EXTRA JUDICIAL SETTLEMENT OF ESTATE

(Estate of Elizabeth Dela Cruz Manio)

 

KNOW ALL MEN BY THESE PRESENTS:

This Extra- Judicial Settlement of Estate among heirs, made entered into by and
among EMMANUEL DELA CRUZ MANIO, EMERITO DELA CRUZ MANIO, ESPERANZA
DELA CRUZ MANIO and ERIC DELA CRUZ MANIO, Filipinos, of legal ages, all with
residence and postal address at Candaba, Pampanga, all represented by EVANGELINE
MANIO GONZALES and EDWARD DELA CRUZ MANIO, as evidenced by a Special
Power of Attorney, hereto attached as Annex “A”.

WITNESSETH: THAT

WHEREAS, the above-named HEIRS are the only surviving and lawful heirs of
ELIZABETH DELA CRUZ MANIO who died intestate on December 20, 2022; Copy of
the Death Certificate is hereto attached as Annex “B” and Copies of the Certificate of
Live Births are hereto attached as Annex “C” and “C-1 to “C-5” respectively.

WHEREAS, the deceased at the time of her death left certain properties (“Estate”)
hereto attached as Annex “D” and “D-1 to D-__” and made an integral part of this
Deed;

WHEREAS, the above named decedent left no known debt or obligations which
remain unpaid and unsettled and chargeable against her estate.

WHEREAS, we are the heirs of the above named decedent entitled to and have the
right to succeed her estate, particularly the above described properties.

  Now THEREFORE, for and in consideration of the Provisions of Section 1, Rule 74

of the Revised Rules of Court of the Philippines, the parties hereto, do by these presents
agree to adjudicate unto ourselves the above described property, subject, however, to
the liabilities imposed by Section 4, Rule 74 of the said Rules of Court, in favor of any
other possible heirs, creditors and other persons who might have been deprived of their
lawful participation in the estate of the decedent for a period of two (2) years.

The parties agree to publish this instrument in a newspaper of general circulation

in the City/Province of ________ once a week for three consecutive weeks.

In the remote event that any other property of the decedent should ever be found
which is not included herein above, the HEIRS hereto further agree as they do so agree
to settle and distribute the same in like manner and proportion as herein established
and disposed.

That the HEIRS hereby covenant and further warrant that should there be
preterition or omission of one, some, or all of the compulsory heirs in the direct line,
whether living or not at the time of the execution of this Deed, will not invalidate/nullify
the terms and conditions of this Deed. Instead, the HEIRS shall proportionately oblige
themselves to pay to the omitted Heirs or the latters’ heir(s) the share which belongs to
him/them, in accordance with the rules of succession under the Civil Code of the
Philippines.

BEFORE ME, appeared the above stated parties showing their Identification
documents as stated below their names and known to me as the parties who executed
this Extra Judicial Settlement and they acknowledged to me as their free and voluntary
act and deed.

This document, consisting of two (2) pages including this page where this
acknowledgement is written, with every page thereof duly signed by the parties
including their instrumental witnesses, at the bottom or left margin thereof and seal
with notarial seal.
