Compliance
This Network Rail standard is mandatory and shall be complied with by Network Rail
and its contractors if applicable from 1st September 2012.
When this standard is implemented, it is permissible for all projects that have
formally completed GRIP Stage 3 (Option Selection) to continue to comply with the
issue of any relevant Network Rail standards current when GRIP Stage 3 was

1 Purpose
Works within Infrastructure Maintenance create a risk of contamination to sewer and
controlled waters. Infrastructure Maintenance has a responsibility to manage
discharges produced as a result of maintenance works.
This standard provides a means of compliance with environmental legislation for
England, Wales and Scotland.

2 Scope
This Network Rail standard specifies the process for managing discharges to sewers
and controlled waters. It applies to functions within Infrastructure Maintenance,
including Works Delivery teams.

This standard applies to all discharges, including to sewer and to controlled waters,
that result from Network Rail Maintenance delivery activities:
• Maintenance or Works Delivery works activities involving works (planned or
unplanned) where discharges might be produced;
• Maintenance or Works Delivery teams involved with or responsible for
activities, assets, sites or premises where discharges might be produced.

• Maintenance or Works Delivery teams that are working on or near a


watercourse, including weedspraying

3 Roles and responsibilities


Drainage Asset Engineer
Produces drainage management plans for all drainage assets within Maintenance
and retains details of consents. The accountability lies with the Route Asset Manager
(Civils)/Geotechnics via the correct reporting line.

Infrastructure Maintenance Delivery Manager (IMDM)


Accountable for the Delivery Unit to comply with all Network Rail standards and to
adhere to any requirements specified in this standard.

Infrastructure Maintenance Environment Specialists (IMES)


Offers further technical advice or assistance to all Route and Delivery Unit WHSEAs
for delivering tasks specified in this standard and going forward for ad hoc queries
regarding drainage.

Section Manager (SM)


Generic title for frontline manager of track, signalling, telecoms, off track,
electrification and plant, works delivery (etc.) teams within Infrastructure
Maintenance.

Workforce Health Safety and Environment Advisor (WHSEA (DU))


Advises on requirements specified in this standard from a health and safety
perspective as well as an environmental perspective. Responsible for cascading
information to the delivery unit.

Workforce Health Safety and Environment Advisor (WHSEA (Route))


Cascades requirements specified in this standard and offers further technical advice
to the Delivery Unit WHSEAs.

4 Definitions
For the purposes of this standard, the following terms and definitions apply.

combined sewer
piped drainage system conveying surface water runoff and foul flows usually owned
and maintained by a Water Authority or other outside party.

NOTE Some combined sewers are owned and maintained by Network Rail.
contaminated water
pollutants contained in quantities of water which exceed EA limits.

controlled waters
fresh and saline waters except sewers.
NOTE This includes rivers, lochs, reservoirs, burns, canals, ditches, estuaries, groundwater and
coastal waters (to the UK offshore territorial limit).

discharges
release of effluents to foul sewers or to controlled waters.

discharge consent
consent issued and monitored by the regulators, water authority or outside party
setting out the acceptable discharge limits for discharging effluents to controlled
waters.

NOTE Acceptable discharge limits are maximum limits set out in the discharge consent from the
regulators, water authority or outside party to minimise the polluting impact on a watercourse. It is
assessed on the polluting load, dilution factor and the existing quality of the receiving watercourse.

England and Wales with permissive powers to undertake work to secure clean water
drainage and water level management within drainage districts.

Mean high water springs


the highest level that spring tides reach on the average over a period of time (often
19 years).

Scottish Environment Protection Agency (SEPA)


the regulatory body for issuing discharge consents in Scotland under the Controlled
activities Regulations (CAR).

5 Drainage plans and drainage maintenance


5.1 Drainage Management Plans (DMP)
Each drainage system on the network shall have a Drainage Management Plan.
The Drainage Management Plan is provided by the drainage asset engineer based
on results of a current national survey, and is specified in NR/L3/CIV/005.

