Freedom of expression is already Customary international law, freedom of expression, universal


declaration on human rights

For freedom of expression to be questionable, doesn’t need to be a law etc. All it needs is for that
someone to do it while in the exercise of their official functions to have a “Chilling effect”

a content-neutral regulation, i.e., merely concerned with the incidents of the speech, or one that merely
controls the time, place or manner, and under well defined standards; or

a content-based restraint or censorship, i.e., the restriction is based on the subject matter of the
utterance or speech. [61] The cast of the restriction determines the test by which the challenged act is
assayed with.
