Complete Forensic Extraction and Analysis of the cellular telephone and memory cards including, but not limited to the following: i, Any and all electronic data and wire communications stored in memory within the mobile communication devices, SIM Card, and removable memory eard, including but not limited to phonebook contacts, call logs, SMS/ MMS messages, email, instant messaging, photographs, and other communications, including any content that may be synehronized to or on the device from any service or application. ‘This is to include the inspection/ examination of the aforementioned mobile communication devices and removal of internal components if necessary to obtain the aforementioned data. 3. ‘The facts establi ng probable cause or the grounds for search are: A. Affiantis a Detective with the Jackson County Sheriff's Office currently assigned as an investigator. Affiant has been a sworn law enforcement officer with the Jackson County Sheriff's Office for approximately 11 years. Affiant has been involved in the investigation of numerous assaults and other violent crimes in Affiant’s time as a law enforcement officer. Affiant is currently assisting with the investigation of a suspicious death, SEARCH WARRANT AND AFFIDAVIT Page 2 State of Michigan Police Agency: Jackson County Sheriff's Office County of Jackson Report: 138-22813-21 B. On 12/25/2021, Deputy Barlond was dispatched to 1080 Westfield Drive in Summit Township for a possible assault victim, The caller was Tabata Zuniga, C. When Deputy Barlond arrived on scene, Brian Wickham was laying on a bed in the residence. D. Deputy Barlond observed Wiekham to have a left upper head injury that appeared as though it was an abrasion. He observed several cuts on his arms, He attempted to speak with Brian to ask him ‘what had bappened and he appeared as though he had sustained a closed head injury and was very confused and unable to give any clear answers as to what had happened that evening, B, Deputy Barlond spoke with the caller, Tabata Zuniga, who advised the following: I. She described Brian Wickham as being her fiiend. Il. She originally came to the residence because she became concemed after she had not heard from Brian all day. She had also reached out to Brian's sister and asked if she had heard from. hhim and his sister had also not heard from him, She stated that he lives alone and his other family members had also been trying to get a hold of him since noon. TI, After contacting Brian's sister, Tabata responded to Brian's residence at 1080 Westfield to check his welfare. When she arrived, the front door was unlocked and shut. IV. Upon entering the home, she discovered Brian laying on the bedroom floor injured, He seemed confused and had urinated on himself, She advised that he told her a guy had come over to give him a quote and had hit him end left. V. He does drink aleohol and has diabetes. She is in the medical field so she tested his blood sugar when he arrived and it was reading 308. F. Atthe residence, Deputy Barlond observed there to be small amounts of blood on the floor of Brian's bedroom next to the bed; this is the location where Tabatha had indicated she had located him. In the hallway on the trim of one of the doors, he located a single blood drip. On the flooring in the hallway leading to the bedrooms, he had observed several blood drips leading toward the kitchen area. He looked around and did not observe any other objects inside of the residence that had blood ‘on them, He also checked the front door to the residence and did not observe any signs of forced entry. G. Brian Wickham was transported fo Henry Ford Allegiance Hospital by Jackson Community Ambulance. HL. Deputy Barlond and D/Sgt. Huttenlocker spoke with Doctor Lapinski who stated after an MRI they determined Brian Wickham had multiple brain bleeds. He advised he was not able to determine if the injuries were from an assault or not. Dr. Lapinski further advised Wickham was not making sense and any statements he made should not be relied upon. 1. On 12/27/2021, D/Set. Huttenlocker responded back to Henry Ford Allegiance Health to check on the status of Wiekham, He followed up with Physician’s Assistant Danielle Pluif who works on the neurological trauma team. Pluff had been working on Christmas and 12/27/2021. She described Wicicham’s injuries as brain bleeds on both sides. When they shaved his head, they a saw bruise on top of his head on the left hand side. She also determined at some point Wickham had a severe seizure and had bit his tongue, She was uncertain iffa seizure caused the fall which resulted in head SEARCH WARRANT AND AFFIDAVIT Page 3 State of Michigan Police Agency: Jackson County Sheriff's Office County of Jackson L. z Report: 138-22813-21 injury or not, She indicated there were at Jeast two contacts to the head which could be from fall, assault or many other circumstances. Brian Wickham did succumb to his injuries and died on 