MOTION TO EXTEND PERIOD OF COMPLIANCE

Comes now, through the undersigned legal counsel, and unto this Honorable
Office most respectfully moves for the extension of the remediation period in
order to comply with the ORDER issued by the _________________, and
in support thereof AVER as follows:

1. That ____________ just secured the services of herein counsel,


hence the need for more time to review the records of the case and
carefully examine all the relevant documents in connection with
the issued COMPLIANCE ORDER.

2. That the named representatives of the _______ as mentioned in


the Order, failed to inform the upper management regarding the
remediation period. Hence, the failure to comply within the given
period was not due to any bad faith on the part of ______.

3. With this, the undersigned is constrained to respectfully request


the Honorable Office to allow __________________ a period
of thirty (30) days in order to comply with the following
deficiencies, to wit:

a) Non-registration under Rule 1020 of Occupational Safety and


Health Standards;
b) No certified/trained Safety Officer;
c) No trained/qualified First Aider, pursuant to Rule 1960 of
OSHS:
d) No first aid/emergency medicines;
e) No DOLE-received company OSH Program;
f) No Mandatory OSH Orientation Course/Training Course for all
workers;
g) No Provisions of Safety Signage’s;
h) No Emergency and disaster preparedness and mandated drills;

i) No available fire detection device;
j) Poor Housekeeping; and
k) Unsafe handling and storage of materials and inventories.

4. This MOTION is made in good faith and not intended to unduly


delay the above-entitled case, but only for the reasons above-
mentioned.

PRAYER
WHEREFORE, premises considered, it is most respectfully prayed
that the period to comply with the abovementioned deficiencies be extended
for a period of thirty (30) days from the date of this Motion or from the date of
your approval.
