AFFIDAVIT OF DESISTANCE

I, CHRISTY DE CASTRO JAO, of legal age, Filipino and a resident of Villamor

Porras St., Bo. Obrero, Davao City, after having been sworn to in accordance with the
law, do hereby depose and state that:

1. I am the complaining witness in Criminal Case No. 61,382-2007 For: Violation

of Sec. 5 (a) in relation to Sec. 6 (a) of RA 9262 entitled "People of the Philippines vs.
Jefferson Hong Jao" now pending before RTC-Branch 33, Davao City:

2. My husband, accused Jefferson Hong Jao asked forgiveness to what he had

done to me, and out of my love and compassion for him, and in view of the love and
support that he has since bestowed on me and our children I have decided to forgive my
husband, accused Jefferson Hong Jao;

3. 1 am no longer interested in prosecuting the above-mentioned case against

accused Jefferson Hong Jao nor testify against him in the said case;

4. I respectfully request that the Honorable Regional Trial Court-Branch 33,

Davao City and the Honorable Provincial Prosecutor to DISMISS the above-mentioned
case against accused Jefferson Hong Jao;

5. I am executing this affidavit in order to attest to the truthfulness of the foregoing

statements.

COMPLAINT

Plaintiff, through undersigned counsel unto this Honorable Court, hereby respectfully
avers:

1. That Plaintiff is of legal age

3. That despite repeated demands both written and verbal, defendant failed, neglected
and refused to fulfill his obligation without just and valid grounds to the continued
damage of the plaintiff as evidenced by Annex “B” – Demand Letters;
4. That the plaintiff in order to enforce his rights and interest has sought the services of
a legal counsel with attorney’s fees amounting to One Hundred Thousand Pesos
(Php 100,000.00) and appearance fees of Two Thousand Pesos (Php 2,500.00) per
hearing as evidenced by Annex “C” – Contract for Legal Services;
5. That the plaintiff has incurred litigation expenses amounting to Twenty Thousand
Pesos (Php 20,000.00) as evidence by Annex “D” – Official Receipt;
6. That the plaintiff has suffered moral damages of the sum at the discretion of this
Honorable Court;

WHEREFORE, premises considered it is most respectfully prayed before this Honorabe

Court to render decision in favor of the Plaintiff and order the Defendant to render to
pay the following:

a. The sum of ________

b. Moral damages, exemplary damages at the sound discretion of the Court;
c. Attorney’s fees in the amount of One Hundred Thousand Pesos (Php 100,000.00)
