Deed of gift

THIS AGREEMENT is made on this day of September, 2003

BETWEEN Sri Nemai Chowdhury, son of Late Mahadeb Prosad Chowdhury, by faith –

Hindu, by occupation – Business, residing at Cinema Road, P.O., P.S. & District herein

after called or referred to as the FIRST PARTY (which expression unless excluded by or

repugnant to the context shall mean his heirs, executors, administrators and assigns) of the

FIRST PART.

-AND-

Smt. Bhanumati D. Waghela, wife of Sri Dayalal C. Waghela, by faith – Hindu, by

occupation – Housewife of Nutunganj, Bankura at present residing at Ram Bag Society,

Makarpura Road, Vadodara, Pin : 390 010 hereinafter called or referred to as “SECOND

PARTY” (which expression unless excluded by or repugnant to the context shall mean her

heirs, executors, administrators and assigns) of SECOND PART.

WHEREAS the Mother-in-Law of the SECOND PARTY namely , alias

Bhagirathi Waghela wife of Sree Chimanlal alias Chimanlal Lalji Waghela of Nutanganj,

Bankura executed a Will by bequeathing all the buildings including the landed property

being the Holding No. Nutunganj Mahalla within the Municipal limit of the town of Bankura

AND WHEREAS the said Mother-in-Law of the SECOND PARTY, for avoiding future

complicacy desired to gift the said property and other immoveable property lying in the said

premises including the landed property comprising of the said holding being No. Nutunganj

Mahalla within the Municipal limit of the town of Bankura.

AND WHEREAS the Mother-in-Law of the SECOND PARTY has already

executed the deed of gift and completed the said gift on 12 th September, 2003 before the

Registrar of Assurance, Kolkata through her attorney in respect of the property being the

Holding N, Nutunganj Mahalla within the Municipal limit of the town of Bankura and other

immoveable property lying in the said premises including the landed property comprising of

the said holding being No. Nutunganj Mahalla within the Municipal limit of the town of

Bankura (hereinafter referred to as the said properties) and the said gift has been accepted

by the SECOND PARTY through her attorney namely Sri Nemai Chowdhury being the

FIRST PARTY herein on the basis of the registered Power of Attorney dated 25.08.2003

registered with the Sub-Registrar,

AND WHEREAS on the basis of the said registered Power of Attorney the

FIRST PARTY has been holding the possession of the gifted properties and the possession

of the gifted properties has this day (19.09.2003) been handed over to the SECOND

PARTY in presence of the witnesses named below and the SECOND PARTY herein

acknowledge the receipt of the possession of the said gifted properties by putting signature

on this agreement in presence of the witnesses.

IN WITNESSES WHEREOF the parties of both the parts hereto have signed this instrument

the month and year first above written.
