Opening: Good afternoon everyone, my name is Kathryn Ashby and I am the General Counsel

with Widgets Delivery, Inc. I am here to discuss with you any questions or concerns you have
regarding the implementation of GPS tracking software in the company vehicles. I will open us
up begin with a brief overview of the tracking policy and then will accept questions.

Purpose of Tracking Policy


 To improve delivery time estimates
 Reduce communication and delivery schedule workload on drivers and
 Reduce loss of company property and goods.

● Tracking devices will only be installed in company-owned delivery vans.


● Tracking devices will only be remotely activated during company-work hours.
● Tracking devices will have the ability to remotely activated if there is a special need
○ (i.e., theft, emergency contact).
● Drivers may request tracking devices be deactivated for periods up to an hour during the
workday.
● Tracking data will be collected and stored by a third-party service provider.
● Access to tracking data is limited to necessary supervisorsdispatch supervisors,
fulfillment managers, but may be requested with authorization.
● Improper use of delivery truck tracking data will result in consequences.
○ I.e. immediate loss of access to tracking data. It may also result in reassignment,
suspension, investigation, or loss of employment.
● Tampering or destruction of GPS trackers (or any company property) may result in a
written warning, suspension, termination and/or forwarding of incident information to
local law enforcement.

● GPS tracking data will only be stored up to 2 months, unless preservation is required by
law, investigation, or suit.

Practices

Employee Privacy
● To reduce the tracking of GPS drivers have the options of:
○ Commuting in a private vehicle
○ Use of a personal vehicle for small deliveries or personal time
○ Requesting reassignment to another division w/o change in pay or promotion.
● Drivers do not have the option to
○ Remove or tamper with tracking devices
○ Use of Jammer technology


Legal Considerations
● Right to Privacy
○ Under Illinois law, employers have the right to track their owned vehicles while
under the use of employees.
○ Many jurisdictions do not recognize a right to privacy on a roadway.
○ Company tracking devices will not be activated during non-work hours unless
there is a reasonable necessity.
● Use of Jammers
○ Use of a jammer to block GPS can block radio and cell signals creating a threat
to public safety.
○ It is a FCC violation and can result in criminal fines.
● Consent
○ Only the EMPLOYERS consent is needed to track company vehicles in Illinois.
○ Consent forms detailing what information is gathered, what it may be used for,
how it is protected, and who may have access will be provided.

the GPS will go into effect on January 1st and we must have your form in order for you to check