5.2 Drainage plans


The IMDM shall be accountable for managing the risk of contaminated discharges to
surface water drains. The IMDM shall be responsible for communicating the details
of any drainage plans for the depot staff to use in conjunction with the environmental
emergency plan, as specified in NR/L3/MTC/EN0098 and NR/L3/MTC/EN0225.
All depots should have a drainage plan. The drainage plan is a technical drawing to
identify which drains lead to foul sewer, combined sewer or surface water. If known,

all surface water drains should be marked in blue and all foul sewers marked in red.
Further assistance should be sought through the WHSEA (DU).
5.3 Site layout
All depots should manage their risk of contamination to surface water and identify
areas of risk such as chemical and soil storage and location of spoil heaps in relation
to drains. These should be stored in the Depot Environment Pack. All drains should
be assumed as surface water drains unless a survey proves otherwise.

5.4 Drainage maintenance


The IMDM shall be accountable for maintenance of all drainage systems within the
Delivery Units as specified in NR/L3/CIV/005.
This shall include:
a) maintaining the drains;
b) reporting of drainage defects.

6 Managing silt and sediment


6.1 General requirements
The SM shall:
a) not allow silt-containing water to drain or be pumped directly into a river,
stream or surface water drain;
b) take responsibility for discharges produced as a result of the work.

6.2 Minimising silt and sediment entering a watercourse and removing


blockages
The SM shall take measures to minimise the risk of silt and sediment to sewers and
controlled waters if significant amounts of silty water are produced as a result of
works.
Where it is unavoidable for sediment to be discharged into a watercourse, the
WHSEA (DU) shall notify the EA/SEPA for planned works.
In unplanned/emergency works, where sediment enters sewers and controlled
waters follow the incident response process as specified in NR/L3/MTC/EN0098.
If drains become blocked the SM shall assess the blockage on the quantity of
material, location, and the likelihood of polluting a watercourse. The SM shall seek a
suitable method to remove the blockage. The SM shall be responsible for reporting
this assessment to the WHSEA (DU).
To obtain guidance on minimising risk of sediment contaminating a watercourse
contact the IMES. Further regulatory advice can be sought from the EA/SEPA to
achieve legal compliance and obtain consents or licenses if needed.

7 Works that alter, amend or affect a drainage system sewers and controlled
waters
When any new works to excavate or dig into the ground have been planned, and
when installing new drains, culverts or any other drainage asset, the SM shall
comply with task risk control manual GA08, GA10 and GHE08 and implement
controls to minimise the risk. The SM shall also consult NR/L3/CIV/005, Drainage

manual.
Protection of the groundwater should be considered when any new works take place
with special consideration taken when excavating/piling through contaminated land.
The SM shall assess the risks of the works.
NOTE There is a greater potential to mobilise sediments and contamination through surface water
run-off to controlled waters.
The risk assessment shall include all risks to the drainage system including:
a) the size of the exposed ground;
b) the type of material;

c) the length of time the exposed ground is to be left;


d) the environs of the exposed ground area.
The WHSEA (DU) and/or the IMES shall provide technical assistance where
required.

8 Mobile facilities and mobile waste water storage


Where work sites require facilities for the duration of the works (e.g. mobile toilets
and standard or vehicle-based mobile wastewater storage), the SM shall have a
system in place to:
a) maintain these facilities;
b) minimise the risk of contaminated discharge occurring from Network Rail land.

When planning works which need mobile facilities a risk based approach should be
taken when planning the location of mobile facilities and waste water storage. As a
guide they should not be located within 10m of a watercourse due to the risk of
unstable ground and exposure. A consent may also be needed.
The SM shall check these facilities (whether provided by a contractor or Network
Rail) in accordance with supplier specifications for appropriate maintenance and
leakage.
Where a mobile toilet/wastewater storage container needs to be emptied, a licensed
waste carrier shall undertake this and a waste transfer note shall be provided and
stored as specified in NR/L3/MTC/EN0100.

