PART 1 : INVITATION TO BID

State Bank of India (hereinafter referred to as “SBI” / “The Bank”) is having its
Office at Ground Floor, ‘C’ Wing, GITC, Plot No 8, 9, 10, Sector – 11, CBD
Belapur, Navi Mumbai.
In order to provide services in operation and maintenance of Sewage Treatment
Plant on daily basis at SBI Staff Residential Colony, Nerul, Navi Mumbai, the
Bank proposes to invite Tenders from reputed and established venders
(hereinafter referred to as “Bidder” or “Contractor”) to undertake Operation and
Maintenance Contract for Sewage Treatment Plant.
The Bidding documents are to be downloaded from the Bank’s Websites

▪ Please note that all the information’s / documents desired are provided.
Incomplete information may lead to non-consideration of the proposal.

▪ Tender process shall be carried out in regular two bid system [Technical bid &
Commercial bid].

▪ All Technical Bids must be accompanied by Earnest Money Deposit (EMD) as


specified in the Bid document. Otherwise, the bid will be rejected.

which will be communicated to the bidders through the Bank’s websites

▪ The information provided by the bidders in response to this RFP document will
become the property of SBI and will not be returned. SBI reserves the right to

The information contained in this Request for Proposal (RFP) document or
information provided subsequently to Bidder(s) or applicants whether verbally or
in documentary form by or on behalf of State Bank of India (Bank), is provided to
the Bidder(s) on the terms and conditions set out in this RFP document and all
other terms and conditions subject to which such information is provided.

This RFP is neither an agreement nor an offer and is only an invitation by Bank to
the interested parties for submission of bids. The purpose of this RFP is to
provide the Bidder(s) with information to assist the formulation of their proposals.
This RFP does not claim to contain all the information each Bidder may require.
Each Bidder should conduct its own investigations and analysis and should check
the accuracy, reliability and completeness of the information in this RFP and
where necessary obtain independent advice. Bank makes no representation or
warranty and shall incur no liability under any law, statute, rules or regulations as
to the accuracy, reliability or completeness of this RFP. Bank may in its absolute
discretion, but without being under any obligation to do so, update, amend or
supplement the information in this RFP. No contractual obligation whatsoever
shall arise from the RFP process until a formal contract is signed and executed
by duly authorized officers of the Bank with the selected Bidder.

The Bank reserves the right to accept or reject any Bid/ offer received in part or in
full, and to cancel the bidding process and reject all Bids at any time prior to
contract of award, without thereby incurring any liability to the affected Bidder or
Bidders or any obligation to inform the affected Bidder or Bidders of the grounds
for the Bank’s action. Bank reserves the right to reject any Bid on security and /
or other considerations without assigning any reason.
Bank reserves the right to cancel the entire Bidding / procurement process at any
stage without assigning any reason whatsoever.

PART – 4 : NOTICE INVITING TENDER

Sealed Tenders in two bid system, technical bid and price bid, are invited from
reputed, established and financially sound Contractors for “Maintenance of STP”
at SBI Staff Residential Colony, Nerul, Plot No.1 & 2, Sector – 13, Nerul (East),
Navi Mumbai – 400 706.
Issuing of Tenders to Bidders Will be available at our website free of cost:

Validity of Tender offers 90 days from the date of opening
Earnest Money Deposit Rs.10000/- (Rupees Ten Thousand Only) by way of
Bank Draft or Pay Order issued by any bank other
than SBI, payable at Mumbai / Navi Mumbai in
favor of “State Bank of India, Estate Dept., Belapur”
should accompany the Tender.
➢ Tenders without EMD are liable to be
rejected.
➢ EMD of unsuccessful bidders will be
returned immediately.
➢ EMD of successful bidder will be returned
after submission of the Performance Bank
Guarantee and after Submission of Service Level

Security Deposit The successful Bidder shall have to submit the


Security Deposit equivalent to 3 months contract
value within 15 days of the receipt of the work order.
The Security Deposit shall be in the form of Bank
guarantee issued by any bank other than SBI and
shall be retained by the Bank till the end of contract
period. No interest shall be payable on the Security
Deposit.