12/29/2022. D/Sgt. Huttenlocker reviewed Wickham’s cellphone which was received from Zuniga. He determined he had unanswered texts beginning around 0800 hours on 12/25/2021. It also appeared past messages and calls were deleted prior to 12/24/2021. On 12/29/2021, Affiant re-interviewed Tabata Zuniga at the Jackson County SherifPs Office, Tabata gave a timeline for herself and Bryan, She stated on 12/24/2022, she picked up Bryan from his residence and responded to her home on Helena Ave in Summit and stayed there until 2200 hours. Tabata stated she and Bryan then left her residence and went back to 1080 Westfield Dr and she stayed there until 0000, before she left for home again, Tabata stated Bryan was fine when she left. Tabata stated she wanted to go back into 1080 Westfield and look to see if there is a frying pan missing, When Affiant questioned Tabata on why she wanted to look for a frying pan, Tabata then stated she observed one missing when she was at Brian’s residence on Christmas. This information ‘was never relayed to officers they day the incident occurred. . Also during the interview, Tabata initially stated she mostly stayed in the kitchen and upper atca of the residence, but when questioned if she had gone into the basement; she then stated she had. Affiant asked Tabata if she observed anything unusual in the basement to which she stated no. Tabata also mentioned she had received a Snapchat from Brian on 12/25/2021 around 1140 hours. She stated the “snap” wes a blucry picture of Brian with injuries to his face and head. Tabata stated she attempted to call and message Brian but got no response. Affiant asked Tabata why she had not responded over to Brian’s earlier in the day to check his welfare, to which she stated she tries to keep her children away from Brian’s residence (due to the fact she is technically still married and does not want her kids to tell her husband about Brian). Affiant found this suspicious since one of her children were with her when she finally made contact with Brian’s residence at 1930 hours on 12/25/2021 and Affiant obsorved numerous pictures of Tabata’s children at Brian’s residence in Brian’s phone. ‘Tabata also informed Your Affiant she had deleted pictures off of Bryan's iPad and iPhone after the investigation was on going and before Your Affiant was able to view the iPad. Tabata stated she only deleted nude photos of herself, but itis unknown if this is all she deleted. . Affiant executed a search warrant on Tabata’s phone records and data records. The results showed that Tabata’s time line she gave police during her initial interview of 12/24/2022 was incorrect and she and Bryan were at another location that was not provided {o police. Data records showed that Tabata left her father’s residence around 1930 hours and stayed within the city of Jackson until ~2030 hours, before responding to 1080 Westfield Dr. Tabata was again interviewed on 3/7/2022 and confronted with this information, Tabata timeline then changed. Tabata stated she and Bryan left her father’s residence around 1930-1830 hours and then went straight to 1080 Westfield. Tabata denied being at another location. Tabata also stated she has Life360 on her phone which is a mobile application that provides location based services, notifications, and sharing to consumers. Affiant believes this execution of this search warrant is necessary to further this investigation and will help to determine Tabata’s whereabouts on 12/24/2022 and potentially discover further evidence to assist with this investigation. ‘urther, the contents of this affidavit do not represent the entirety of the evidence collected in this, investigation, however, it presents a concise summary of the facts which show the necessity for the execution of this search warrant. D/Sgt. Huttenlocker reviewed Wickham’s cellphone which was received from Zuniga, He determined he had unanswered texts beginning around 12PM on 12/25/2021. It also appeared he deletes phone calls and texts daily. Affiant, along with D/Sgt Sukovich and D/Sgt Huttenlocker executed a search warrant on 1080 Westfeild Drive on 12/27/2021, Swabs of suspected blood were collected from the residence. Inside of the house, Affiant located clothing and a pillow case in the basement that was covered in blood in plain sight (easily observed by the eye). This was not initially seized at the time of the first seareh warrant, On 12/29/2021, Affiant re-interviewed Tabata Zuniga at the Jackson County Sheriff's Office. During the interview, Tabate stated she wanted to go back into 1080 Westficld and look to see if there is a frying pan missing. P. Affiant was able to confirm Brian’s Snapchat user name of jerhroguy26 by looking at his Snapchat application on his phone. A preservation letter was sent to Snapchat on 12/29/2021 to preserve this account, Q Abffiant believes this execution of this search warrant is necessary to further this investigation, R. This