DRAFT ORDINANCE PROHIBITING ALL LIVESTOCK FRAMS/GROWERS, COMMERCIAL

ESTABLISHMENTS, INDUSTRIAL AND MANUFACTURING COMPANIES FROM DRAINING,

THROWING OR DISPOSING WASTE OF WHATEVER KIND INTO THE RIVER CREEKS AND
ITS ATTRIBUTES WITHIN THE JURISDICTION OF MUICIPALITY OF CUENCA, BATANGAS

WHEREAS, Sec 458, No1 (VI) of Local Government Code of 1991 mandates the Sangguniang Bayan to
enact ordinances, resolutions and appropriate funds to protect the environment and impose appropriate
penalties for acts which endanger the environment and such other activities which result in pollution in
the acceleration of eutrophication of rivers or in ecological imbalance;
WHEREAS, there are at present livestock farms, commercial establishments, industrial and
manufacturing companies disposing their waste in canals, creeks, and the waters of Municipality of
Cuenca Batangas;
WHEREAS, the Sangguniang Panlalawigan of Batangas passed Resolution No. 450 Series of 2002
enjoining the municipalities and cities of Batangas to pass appropriate ordinance or resolutions adopting
and implementing measures to address or abate the pollution problems and put to half further degradation
of creeks and river whose tributaries include river system in the south;
WHEREAS, the establishment of livestock farms and industries along the river system may pollute the
water of Municipality of Cuenca may adversely affect the benefits derived from them by our marginal
constituents, destroy marine environment and affect tourism;
SECTION 1 TITLE – this Ordinance shall be known as “ORDINANCE PROHIBITNG
THE DISPOSAL OF AGRICULTURAL, COMMERCIAL, AND INDUSTRIAL OR
MANUFACTURING WASTE IN THE WATERS OF MUNICIPALITY OF CUENCA BATANGAS
SECTION 2 COVERAGE – this ordinance shall cover and applicable to all livestock farm commercial,
industrial and manufacturing establishments already existing at the time of the passage of this ordinance
and those which may constructed after this passage.
