AFFIDAVIT OF WITNESS

I, _______________, of legal age, Filipino citizen, and a resident of

Bacolod, Lanao del Norte, after having been duly sworn to in accordance
with law, hereby depose and say:
1. I am the lifelong partner of_______. We are blessed with five
beautiful children.

2. On 25 July 2015 at around 9 A.M in the morning, I called my

partner to go back home to have breakfast with our kids whom
he brought to a beach house for family bonding.

3. He parked our car in our garage and carried our children inside
our house and told me to feed the children. Since there were
Barangay Officials outside our house, he went outside to greet
them and ask if there is a barangay activity.

4. I heard that the Barangay Officials were negotiating with the

private complainant. They did not present a Court Order
authorizing them to survey the area that is why the Barangay
Officials did not allow them to proceed.

5. After feeding my children, I went outside the house and stood

beside my partner when the negotiation was taking place.

6. My partner was merely listening and did not use nor point his
licensed firearm which was kept intact in his trouser belt al
throughout the incident;

7. Private Complainant was not present during the said incident.

My husband never spoke to her. Perhaps, she was hiding inside
her house, never went out, and imagining things on her mind.

8. The filing of the Complaint against my partner by the spouses is

a product of revenge to annoy, humiliate, and get even with my
family. Sadly, my partner is a victim of character assassination.

9. I am executing this Affidavit to certify or attest to the truth of

the foregoing facts, and in support of the Answer. Other reliefs
just and equitable warranted under the circumstances are
likewise prayed for.
