच्या
चौकशी अहवालामध्ये केलेले आरोप सिद्ध केलेले नाहीत, त्यामुळे आरोपपत्राच्या आधारावर आपण वरील शिक्षा प्रस्तावित
केलेली आहे , ती आवाजावी व ् अमान्य आहे .

ह्या ठिकाणी आरोपपत्रामध्ये सिद्ध केलेल्या आरोप संबंधीचे खालील प्रमाणे खंडन करीत आहे . आरोप क्र. २ व ् ६
सिद्ध करताना घटना क्र. १ ते ३ मधील ज्या बाबींचा उहापोह केलात्याबद्दल विश्लेषण वजा खंडन खलील प्रमाणे करीत आहे .

ह्या आरोपसंदर्भात चौ अ यानी असे नमद
ू केले की' " आ. क. ह्यानी घटना क्र. १ च्या बाबतीत स्थळ तपासणी
अहवालावर काय कार्रवाई झाली यावर दक्ष रहूं सातत्याने पाठपुरावा केला असता, तर कंपनीचा महसूल अडला नसता " ह्या
त्यांच्या निष्कर्ष अहवालाच्या विपरीत घटना क्र. १ पान क्र. १० वर " दरम्यान व्य. प्र. यानी "सदर प्रकारणांमध्ये स्थळ
तपासणी अहवालावर आ. क. यानी त्याबाबत सूचना दिल्याचे गहृ ीत धरुन त्याचा पाठपरु ावा न केल्याबद्दल आ. क. याना दोषी
ठरविणे उचित होणार नाही, किं बहुना ती जबाबदारी सम्बंधित सहाय्यक अभियंता व ् त्या विभागातील विज बिल प्रमख
ु या
नात्याने यांची होती असे आ. क. प्र. यानी म्हं टलेले आहे व ् ताशा अशयाचा पुरवा चौकशी पटलावर सादर झालेला आहे . ह्या
पुरव्या वरुन आ. क. यानी या प्रकरणमध्ये पाठपुरावा केला नहीं हे म्हणणे गैर लागू ठरते.”

वरील दोन्ही निष्कर्षांमध्ये चौ अ यांची पाठपरु व्या बाबत विसंगती आहे . मी उपकार्यकारी अभियंता ह्या नात्याने
पाठपुरावा केलेला ह्या संबंधीची कोणतीही कागदपत्रे पुरावा म्हणून सादर झालेली नाहीत, अशा वेळेस मला पाठपुरावा केला
नाही म्हणन
ू दोषी धरणे हे नियमाधीन नाही. उत्तपरपक्षी महावितरण कंपनीच्या कार्यप्रणालीनस
ु ार सम्बंधित विभागाच्या
विभाग प्रमुखाने पाठपुरावा करावयाचा असतो त्याबाबाबतचा पुरावा म्हणून महाराष्ट्र राज्य विद्युत ् मंडल यांचे manual of

मी दिलेल्या सूचनांचाच पुरावा चौकशी पटलवार सादर झालेला नसताना, मी पाठपुरावा केला नाही त्याबाबत दोषी धरने
चुकीचे आहे व ् जनून बुजुन ओढून ताणन
ु आरोप सिद्ध करण्यासारखे आहे . निष्कर्ष नोंदवत असताना तो पुरव्यासह नोंद करने

बिलिंग कार्यक्षमता माज़्या कार्यकाळात वाढलेली आहे .

घटना क्र. ३

वीजचोरीच्या ग्रहकाकडे विशेष लक्ष दे ने क्रमप्राप्त होते असे नमूद केलेले आहे . ह्या ठिकाणी सुद्धा निष्कर्षांमध्ये
विसंगति आहे . हयाबाबतचा पाठपुरावा केल्याचे चौ अ. ह्यांच्याच निदर्शनामध्ये नमूद केलेले आहे . ते पुढील प्रमाणे " सदर
मीटरचि तपासणी करण्यात यावी यासाठी सम्बंधित कक्ष अभियंता याना PC - ० मधील शुन्य (०) यूनिट बिल येत
असलेल्या ग्राहकांची तपासणी करण्याकरिता प्रत्येक महिन्यात कळविलेले होते, त्यामधील पत्र क्र. उका
/श्रीराम/उवि/बिलिंग/९८७ दिनांक १६.०६.२०२० व ् तदनन्तर कलविले होते त्याबद्दलचा पुरावा म्हणून आ. क. दस्तऐवज क्र.
१३ पाने १९ सोबत जोड़त आहे . हयाबाबतचे परु ावे व्यवस्थापनेने नाहीत सबब, त्याबाबतचा अधिक खल
ु ासा दे ता येत नाही.”
ह्यावरून पुरावा नसताना व ् व्य. प्र. यानी सुद्धा पुरावा सादर केलेला नसताना जर तर च्या आधारे चौ. अ. यानी आरोप
सिद्ध केलेले आहे त.

वास्तविक सम्बंधित कालावधि मध्ये मी स्वतः रजेवर होतो. मी कोविड १९ ह्या आजाराने ग्रासलेला होतो व ् त्याचे
पुरावे सुद्धा चौकशी पटलावर ठे वण्यात आलेले आहे त . परन्तु सदर पुरवाव्याचा कोणताही विचार न करता व ् ते त्यानी सदरची
माहिती निष्कर्षांमधे न मांडता असे आरोप सिद्ध करणे हे न्यायोचित व ् नियमाधीन नाही तरीही आपणास विनंती करण्यात
येते की, माज़्या विरूद्ध कोणतेही पुरावे नसताना आरोप सिद्ध करने हे नैसर्गिक न्याय तत्वाच्या विरुद्ध आहे , सबब मला