Contract Period Initial period of contract is one year. After the initial
period of one year of contract, it may be renewed on
the same terms and conditions for a further period of
one year upto the changed amount of minimum
labour wages, at the discretion of the Bank

Part – 5 : TENDER CONDITIONS

5.1 INTRODUCTION
Brief Scope of Work :

5.1.1 Providing round the clock service to operate the Sewage Treatment
Plant (STP) by providing 3 (Three) Semi-skilled operators in 3
(Three) shifts. The STP comprises of mechanical equipments and
pipelines and electrical installations. Details of equipments are as
under : Raw sewage transfer pump, sludge recycle pump, PSF feed
and backwash pump, Bucket screen, Surface aerator, Pressure
sand filter, ultra violet console, Level control switches,
interconnecting pipe lines & valves etc., Electrical work including
MCC/ Starters / Push buttons, Cables, Earthing etc for above
equipments with oiling, greasing, glands etc complete.

5.1.2 Arrange for testing of treated water from the reputed Laboratory
every month and charges to be borne by contractor. Testing report
should contain following parameters-

In addition to these Test parameters, report on other additional


parameters may be required as per government guidelines/
statutory instructions from time to time.

5.1.3 Arrange for repair of equipments / pipes / electrical installations etc.


The cost inclusive of materials and labour will be reimbursed as per
prior approval from the Bank.

Sewage Treatment Plant, SBI Staff Residential Colony, Plot No.1 & 2, Sector –
13, Nerul (East), Navi Mumbai – 400 706.
The Bidder should visit the premises to get a brief knowledge about the
area and nature of various works.

5.2 ELIGIBILITY CRITERIA


5.2.1 This is a open tender and bids will be accepted from vendors agreeable to
provide the services as mentioned in para 5.1 above.

5.2.2 The Bidder should have a minimum 5 years of experience as STP


Operator or the agencies involved in managing and setting up of STP or
experience in maintenance of STP / plumbing as on 01-04-2017 in the
field of maintenance. The bidder should furnish previous work orders /
Satisfactory Completion certificates for establishing the experience which
should include the work of maintenance. Bidder having experience in the
field of maintenance will be preferred.

5.2.3 Average turnover for last three year should be minimum of Rs. 3 lacs (as
on 31-03-2016). Audited / certified Balance sheets (by Chartered
Accountant) of last three years are to be enclosed as proof.

5.2.4 The minimum value of maintenance contract in Commercial / Residential


buildings during the last 5 years, should be –

Atleast One single contract of Rs.8 lacs in the last 5 years


(or)

Atleast Two contracts of Rs.5 lacs in the last 5 years


(or)

Atleast Three contracts of Rs.4 lacs in the last 5 years

5.2.5 Contractor should be based at Mumbai / Navi Mumbai or Thane districts or


atleast should have a branch office.

5.2.6 The contractor should have all mandatory registrations – PAN, Service
Tax, EPF, ESIC, extant labour laws etc

5.3 BIDDING DOCUMENTS


Bid documents need to be submitted in 2 separate envelopes super
scribed Technical Bid / Commercial Bid for “Maintenance Contract for
STP” at SBI – Staff Colony, Nerul”, sealed & coupled together as per the
procedure narrated below. The tenders should be dropped in the Tender
Box located at the given address. Bidders may also submit the Tender by
post so as to reach at Estate Dept. on or before scheduled date and time.
Bank shall not be responsible for any postal delay. Each paper of Tender
documents should be stamped & signed by the authorized official of the
company with a seal of the company.

5.3.1 First envelope (Technical Bid) should contain:


Self-attested photocopies of the following documents serially numbered
and stamped and signed on each page. Bids with conditions and non
submission of the required documents will be rejected which please
note.

1. Pay Order/Banker’s cheque / Bank Draft for ‘Earnest Money


Deposit’ (EMD) valid for 90 days.
2. Basic Information of the Applicant
3. Letter of Undertaking
4. Proof that the contractor is based at Mumbai / Navi Mumbai or
Thane districts or atleast has a branch office.
5. Service Tax Registration.
6. E.S.I.C. Registration or workmen's compensation policy
7. PAN card
8. Audited Balance Sheet for the years 2013-2014, 2014-2015,
and 2015-2016, establishing the turnover criteria.
9. Satisfactory Completion Certificate or Purchase Order/ LOI as
Documentary evidence for value of relevant executed
Maintenance contracts in commercial / residential buildings
during the last 7 years, mentioning the period of contract, value
of the contract in Rupees & contact details of that Organisation.
10. List of skilled / semi skilled workmen employed for Operation of
STP with name, skill set & years of experience.

