Pertinent_Authority;

The Gun Control Act of 1968 (GCA), as amended, defines "firearm" to include

"... any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a
projectile by the action of an explosive...[and] ...any firearm muffler or firearm silencer...." (See 18 U.S.C.
$ 921(a)03).)

ln addition, the GCA defines the terms "firearm silencer" and "firearm muffler" to mean:

"...any device for silencing, muffling, or diminishing the report of a portable firearm, including any
combination ofparts, designed or redesigned, and intended for use in assembling or fabricating a firearm
silencer or firearm muffler, and any part intended only for use in such assembly orfabrication."
(See 18 US.C. $ 921(a)024).)

The National Firearms Act (NFA) $ 5845(a) defines "firearm" to include "...(7) any silencer (as defined in
section 921 of title 18, United States Code)...." (See 26 U.S.C. $ 5845(a)(7).)

Findings:
Exhibit l is a cardboard box containing a black in color, cylindrical device. My examination revealed that it
is an unmodified NAPA fuel filter, model number 4003. It measures approximately I1-5/8 inches in length
and approximately 2-1/8 inches at its major diameter, The device has internal 3/4 NPT threads on each end.

Findings (cont.);

As submitted, the device is still in its original unmodified state and as such has not reached the stage to be
considered a silencer or silencer part. In order for the device to have reached that stage, the original design
would have to be modified by creating a hole for the projectile to pass through or by marking (indexing) the
submitted sample to show where such a hole should be made. The creation or indexing of the hole would
negate the original purpose of the device and result in the device being redesigned as a silencer,

Eyhibit2 is a cylindrical device with internal 1/2x28 threads and extemal 3/4 NPT threads. The device is
approximately 2-1/2 inches in length and approximately I inch at its major diameter. The device also has
four longitudinal ports which are approximately 3/16 inch wide and 1-1/4 inches in length. The design of
the device is consistent with a muzzle device for an AR-15 type firearm.

Exhibit_3 consists of eight unmodified automotive type freeze plugs, a blue plastic disc approximately 1-5/8
inches in diameter with a centrally located hole approximately I-5/16 inches in diameter and a piece of
paper containing instructions for marking the center of the freeze plugs. The freeze plugs are made of
galvanized metal and are approximately 1-3/4 inches in diameter. In accordance with the provided
instructions, the blue disc is designed to be placed in the freeze plug and a 3/16 center punch used to mark
the center of the freeze plug.

As submitted, these devices are still in their original unmodified state and as such have not reached the stage
to be considered a silencer or silencer parts. In order for these devices to have reached that stage, the
original design would have to be modified by creating a hole for the projectile to pass through or by
marking (indexing) the submitted samples to show where such holes should be made. The creation or
indexing of the hole would negate the original purpose of the devices and result in the devices being
redesigned as a silencer or silencer parts.

Exhibit_ 4 consists of two sections of aluminum tube approximately 5 inches in length and 1-3/4 inches in
diameter (internal diameter is approximately 1-9/16 inches). During my examination, I noted the original
packaging for Exhibit 4 was marked as follows:

As submitted, these devices are still in their original unmodified state and as such have not reached the stage
to be considered a silencer or silencer parts. In order for these devices to have reached that stage, the
original design would have to be modified by the addition of threads to readily accept attachment to a
firearm, the addition of end caps either through welding or threading, and/or the addition of internal
components intended to silence, muffle or diminish the report of a portable firearm. The addition of any of
these features would negate the original purpose of the devices and result in the devices being redesigned as
a silencer or silencer parts.

Exhibit 4 being an unmodified piece of aluminum tubing, is not subject to regulation under the provisions of
the GCA or NFA; therefore, it is not a "firearm" or a "firearm silencer" as defined.

The freeze plugs you have might very in exterior size as the specs vary when manufactured. This is
not a problem if your freeze plug is to loose in your estimation simply put your plug cup facing down
on a hard surface and hit the center of the plug with a hammer until it spreads out a bit Make sure to
wear safety glass, or a full protective face mask, good hand protection, leather chaps, and crotch
protection. The centering jig included in this package is meant for a 3/16 centering punch to mark you
freeze plugs. Never drill into or through the centering Jig.