includes, but is not limited to: trace evidence such as blood stains, fibers and DNA at the residence; security systems such as surveillance cameras, DVRs or other electronic storage devices which may hold videos; photographs of the residence and its condition; cellular telephones which ‘may contain communications telated to the injuries; prescription medications; and / or medical ; records Any and all evidence in the electronic format on cellular telephones or other electronic devices concerning the injuries sustained by Brian Wickham on 12/25/2021, including, but not limited to, photographs ot video files in electronic format, text messages, instant messages, call history, address books, account information, identifying numbers assigned to the device, e-mail correspondence saved to the device, interniot history or related web sites, and any information recording the suspect's schedule or travel, 3. The facts establishing probable cause or the grounds for search are: A. Affiantis a Detective Sergeant with the Jackson County Sheriff's Office currently assigned i as an investigator, Affiant has been a swom law enforcement officer with the Jackson i County Sheriff's Office for approximately 9 years. Affiant has beon involved in the investigation of numerous assaults and other violent crimes in Affiant's time as a law | enforcement officer. RECEIVES FEB 23 2022 SEARCH WARRANT AND AFFIDAVIT Page 2 State of Michigan Police Agency: Jackson County Sheriff's Office County of Jackson B, On 12/25/2021, Deputy Batlond was dispatched to 1080 Westfield Drive in Summit ‘Township for a possible assault victim. The caller was Tabatha Zuniga. C. When Deputy Barlond arrived on scene, Brian Wickham was laying on a bed in the residence, D, Deputy Barlond observed Wickham fo have a left upper bead injury that appeared as though it was en abrasion, He observed several cuts on his arms. He attempted to speak with Brian to ask him what had happened and he appeared as though he had sustained a closed head injury and was very confused and unable (o give any clear answers as to what had happened that evening. 5 Deputy Barlond-spoke-witt the callers Tabathe Zmiga, who advisedthe following: 1, She desoribed Brian Wickham as being her friend. Il. She originally came to the residence because she became concerned after she had not heard from Brian all day, She had also reached out fo Brian's sister and asked if she had heatd from him and his sistor had also not heard from him. She stated that he lives alone and his other family members had also been trying to get a hold of him since noon. TH, After contacting Brian’s sister, Tabatha responded to Brian’s residence at 1080 Westfield to check his welfare. When she arrived, the front door was unlocked aud sit. TV, Upon entering the home, she discovered Brian laying on the bedroom floor injured, Hee seemed confused and had urinated on himself. She advised that he told her a ‘guy had come over to give him a quote and had hit him and Jef. Y, He does drink alcohol and has diabetes. She is in the medical field so she tested his blood sugar when he arrived and it was reading 308, F. Atthe residence, Deputy Barlond observed there to be small emounts of blood on the floor of Brian's bedroom next to the bed; this is the location where ‘Tabatha had indicated she hhad Located him, In the hallway on the trim of one of the doors, he located a single blood drip. On the flooring in the hallway leading to the bedrooms, he had observed several blood drips leading toward the kitchen area, He looked around aud did not observe any other objects inside of the residence that had blood on them, He also checked the front doot to the residence and did not observe any signs of forced entry. G. Brian Wickham was transported to Henry Ford Allegiance Hospital by Jackson Community Ambulance. H, Deputy Barlond and D/Sgt. Huttenlocker spoke with Doctor Lapinski who stated after an MRI they determined Brian Wickham had multiple brain bleeds. He advised he was not able to determine if the injuties were fom an assault or not. Dr, Lapinski further advised Wickham was not making sense and any statements he made should not be relied upon. Huttenlocker responded back to Henry Ford Allegiance Health to check on the status of Wickham, He followed up with Physician's Assistant Danielle Pluff ‘who works on the neurological trauma team. Pluff had been working on Christmas and 12/27/2021. She described Wickham’s injuries as brain bleeds on both sides. When they shaved his head, they a saw bruise on top of his head on the loft hand side. She also determined at some point Wickham had a severe seizure and had bit his tongue. She was uncertain if a seizure caused the fall which resulted in head injury or not, She indicated there were at least two contacts to the head which could be from fall, assault or many other circumstances, i J. DiSgt. Huttenlocker reviewed Wickham’ s cellphone which was received from Zuniga.