The Technical Proposal should NOT contain any price information. Such
proposal, if received, will be rejected.

Note: Original documents need not be submitted with the bid offer. However, the
bidder should provide the original documents at the time of verification by the
Bank. Bank may seek additional documents / information, if required, for
ascertaining the eligibility of the Bidder.

5.3.2 After scrutinizing the Technical Bid parameters, Bidders who qualify will be
shortlisted. Bidders who fulfil the requirements of Technical Bid will
only qualify for opening of 2nd Envelope i.e. Commercial Bid.

5.3.3 Second envelope (Commercial Bid) should contain "Bill of Quantities"


specifying their price. The price quoted should contain a single sheet as
per Annexure - BOQ on the Bidder’s letter head wherein the Base Price is
only to be mentioned under the signature and seal of the Bidder,
Service Taxes, (or other similar Tax imposed by the Government in
lieu of Service Tax).

Note: Base Price should include minimum wages, EPF, ESIC, Bonus,
Escalation on account of increase in minimum wages during the
contract period of initial one year, include Profit, lump sum payment
towards the cost such as Insurance, PPE (personal protective
equipment), tools required, etc.

5.4 Documents constituting the Bid


The Bidder is expected to examine all instructions, forms, terms and
specifications in the Bidding Document. Failure to furnish all information
required in the Bidding Document or to submit a Bid not substantially
responsive to the Bidding Document in every respect will be at the
Bidder’s risk and may result in the rejection of the bid at the discretion of
the Bank.

5.5 Clarification / Amendment of Bidding Document


5.5.1 Bidder requiring any clarification of the Bidding Document may notify the
Bank in writing at the address or by e-mail indicated as per time and date
mentioned in Schedule of Events (Part 3).

5.5.2 A pre-bid meeting is scheduled as per time and date mentioned in


Schedule of Events (Part 3).

5.5.3 Text of queries raised (without identifying source of query) and response of
the Bank together with amendment to the bidding document, if any, will be
notified on Bank’s website. No individual clarification will be sent to the
bidders. It is the responsibility of the bidder to check the website before
final submission of bids.

5.5.4 Relaxation in any of the terms contained in the Bid, in general, will not be
permitted, but if granted, the same will be notified on Bank’s Website.

5.5.5 All bidders must ensure that such clarifications / amendments have been
considered by them before submitting the bid. Bank will not take
responsibility for any omissions by bidder.

5.5.6 At any time prior to the deadline for submission of Bids, the Bank, for any
reason, whether, at its own initiative or in response to a clarification
requested by a prospective Bidder, may modify the Bidding Document, by
amendment.

5.5.7 In order to enable bidders reasonable time in which to take amendments


into account in preparing the bids, the Bank, at its discretion, may extend
the deadline for submission of bids.

5.6 The EMD may be forfeited :


a. If a Bidder withdraws or amends its bid during the period of Bid validity
specified herein; or
b. If a Bidder makes any statement or encloses any form which turns out
to be false/incorrect at any time prior to signing of contract; or
c. In case of a successful Bidder, if the Bidder fails:
(i) To sign the contract with the Bank within a period of 30 days; or
(ii) To furnish Security / Performance Guarantee to the Banks.
5.7 OTHER CONDITIONS:
5.7.1 Successful Bidder will have to enter into an agreement with the Bank. The
format of the agreement shall be designed drafted based on the Terms &
Conditions / Clauses mentioned in this RFP document. However, Bank
reserves the right to add / delete any other Clauses in this Agreement.
The successful Bidder should forward a letter specifically indicating the
names of their personnel who will be providing services. Along with the
letter, the following data should also be provided:-

b. The Contractor has to submit the Bio-data & Experience certificate for all
their personnel who will be providing services in this contract.
Bank reserves the right to reject any persons to be employed by the
Contractor at the discretion of the Bank. Once the contract is awarded, if
they wish to change any of the above personnel, the maintenance
contractor will inform the Bank in writing and obtain the Bank’s prior
approval, one week in advance. After the contract is awarded, the
Contractor will carry out the work without raising any preconditions
regarding the functioning of Sewage Treatment Plant. Irrespective of
existing condition of the equipment, circuits, cables, plumbing lines, etc.,
the Contractor should carry out all maintenance / rectification works that
are necessary to make the system fully operational.