9 Vehicle washing
All discharges from vehicle washing shall go to a foul sewer. A trade effluent
agreement shall be made with the sewerage undertaker.
NOTE This is a requirement of the Water Resources Act 1991 and Environmental Permitting
regulations, 2010. Water Environment (Controlled Activities) (Scotland) Regulations 2011 (CAR)
NOTE The EA/SEPA would not normally consent this discharge unless it has been fully treated.

Vehicles shall be washed:


a) in a designated enclosed washing bay; or
b) off site at a licensed vehicle washing utility if a vehicle washing area is not
available on site.

10 Weedspray restrictions
Environmental aspects shall be considered when planning applications by hand
spraying or by train spraying.

These aspects include watercourses, water source protection zones or protected


sites such as SSSIs. Protected sites can be identified on the GI Portal.
If herbicides will be used in a protected area, Natural England, the Countryside
Council for Wales or Scottish Natural Heritage shall be consulted.
Weedspray planning and works affecting water source protection zones, sewers and
controlled waters shall be conducted in accordance with the Network Rail code of
practice.

11 Obtaining and complying with consents


11.1 Managing and monitoring consents
The IMDM shall manage and monitor their compliance with any consents in their
delivery unit.
Monitoring may include sample retrieval and analysis by a competent laboratory.
Where non-compliance with a consent is identified from monitoring, the IMDM shall
instigate remedial action.
NOTE Compliance with the terms of a consent is a legal requirement.

11.2 Discharge consents


A discharge consent shall be obtained for discharging contaminated water into
controlled waters.
Contaminated water should either go to a foul sewer or be treated to a sufficient
standard determined in the permitting process of the discharge consent. The
sufficient standard will depend on the activity and load it might have into the
receiving water course. Discharge consents are site-specific.

NOTE The EA/SEPA no longer require a discharge consent for uncontaminated surface water
discharges. Uncontaminated surface water includes rain water run-off from buildings and
impermeable surfaces.
NOTE If in any doubt that a discharge consent is needed, advice can be sought from the regulator,
water authority or other outside party

11.3 Other consents


If a new connection leads to a surface water drain, combined sewer or controlled
water, a flood defence consent shall be obtained from the EA or local water authority
even if the water is uncontaminated.
If work is being carried out within 10 metres of a non-tidal water course or sixteen
meters of a tidal watercourse, a flood defence consent shall be obtained from the
EA.
NOTE In Scotland, these activities would require permission from SEPA under the Controlled
Activities Regulations (CAR).

11.4 Internal Drainage Board


If any planned maintenance works should affect a watercourse in areas covered by
an Internal Drainage Board, consultation with the EA and the IDB should be sought
to obtain consent for the works.
NOTE Only required in England and Wales

11.5 Marine Management Organisation


For any maintenance works that constitute an alteration or improvement either in or
over waters up to and including the mean high water springs, consent shall be
obtained from the Marine Management Organisation (MMO).
NOTE It is possible that multiple consents are needed depending on the size and extent of the
project. The consultation period can be a lengthy process and these consents should be considered
when planning works.
NOTE Further advice on consents can be obtained from the WHSEA (route and DU) or the IMES
regarding application/renewal/update of consents and monitoring regimes. Failure to comply with
legislation, consents and licenses can result in prosecution and reputational damage to Network Rail.

What’s New/ What’s Changed and Why: Standard written to reduce the compliance risk associated planned and unplanned works
when working near controlled waters or surface water/foul sewer drains in depot yards. This update to the standard details tasks
which demonstrate compliance with managing this risk. Safety and performance can be reduced with effective planning of works.

A new section of drainage plans and drainage maintenance has been drafted to align with the new Environement Management
System standard. Compliance in managing the risk of discharges to water has been outlined from a depot level. Managing the risk at
work sites has also been identified. Small amendments to all previous sections on Vehicle washing, silt and sediment and
weedspraying also reviewed. A total re-write of the section on managing discharge consents has been formed to include new
consents from the Environment Agency and including the Scottish Environment Protection Agency equivalent. New additions of the
Internal Drainage Board and Marine Management Organisation also included in this section.
