REORGANIZATION OF BARANGAY
ANTI-DRUG ABUSE COUNCIL
WHEREAS, the constitution mandates that government shall promote the quality of life of the
people;
WHEREAS, Section 16 of the Local Government Code of 1991 provides that Local
Government Unit (LGU’s) shall pursue undertakings to improve public morals and maintain peace
and order, among other equally significant concerns;
WHEREAS, DILG Memorandum Circular No. 2015-63, mandates revitalization of the
Barangay Anti-Drug Abuse Council (BADAC) and their role in drug clearing operations, issued to
emphasize to local authorities, especially barangay officials, their principal responsibilities in
support of overall government efforts to address peace and order, particularly to curb illegal drugs
and other substances.
NOW THEREFORE, I ARNOLD L. BURIEL, Punong Barangay of Barangay Talahik, Surallah,
South Cotabato by virtue of the power vested upon me by law do hereby order the re-organization of
the BARANGAY ANTI-DRUG ABUSE COUNCIL.
SECTION 1. COMPOSITION: The Barangay Anti-Drug Abuse Council shall be composed of
the following:

SECTION II. POWER AND FUNCTIONS


The Local Anti-Drug Abuse Council shall perform the following roles and responsibilities:
1. Conduct regular meetings at least once a month and call for special meetings whenever
necessary;
2. Plan, strategize, implement and evaluate programs and projects on drug abuse prevention in
the barangay;
3. Organize the BADAC Auxiliary Team to compose an ideal number of 25 members per 2,000
population of the barangay representing streets, puroks, subdivision or sitios;
4. Orient the BADAC Auxiliary Team on their roles and functions and in formulating plan of
action to address the problems;
5. Equip barangay Tanods and BADAC Auxiliary Team on their roles and functions in the
campaign against street level illegal drug trade through seminars or trainings;
6. Coordinate and collaborate with other institutions implementing programs and projects on
drug abuse prevention at the barangay level;
7. Continuously gather and update data on all drug related incidents and its effect on the peace
and order situations in the barangay including listing of suspected drug users and pushers;
8. Submit a monthly report to the Municipality Anti-Drug Abuse Council copy furnished the
DILG Municipal Filed Office.
9. Refer suspected Drug users to the C/MADAC and other institutions for corresponding
counseling and/or rehabilitations;
10. Conduct an information, education campaign (IEC) on illegal drug demand reduction;
11. Monitor disposition and progress of drug-related cases failed; and
12. Perform other related functions.

b. Roles and Responsibilities


• Prepare and maintain a confidential list of suspected user, pushers, financiers and/or
protectors of illegal drug trade found in the LGUs area or jurisdiction to be submitted to the
Municipal Anti-Drug Abuse Council copy furnished the PNP-Anti-Illegal Drug special operations
task force (AIDSOT ;and
• Establish rehabilitation/referral desks and process application for rehabilitation of drug
dependents.
Pre-Operations
• Identification of drug affected house clusters, work places, streets, puroks and sitios where
manufacture, delivery, sale or use of illegal Drugs are being conducted and to report the same
immediately to the PNP or the Philippines Drug Enforcement Agency (PDEA).
• Conduct administrative searches of suspected drugs den/laboratories.
• Conduct briefings, meetings prior to the launching of operations to ensure positive results
and safety of the operating teams and the community.
DURING OPERATIONS
• Ensure safety of the community and regularity of the operations.
• Any elected barangay official present during the operations to witness the inventory of seized
drugs/paraphernalia.
• Extend such other necessary assistance to the PDEA and PNP authorities in its operations
against illegal drugs including but not limited to the preservation of evidence nd protection of
witnesses and suspects against unlawful acts.
POST OPERATIONS
• The elected barangay official present during the operations shall execute an affidavit and act
as witness in court hearings in the prosecution of drug cases.
• Submit reports of drug-clearing operations conducted, if any, to the City/Municipal Anti-
Drug Abuse Council copy furnished the DILG City/ Municipal Field Office;
For operations conducted/initiated by the PDEA/PNP, an elected barangay official should be
involved immediately after the raid and be present to stand as witness during the conduct of
inventory.