5.7.2 Decision of Bank in regard to interpretation of the Tender Conditions,


Terms & Conditions, Scope of Work, Agreement, Payment terms, etc. shall
be final and binding on the Contractor. In case of any dispute between the
Contractor and the Bank, the Bank shall have the right to decide. However
all matters of jurisdiction shall be subjected to courts in Mumbai.

5.7.3 Bank reserves its right to reject any or all the Tenders / bids without
assigning any reasons therefore and the Bank’s decision shall be final and
binding.

5.7.4 No deviation of any kind will be allowed in Tender conditions, Scope of


work, Terms & Conditions, Payment Terms, etc. after the tendering
process are over.

PART – 6 : TERMS & CONDITIONS OF THE CONTRACT


6.1 MANPOWER, WAGES, ETC.
▪ The Contractor should ensure to comply with all the provisions of Labour
Act / State / Central Govt. agreed procedures. The Contractor shall be
solely responsible for compliance to provisions of Various labour and
industrial laws and all statutory obligations such as minimum wages as per
Central Govt. rules ,allowances, compensations, EPF, Bonus, gratuity,
ESIC, etc. relating to workers provided to the Bank. The Bank shall have
no liability in this regard.
▪ The Contractor shall ensure to get the Police verification for all the
manpower deployed by them and the contractor should ensure that
the manpower deputed should bear good moral character.
▪ All personnel provided by the Contractor will be on the payrolls of the
Contractor / Company and there will be no Employee and Employer
relationship between the personnel engaged by the Contractor and the
Bank.
▪ That the Contractor will not sub-contract or permit any other person to
perform any of the work or services agreed to without prior permission
from the Bank.
▪ The Contractor shall ensure the availability of a reliever for weekly off and
a substitute is provided if a person is absent. The Contractor should
arrange for replacing his workmen to give weekly off to his workmen as
per the labour rules.
▪ Contractor’s personnel or their family members shall not be allowed to stay
/ reside at site.
▪ The operator should be well mannered and properly behaved.

6.2 SAFETY, SECURITY, ETC.

That the Bank shall not be liable for any compensation in case of any fatal injury /
death caused to any of the Contractor’s employees while performing /
discharging their duties or otherwise. The contractor shall alone be fully
responsible for safety and security & insurance or life insurance of their personnel
who is working on the operation and maintenance works.
▪ In no case, safety norms shall be violated. Even in case of urgency, when
temporary rectification is done, etc. no such compromise is allowed as
regards to safety provisions.
▪ The Contractor agrees that its personnel shall comply with security
regulations in effect from time to time at Bank's Residential Colony and
externally for materials belonging to SBI at all times. The Contractor alone

shall be fully responsible for safety and security & insurance or life
insurance of their personnel who are working at site.
▪ The Contractor should issue a valid Company Identity cards to all their
staff personnel who will be providing services under this contract.
▪ The personnel of contractor shall report to the Security Reception of M1
Tower in-gate while entering & exiting the premises. All personnel of
Contractor will be subjected to a thorough physical checking while coming
and leaving the colony. Those persons so deputed will sign in the Register
for arrival and departure at the site.

6.3 PAYMENT TERMS


▪ Payment of AMC shall be made post monthly basis after effecting
necessary deductions like TDS, penalty for shortcomings etc.
▪ Proof of ESIC and EPF contribution made by the contractor to their
employees shall be submitted along with the monthly bills.
▪ There would be no increase in rates payable to the Contractor during the
Contract period. In-case of renewal after the initial contract period the
minimum wages component only will be revised considering the
changes in the Central Govt. minimum wages, if any. For eg. If there
is a variation of 5% in the labour wages at the time of renewal from
the wages prevailing at the time of tender finalisation, only the labour
wages will be considered proportionately.
▪ Payment of wages to all the workers engaged by the contractor should be
through an Account maintained with any Scheduled Commercial Bank.

6.4 SPARES
▪ Cost of spares required for routine maintenance of STP like gland packing,
star wicers etc. shall be borne by Bank. However, monthly demand of
materials has to be projected by the Contractor to Caretaker Office.

