MOTION FOR CANCELLATION and RESETTING OF THE

HEARING

ACCUSED ARLYN P. MARASIGAN, by the undersigned counsel,

to this Honorable Court respectfully states:

1. On October 27, 2020, undersigned counsel received thru e-

mail a notice setting the clarificatory hearing on November 19,
2020 at 8:30 o’ clock in the morning;

2. Unfortunately, on the said date and time, undersigned

counsel will appear as counsel for the plaintiff in Civil Case No.
19-0020, entitled “Alfonso L. Garcia, Jr. vs. Danilo P.
Decena” before the Regional Trial Court of Las Piñas City,
Branch 197, which was long set before this Honorable Court’s
notice. Copy of the Pre Trial Order dated September 24, 2020 is
hereto attached as Annex “A”.

3. In view thereof, the undersigned is constrained to humbly

move for the cancellation and resetting of the scheduled hearing
on ___________ 8:30 o’ clock in the morning to October 19,
2022 at 8:30 o’ clock in the morning.

4. This motion is being filed solely for the above stated reason
and not in any manner intended to delay the proceedings.

PRAYER
WHEREFORE, premises considered it is most humbly
prayed of this Honorable Court that the scheduled hearing set

CANCELLED AND RESET preferably to October 19, 2022 at
8:30 o’ clock in the morning or as soon as the calendar of this
Honorable Court may permit.

Other reliefs just and equitable under the premises are
