LEAVE & LEASE AGREEMENT

This agreement is made at Noida on the 24st day of September 2020 between Mr
Karan Batra (name of the landlord) S/o Mr Nidhish Batra R/o Ganpati Villa, 243
Civil Lines, Bareily, UP, hereinafter called the Lessor which representatives, assignees,
successors, and administrators only one part.

AND

Mr Shubham Gupta(AADHAAR 948793883277) S/o Mr Shiv Kumar Gupta, R/o


Sindhi Colony, Haricharan Vakil Ka Makan, Gangapur City, Sawai Madhopur,
Rajasthan-322201, Mr Rohit Katariya (AADHAAR 338065620552) S/o Mr Ashok
Katariya R/o CP-114, Maurya Enclave, Pitampura, Delhi 110034, Mr Naman
Gupta, S/o Manoj Kumar Gupta, R/o 64, Bansi Pura, Suraj Kund Road, Meerut,
UP. Hereinafter called the Lessee which express shall unless repugnant to the context
includes its successors, legal representatives, assigns, and administrators only second
part.

Whereas the lessor is the owner of the residential Flat No.9163 situated at ATS ONE
HAMLET, Sector 104, Noida, UP, with absolute right to let out any portion thereof on
such terms and conditions as he may think fit.

The said premises consisting of 3 bedrooms, 3 toilets, Drawing cum Dining room and 1
Kitchen along with the fixtures and fittings which will hereinafter be referred to as the
premises at Flat No.9163 situated at ATS ONE HAMLET, Sector 104, Noida, UP.

And whereas the lessee has agreed to take the above premises belonging to the lessor for
residence only and not for subletting, on the terms and conditions herein contained for a
period of 11 months w.e.f 1 October 2020.

NOW THEREFORE IT IS AGREED AS FOLLOWS:

1. That the lessee shall pay the lessor during the period of this agreement a
monthly rent of Rs 29500/- (Rupees Twenty nine thousand five hundred
only).
2. That the lessee has paid to the lessor a sum of Rs 60000/- (Rupees Sixty
Thousand only) as security deposit, free of interest.
3. That the Lessee undertakes to pay as sum of Rs 5500/- per month as society
maintenance charges or any other amount as specified by the society from
time to time.
4. That period of lease granted by Lessor to the Lessee for the demised
premises has been agreed to be 11 months, which could be extended
for a further period of 0 months with mutually agreed on terms and
conditions therein.
5. That the charges for electricity and water shall be paid by the Lessee to the
concerned authorities as per bills to be received from time to time, and the
original copy of the same shall be sent to the Lessor periodically at his
address.
6. That no structural additions or alterations shall be made by the Lessee in the
demised premises or any part thereof without prior permission of the Lessor.
However minor additions may be carried out by the lessee are their own cost
with prior permission of the lessor for installation of coolers, air
conditioners, exhaust, etc. which shall be repaired/restored to their original
condition by the lessee at the time of handing over possession of the said
premises to the lessor.
7. That the lessee shall permit the lessor or his authorized representative to
enter the premises for inspection and to carry out repair with appointment.
8. The lessee shall not use the property for any dangerous, noxious manufacture
of occupation or for any illegal or immoral act or purpose.
9. That day to day repairs including minor repairs to the electrical, sanitary and
water supply system such as replacement of switches, fuses and leakage or
change of water taps, etc. shall be effected by the lessee at his own cost in
case of any major repairs such as bursting in electricity or leakage in sanitary
pipes or any damage to the structure, the same shall be repaired by the lessor
at his own cost. The premises are being given after white wash/distemper,
varnish and this work is normally not required for next two years.
10. That all rules, regulations, and by-laws of the municipal, flat owner
association and other authority having jurisdiction over the premises shall be
strictly complied with by the lessee.
11. That all sanitary, electrical, other fittings in the premises shall be restored by
the lessee at the time of handing over the peaceful possession to the lessor in

a good condition as they are at present subject to natural wear and tear and
damage by act of GOD.
12. That the premise will be handed over by the lessor with all lights, fans, taps,
WC, etc, in good working condition.
13. The lease deed is being executed at Noida and any dispute arising out of this
lease deed will be subject to the jurisdiction of District Court Gautam Budh
Nagar.
14. That the lease can be terminated by given one calendar month notice by
either party.
15. That the premises have been painted distempered and polished which shall
not require any further distempering painting and polishing during his
tenancy period.
16. That if there will be breach of any above said terms and condition
particularly payment of rent, the lease shall be automatically come to an end.
The lessor will take the possession back by giving 30 days notice.
17. That if the tenancy will extend for the further period then the rent will be
increased by 10%.
18. IN WITNESSES HEREOF THE PARTIES HETRETO have set their
respective hands on these presents on the date, month and year herein above
first mentioned in the presence of the following witnesses:-