▪ In case of any materials are not available in the stock for preventive /
breakdown maintenance, the Contractor should immediately arrange for
purchase of the materials from the market after obtaining approval from
Bank. The cost of such material purchased by the contractor shall be
borne by the Bank as per the terms stated below.

Only handling charges which include transportation cost shall be paid by


the Bank over and above the actual material cost. Handling Charges shall
be a maximum of 10% of the value of material purchased as per bills
submitted by the contractor. Any taxes payable on such handling charges
claimed by the contractor shall be borne by the Contractor himself. All
purchase bills of the materials supplied by the contractor should be in the

name of ‘State Bank of India, Belapur’. Bank reserves the right to verify the
reasonableness of the prices.

▪ All necessary components required for the breakdown maintenance of all


equipment shall be arranged by the Contractor at the market rate and
same shall be reimbursed by Bank as stated above, along with
acknowledgement of having done the work from Caretaker.

6.5 DELAY IN WORKS & PENALTY


▪ If any of the preventive / breakdown maintenance are not carried out by
the Contractor in time or absenteeism of their workmen or non-
performance of duties, Bank will arrange to carry out this work through any
other contractor at their will and deduct the expenses (decided by the
Bank) from the AMC bill.
▪ In case of absenteeism of the contractor workmen, the proportionate
amount shall be deducted in the monthly AMC bill.
▪ If the Contractor does not fulfil the minimum requirement of the
manpower, then the labour charges as per the Central Wages
prevailing at that time shall be deducted from the monthly AMC bill. If
the contractor fails to fill the vacancies on account of attrition of
labour within one month, then double the labour charges shall be
deducted.
▪ While executing the maintenance / breakdown works, Contractor has to
take necessary precautions to avoid any damage to Bank’s property. In
case of any property damage, the Contractor has to repair/replace the
same at no extra payment. If the Contractor fails to repair/replace, then the
same work shall be carried out through other agency and the expenditure
incurred shall be debited from the AMC amount payable to the Contractor.

Any irregularities, unsafe practices, etc. noticed / informed by


the Bank should be rectified by the Contractor within 24 hrs 2000/-

6.6 TERMINATION OF THE CONTRACT


The Bank reserves the right to terminate the agreement in case of breach of
any terms and conditions of this agreement by the Contractor, with 24 hours
notice. The Bank also reserves its right, to claim damages for such
breaches and the decision of the bank in this regard shall be final. Bank
can terminate the agreement if the services provided by the Contractor are
found to be dis-satisfactory. Either party can terminate the agreement by
giving 90 days notice in writing to the other. Bank will automatically
terminate the contract if the penalty is imposed or recurrence of the
deficiencies in services.

6.7 FORCE MAJEURE

Neither party shall be liable for delay in performing obligations if the delay or
failure is due to any of the following force majeure i.e. Act of God or any
Government Act, fire, earthquake, explosion, strikes/ Bandh, civil commotion or
anything beyond the control of either party. The party shall use all reasonable
endeavours to minimize any such delay.
6.8 BUSINESS TERMINATION
In the event that the contractor shall close conducting business in the
normal course or wind up, make a general assignment for the benefit of
creditors, suffer or permit the appointment of a receiver for its business or
shall avail itself or become subject to any proceeding under any Act or
statute of any country or state relating to insolvency or protection of rights
of creditors, then (at the option of the Bank notwithstanding clause 1.0 of
the agreement) this agreement shall terminate and be of no further force
and effect and any property or rights of such other party tangible or
intangible shall forthwith be returned to it.

6.9 If the Bank does not avail of certain service(s) mentioned in the Scope of
work, then the Bank shall not pay for that/those service(s). The Bank shall
have the right, during performance of the maintenance contract to change
the scope of the maintenance contract.