b. Roles and Responsibilities
a. Coordinate and collaborate with other institutions in the barangay, if any (i.e. Barangay,”
Barangay Intelligence Network (BIN), “The Eye in the Barangay,” Barangay Peacekeeping Action
Team (BPAT), etc.) in implementing programs and projects on anti –illegal drug abuse;
b. Conduct consultative meetings with organizations in the barangay, such as the Parents
Teachers Community Association (PTCA), youth Groups, Boy and Girls Scout, religious
organizations, Senior Citizen, homeowner associations, neighborhood associations, puroks and
tricycle operators and driver’s association(TODA) and other organizations existing in the community
to get their commitment to assist in curbing the drug menace I the community
Strengthen the family by promoting values, parental care and guidance that will prevent children
from attempting to and/or use of prohibited drugs;
d. Strengthen the linkages of the Barangay Officials with the community higher LGUs, local
police and PDEA on anti-illegal drug campaign;
e. Conduct necessary seminars for the community on the dangers of illegal drugs in coordination
with the PNP;
f. Empower the community in reporting drug related cases through an award/commendation
system; and
g. Identify and implement sustainable livelihood projects as a reintegration program to former drug
pushers and drug addicts.
IV. Sanctions
All concerned local authorities are hereby advised that:
a. Failure of the concerned local officials to appropriate a substantial portion of their respective
Annual Budget to assist in or enhance the enforcement of RA 9165, as mandatorily required by
Section 51 of RA 9165 in all budget preparations in addition to those already mandatorily required
under Section 324 of the Local Government Code, shall be ground for disapproval of the Annual
Budget on review and can be a ground for possible administrative case of dereliction of duty
pursuant to Section 60 of the Local Government Code.
b. Failure of the Local Officials to take appropriate measures to enforce the pertinent provision
of RA 9165 after being made aware by the PDEA and/or PNP and other law enforcement agencies
that illegal drugs sale, delivery and use is rampant within their LGU; or shabu and other illegal
drug laboratories and marijuana plantation have been uncovered within the area of their
jurisdiction shall be considered as prima facie evidence for administrative charge(s) for gross
negligence or dereliction of duties, as may be warranted by evidence.
c. Any local official engaged in the manufacture, sale, delivery, transportation and use of illegal
drugs or who may have been benefited therefrom shall be dealt with criminally and administratively
pursuant to the provisions of RA 9165.
V. Repealing Clause
All previous issuances which are inconsistent herewith are hereby repealed or modified
accordingly.
SECTION IV. REPEALING CLAUSE
Upon effectivity of the Executive Order, all preceding executive orders pertaining to the Organization
of the Barangay Anti-Drug Abuse Council is hereby repeated.

AN ORDER CREATING AND DESIGNATING THE FOCAL PERSON AND


COORDINATOR OF THE TREATMENT AND REHABILITATION DESK.

WHEREAS, the Dangerous Drugs Board (DDB) Regulation No. 3 provides for the parameters
and requisites for the Drug Cleared barangay;
WHEREAS, the parameters and requisites further enhance the classification of the barangay;
WHEREAS, one of the requisites/parameter before a barangay can be declared is the existence
of a voluntary and compulsory drug treatment and rehabilitation processing desk;
NOW THEREFORE, I ARNOLD L. BURIEL, Punong Barangay of Barangay Talahik, Surallah,
South Cotabato, by virtue of the authority vested in me by law do hereby order the following:
a. Creation of a Voluntary and Compulsory Drug Treatment and Rehabilitation Desk.
b. Designating HON. WILLY LANSANGAN-Barangay Kagawad as the Focal Person and
Coordinator of the Treatment and Rehabilitation Desk.

The designating Focal/Coordinator of the Drug Treatment and Rehabilitation Desk shall be in charge of
the referral/appropriate actions for the assessed SPID in the barangay.

This EXECUTIVE ORDER shall be effective upon the signature of the undersigned.

AN ORDER ORGANIZING THE MASA MASID TEAM

WHEREAS, memorandum circular 2016-116 (dated September 2, 2016) provides for the implementation of the
MASA MASID (Mamayang ayaw sa Anomalya, mamayang ayaw sa illegal na Droga) Program.

WHEREAS, RA 9165 also known as the “Comprehensive Dangerous Drugs Act of 2002” protects the state and
its individuals from the possible harms brought by the abuse of illegal drug substances.

WHEREAS, Article II, Section 23, 1987 Philippine Constitution, State: “ The state shall encourage non-
governmental, community-based, or sectoral organizations that promote the welfare of the nation.

WHEREAS, the Local government code of 1991 also encourages multi-sectoral participation. It is provided
(Section 3 (1)” that the participation of private sector in local governance, particularly in the delivery of basic
services, shall be encouraged to ensure that ensure the viability of local autonomy as an alternative strategy for
sustainable development”.

NOWTHERFORE, I ARNOLD L. BURIEL, Punong Barangay, by virtue of the power vested in me by law do
hereby order the following:

SECTION I. Organization
There is hereby created a MASA MASID team in the barangay.

