MEMORANDUM

TO : COP Delfin Albano PS

SUBJECT : Request for Police Assistance on the Implementation of Writ


of Execution in Relation to Civil Case No. SCC-270

DATE : November 14, 2022

1. References:
a. Memo from Chief, ROD dated October 10, 2022 with same subject as
above; and
b. Letter from Regional Director dated October 10, 2022.

2. This pertains to the letter of Mr. Isabelo S. Lavadia, Sheriff IV, RTC Branch
22, Cabagan, Isabela requesting for police assistance during the implementation of
Writ of Execution in relation to Civil Case No. SCC-270 on November 18, 2022
at 9:00 AM at Barangay San Andres, Delfin Albano, Isabela. Considering the
completeness and authenticity of the documents submitted, clearance is hereby
granted subject to the following guidelines:

a. The police team that will render police assistance shall be led by the
Chief of Police;

b. The police team shall conduct discreet verification of the case to have a
better grasp of the subject on the request, decision or order;

c. Sufficient number of police personnel shall be deployed to ensure the


maintenance of peace and order;

d. The PNP members shall observe maximum tolerance and respect


individual human rights at all times. Reasonable force shall be resorted
only as self-defense or defense of strangers;

e. Should the need therefore arise, the Team Leader shall initiate
dialogue with the concerned parties and other stakeholders (e.g., LGUs,
NGOs, religious leaders, council or elders, media, etc) to obviate
violence;

f. The sheriff or officer of the court or quasi-judicial body shall have the
final disposition whether to proceed with the implementation of the
order. His presence is required during the implementation of the order;
g. The role of the PNP personnel shall be supportive only, that is, strictly
limited to the maintenance of peace and order, crowd control, and to
ensure the personal safety and security of the sheriff or officer of the
court or quasi-judicial body;

h. In no case shall PNP members participate in the implementation of the


order, and shall refrain from performing acts such as hauling of personal
properties, dismantling of structures and socializing with the parties to
the case; and

i. Secure an undertaking from the plaintiff that they will shoulder the
necessary expenses in the implementation of the court order.

3. In this connection, you are directed to provide sufficient number of police


personnel to assist the sheriff in the implementation of the said Court Order. Further,
submit to this Office (Attn: POMU) thru email at ippo.opns@gmail.com an After
Operation Report within 24 hours after the termination of said activity.
