A report was called from EADA (E&M) Hafiz Abad on subject complaint of
Babar & Sons .The EADA has furnished his report vide No.09/E&M/HFZ/19 dated
30.01.2019 (Annex-A).The allegations levelled by the applicant are discussed below.

Allegation No.1

That applicants firm Babar & Sons obtained License No 338-B dated
20.09.2001 from Market Committee Hafizabad for conducting
business of commission agents in old Grain Market and is getting
renewal of licence regularly and paying market fee. The
aforementioned licence is renewed by market committee up till
31.12.2017. That he paid Rs. 10000/- to concerned sub-inspector for
renewal of licence for the year 2018 and concerned Sub-inspector is
demanding more amount for payment of advance withholding tax for
the year 2017 where as his licence has already been renewed for the
year 2017.

The EADA in his report has incorporated statement of Mukhtar Ahmad, the then
sub-inspector and now posted at market committee Gujranwala (Annex-B). He has stated
that applicant attended office of market committee Hafizabad during May 2018 and handed
over to him Rs.10, 000/- for renewal of licence and payment of advance withholding tax for
the year 2018. He was asked to pay withholding tax of previous year- 2017 and he
promised to provide Advance withholding tax amount and he did not return. He was
contacted through his cell No and was requested to collect his amount given for renewal of
license or provide receipt or amount for payment of withholding tax for year 2017. Neither
he provided required amount of withholding tax for the year 2017 nor he collected his
Rs.10, 000/- given for renewal of license. The license in question cannot be renewed till
clearance of withholding tax of year-2017.
Conclusion:-

The applicant has not paid advance withholding tax of FBR for the
year 2017, His license of market committee can only be renewed on
payment of outstanding withholding tax for the year 2017. He is
required to pay outstanding amount of withholding tax for the year
2017 otherwise he should collect his amount of Rs.10000/- given for
renewal of license.
Allegation No.2

In his second allegation he mentioned that market committee

allotted plots of allotment quota during year 2015-16 to bogus 45
licencees in new grain market Hafizabad. We registered case in
Anti-Corruption Department against Administrator, Secretary and
other officials of market committee. The Anti-Corruption
Department neither recovered bribed amount nor got original
record from culprits. Further a department inquiry was initiated in
which chairman allotment /auction committee, Administrator market
committee and Secretary Market Committee was declared guilty
but no action has been taken against accused. He has requested
to proceed against those who involved in bogus allotment. He also
desired to refer case to NAB.
In this respect it is informed that department has already proceeded
against Mr. Shehbaz Ahmad Cheema, Mr. Safdar Cheema Inspector, Rana Shahid Sub-
Inspector, Mian Wahid Sub-Inspector of market committee Hafizabad and has awarded
different penalties to them as per PEEDA-2006 whereas charge sheet against Mr.Ali
Ahmad Randhawa the then DCO Hafizabad, Mr. Fakhur-ul Islam Dogar the then EDO
(F&P) and Mr. Shoaib Ullah Tarar Ex- Administrator Market committee has been framed
and is being conveyed to competent authority for initiating regular enquiry .

Recommendations:-

As far as allegation No. 1 of the complaint is concerned the

complainant is required to produce receipt of Advance withholding
tax of the year 2017 to Secretary Market committee Hafizabad and
get his license No 338-B renewed from market committee. If the
complainant does not want to produce said receipt he may collect
his paid amount Rs.10, 000/- from Secretary market committee
Hafizabad. The market committee Hafizabad is unable to renew
the licence in absence of receipt of withholding tax for the year
2017.