SECTION II. Composition


The MASA MASID team shall be composed of the following

SECTION III. Roles and Responsibilities

The MASA MASID team shall have the following roles and responsibilities:

1. Conduct IEC advocacy.


2. Organize forums, seminars and related activities on prevention and demand reduction.
3. Secure support of Local media.
4. Coordinate and partner with schools for possible partnership on information drive against illegal
drugs.
5. Forge partnership with the Local organizations where primary mission is to fight illegal
drugs/activities.
6. Encourage the support of the community on gathering and reporting information on any incident
related to illegal drug activities.
7. Encourage the support of the community on gathering and reporting information on any incident

8. Institute reporting mechanism in consultation with the local PNP and church/faith based
rehabilitation.
9. Monitor the progress of the recovering drug dependents.
10. Work with the network of local volunteers on the implementation of interventions for
community based rehabilitation programs and;
11. Assist in the reintegration of the recovering drug dependents.

SECTION IV. Effectivity

This Executive Order shall take effect immediately.

CREATING BARANGAY PEACE AND ORDER COMMITTEE AS THE IMPLEMENTING ARM OF THE
MUNICIPAL PEACE AND
ORDER IN ACCORDANCE TO EO 366.

WHEREAS, pursuant to EO 366 entitled “Further amending Executive Order No. 309, series of 1987, entitled
the Peace and Order Council, as amended by Executive Order No. 317, series of 1988, Executive Order No. 320, series of
1988 and Executive No. 20, Series of 1992 and organizing the Barangay Peace and Order Committees as the
implementing arm of the Municipal Peace and Order Council at the Barangay level.

WHEREAS, peace and order is one of main concern of the Local Government Units and there exist an
imperative need to enhance the effectiveness of the peace and order councils in its crime prevention and suppression
mission through the expansion of its membership and extension of its structure down to the Barangay level;

NOW THEREFORE, I, ARNOLD L. BURIEL, Punong Barangay of Barangay Talahik, Surallah, South
Cotabato by virtue of the powers vested upon me by law do hereby order.

SECTION 1. CREATION & COMPOSITION of Barangay and Order Committee. There shall be an organized
Peace and Order Committees to serve as implementing arm of the Municipal Peace and Order Council at the Barangay
Level. Such committee shall be composed of the following:

Barangay Government shall appropriate the necessary funds for the operation of the committee from any available
local funds.

SECTION 2. Duties and responsibilities of the Barangay Peace and Order Committee. The Barangay Peace and Order
Committee shall have the following functions and responsibilities

1. Monitor and coordinate the implementation of peace and order programs and projects at the Barangay level;
2. Serve as an information-gathering mechanism;
3. Monitor and check the nefarious activities and criminal elements’
4. Identify Barangay constituents with strong deviant behavior for referral to appropriate authorities.
5. Maintain continuing dialogue, close coordination and support with the higher levels of peace and order
councils and law enforcement units;
6. Formulate plans and recommend such measures which will improve or enhance peace and order and public
safety in their area of responsibilities;
7. Monitor, coordinate and supervise the operation of all community based anti-crime movements within the
Barangay;
8. Make periodic assessment of the prevailing peace and order situation in their respective areas of responsibility
and submit report with appropriate recommendations to the higher level Peace and Order Council; and
9. Perform such order functions, which may be assigned by higher level peace and order councils;

Section 3. Linkages or Relationships with Other Anti-Crime Bodies. The BPOC shall coordinate and oversee the
activities of all existing bodies concerned with crime prevention and control, public safety intervention operating within
the jurisdiction of the Barangay such as Barangay Anti-Drug Abuse Council (BADAC), the Barangay Intelligence
Network [BIN], Barangay Disaster Coordinating Council (BDCC) and others. It shall closely supervise and monitor
activities of all anti-crime bodies within the Barangay to ensure collaboration and integration of efforts toward crime
prevention and control. Likewise, the BPOC, shall coordinate with Barangay Development Council to ensure that
programs and activities of the committee are integrated in the BDP.

Section 4. Secretariat. The BPOC secretariat shall perform the following functions:
a. Prepare Peace and Order Plans and projects at the Barangay level taking into consideration the prevailing
peace and order situation in their area of responsibility.
b. Implement and monitor BPOC operations
c. Provide a forum for dialogues on problems and issues effecting peace and order at the Barangay level.
d. Assist in the conduct of research projects and evaluation activities.
e. Take actions on matters affecting peace and order that require immediately attention at their level and within
the scope of their authority, and
f. Perform related tasks.

It shall be composed of the following:

evidence and protection of witnesses and suspects against unlawful acts.

 Submit reports of drug-clearing operations conducted, if any, to the
City/Municipal Anti-drug Abuse Council copy furnished the DILG
City/Municipal Field Office.

SECTION III. REPEALING CLAUSE
