EXERCISE: Explain the following briefly in 3 – 5 sentences.

1. The City of Roxas initiated a road rehabilitation project. One night, AAA was riding his
bike which did not have lights when he fell into a hole on the street being constructed.
What is the liability of the government and/or public officer, if there is any?

Answer:
No, the government has no liability on what happened to AAA, because in the first place
he is riding a bike which did not have lights. A public officer shall not be civilly liable for acts
done in the performance of his official duties, unless there is a clear showing of bad faith, malice
or negligence.

2. Can a City Mayor be impeached?


Answer:
No, there is no legal basis or grounds for impeachment because it’s not his fault why
AAA fell into a hole on the street being constructed.

3. Several illegal settlers have settled in an area in Brgy. Squatter. The Local Government
Unit wishes to use this area to build a quarantine center for COVID 19 patients. To effect
this, several officers went to the area and forcibly evicted the illegal settlers. Is the action
of the LGU valid? Provide your legal basis.

Answer:

No, their action is not valid. No resettlement of urban or rural dwellers shall be
undertaken without adequate consultation with them and the communities where they are to be
located". The constitutional requirement that the eviction of squatters and thee demolition of
their shanties shall be done in accordance with law does not mean that the validity or legality of
the demolition or eviction hinges on the existence of a resettlement area designated or earmarked
by the Government.
