ORDER

The issue for consideration is remedial action against illegal

dumping of garbage in Modinagar, Uttar Pradesh.

On 25.10.2018, the Tribunal directed the District Magistrate and

Municipal Commissioner, Ghaziabad to furnish an action taken report.

Accordingly, report has been filed by Ghaziabad Nagar Nigam on

03.12.2018, stating that the matter relates to Nagar Palika Parishad,

Modinagar. The Nagar Palika Parishad, Modinagar has to comply with

the order of the Tribunal.

On behalf of the Nagar Palika Parishad, Modinagar, a copy of the

report has been shown stating that the contract has been given for waste

disposal on 16.08.2018 and the garbage has been now removed.

Learned Counsel undertakes to file copy of the report on record.

Learned Counsel for the Nagar Palika Parishad, Modinagar also

states that a scheme for recovery of the damages for the violators will be

introduced and placed on its website providing for floor level and ceiling

level amount of compensation to be recovered. The scheme will provide

for doubling of the damages for subsequent defaults.

In view of the above, no further order is necessary.

The application stands disposed of.