6.10 The Contractor must provide one common mobile phone with active
connection for the use of maintenance personnel to enable the Bank’s
personnel to communicate with them. No additional charges shall be paid
for provision of mobile phone and monthly bills. The maintenance
personnel should be able to communicate in local language & Hindi

PART – 7 : SCOPE OF WORK


7.1.1 The Contractor shall carry out all repairs and maintenance services as
agreed to with the help of semi-skilled persons who are totally familiar with
the work they are required to perform like operation of motors /
Instruments, timely greecing of machine parts and lubrication of Motors /
Instruments with Oil, Timely replacement of wicers etc and submission of
water testing report on monthly basis.
7.1.2 Manpower is to be deployed as mentioned in para 7.1.1 on all the days of
the year (including Holidays and Sundays) for 24 hours (comprising of
three shifts) for daily preventive / breakdown maintenance of STP. The
Contractor personnel should be available in the premises throughout the
entire working hours. However, if the maintenance contractor feels that
more expertise is required to carry out the above work, they may deploy
additional experts at their discretion. Bank will not pay any additional
amount for the additional manpower. However, in-case of major
breakdown Bank may consider reimbursing the cost of the manpower on
case to case basis. The Contractor shall also carry out the repairs /
maintenance on holidays as well as on Sundays.
7.1.3 The STP operators should be present as per below chart on all the working
days, including Sundays and Bank holidays, etc.

7.1.4 The Contractor shall maintain the STP to keep them in working condition,
every day.
7.1.5 The Contractor personnel shall maintain the complaint registers,
preventive/breakdown maintenance registers, etc. After completion of

every preventive (Routine) maintenance work as per the frequency, a


report may be submitted to the competent authority of Bank.

7.1.6 The scope of work covers the maintenance of complete STP including
maintenance/repairs of all other equipment not covered here but forms a
part of the STP.

7.1.7 The Contractor’s personnel shall work in close co-ordination with colony
caretaker and Bank employees and also while dealing with the Bank’s
employee the contractor’s personnel shall be courteous.

7.1.8 The contractor personnel shall take all pre-monsoon and other seasonal
precautions, to protect the STP. In case of any expenditure towards
purchase of materials in carrying such precautions, the Bank shall be
consulted beforehand.

7.1.9 The Contractor workmen are required to perform the duties without waiting
for specific directions/intimations from the Bank. The contractor shall also
provide repairs and maintenance service in response to oral including
telephonic notice by the Bank whenever necessary. No supervision will be
provided by the Bank for any works. The Contractor is solely responsible
to ensure that no accident / damages occur to the installations / personnel
during the maintenance work.

7.1.10 All debris resulted out of performing the work has to be removed out of
Bank’s premises and disposed as directed by CIDCO/NMMC authorities
immediately after completion of the job. No bills will be considered before
such site clearance. If any repair is carried out, the waste created during
such repairs shall be immediately removed out of site by the contractor.

7.1.11 Quarterly cleaning of All the Tanks and immediate disposal of waste as
per NMMC/CIDCO norms.

NOTE: All the above mentioned scope of works is indicative and not exhaustive.
Bank reserves the right to add / delete any work under the scope of work.
However, the Contractor has to ensure smooth and safe working of all the
equipment in the system.

Annexure – I

BOQ : BILL OF QUANTITIES

** The prices quoted are inclusive of minimum wages (Central Govt.),


EPF, ESIC, Bonus, and all other statutory dues including escalation
on account of increase in minimum wages during the contract
period of initial one year, including profit, lump sum payment
towards the cost such as Insurance, personal protective equipment,
tools required, Uniform to workers, Water testing charges, material
cost, Quarterly cleaning of All the Tanks, etc and all items mentioned
in this RFP documents. Service tax (or such other tax, if
implemented, in place of service tax) will be paid extra and on actual
basis. It will be the sole responsibility of the bidder to bid, after
considering all the expenses, costs and statutory dues towards
workers, suppliers or any third party, including government
authorities. The price would be net payable charges by the Bank
(other than Service tax) (or other similar Tax imposed by the
Government in lieu of Service Tax).

ANNEXURE – II
MINOR REPAIRS / FAULTS (ILLUSTRATIVE)
1. Repairs of pump, Motor bearing, Starters, Electrical Switches, pipelines
(with STP) & resolving the same.

2. Replacement of gland packing, wicers, nut bolts due to wear & tear on
regular and preventive basis. Regular / preventive cleaning of pipelines to
prevent chocking.

3. Quarterly cleaning of All the Tanks and immediate disposal of waste as


per NMMC/CIDCO norms.

ANNEXURE – III
MAJOR REPAIRS / BREAKDOWNS

1. Replacement of foot valve and repairs of electrical motors in case of


breakdown.

Note: The above mentioned lists of minor / major repairs are illustrative and any
other repairs which are not specified in the lists shall be analysed on case to case
