Sample Case: No. 1

At around 8 o'clock in the morning, Mr. Sherwin Sibal, a police asset went to Tarlac City Police
Office to inform the Chief o Police of the name of Supt. Ramoncito Aragon that a person by the name of
Mr. Yuri Galang is in possession of marijuana breaks. Mr. Sibal further told the Chief of Police that Mr.
Galang will walk into an intersection beside CCDT Colleges, Bamban Tarlac at about 2 o'clock in the
afternoon of the same day. Because of the information gathered, Supt. Aragon formed a team to arrest
Mr. Galang before 2 o'clock in the afternoon of the same day, several policemen in civilian clothes
positioned themselves in said intersection. At about 2 o'clock in the afternoon, Mr. Galang pinpointed a
person walking across an intersection of CCDT Colleges saying that the person is Mr. Galang. When that
person already walked across the intersection, the policemen arrested and searched him. It was found
out that the person was really Mr. Galang and the bag he was carrying really contained marijuana
breaks. Was the Arrest of Mr. Galang Valid ? yes or no justify your answer.

- Yes, the arrest was valid because they caught him in the act that he will plan to commit a crime
by selling that marijuana to school but the policemen caught and apprehend or arrested him for
possessing marijuana also no need for a warrant arrest to arrest Mr. Galang. Also, the students
identify the suspect that it was really Mr. Galang. The policemen know that the person is doing
something illegal that’s why they arrested him. Even if there is no warrant of arrest because
there is what we call warrantless arrest the police officer has a reasonable belief that the
suspect has either committed a crime or is about to commit a crime. The police officer might
also arrest the suspect to prevent the suspect’s escape or to preserve evidence.
