MEMORANDUM OF UNDERSTANDING

THIS MEMORANDUM OF UNDERSTANDING made on the 06TH day of

November Two Thousand and Twenty Two between THE WHITE CRESCENT
HOSPITAL of P.O Box 1320-30300, KAPSABET hereinafter referred to as the
“1ST PARTY” which expression shall where the context so admits include its
successors and assigns of the one part AND BARNABA KEMBOI I/D NO
1245933 and EDWIN LAGAT I/D 27844267 of P.O Box ………….. .
hereinafter referred to as the “2ND PARTIES” of the other part which
expression shall where the context so admits include their heirs, successors
and assigns of the other part.

AND WHEREAS the 1st Party is a level five hospital offering both inpatient
and outpatient treatment to patients AND WHEREAS the 2nd Parties
admitted his nephew JULIUS KIPKOECH to the Intensive Care Unit (ICU) of
the 1st Party’s facility for intensive treatment AND WHEREAS the said
Julius Kipkoech has significantly improved but still needs further treatment
AND WHEREAS,the 2nd party wishes to transfer the said JULIUS KIPKOECH
to a cheaper public health facility and whereas JULIUS KIPKOECH has
accrued hospital bill of Kenya Shillings 442,918 (FOUR HANDRED AND
FOURTY TWO THOUSAND NINE HUNDRED AND EIGHTEEN ONLY) AND
the 2ND party has paid KSH 250,000(TWO HUNDRED AND FIFTY
THOUSAND SHILLINGS ONLY) Leaving a balance of KSH 162,918 (ONE
HUNDRED AND SIXTY TWO THOUSAND NINE HUNDRED AND EIGHTEEN
SHILLINGS)WHEREAS the 2nd Parties are unable to settle the aforesaid
balance and have requested the 1st Party to release the said JULIUS
KIPKOECH for further management in the public health facility before the
settlement of the aforesaid balance of the hospital bill on the promise to
settle the aforesaid balance within seven days from the date of the
memorandum of understanding AND WHEREAS the 1st Party has agreed to
the aforesaid request

The 2ND party has offered his little in all that parcel of land known as
Nandi/Kamobo/6958 as security for the aforesaid request.

NOW IT IS HEREBY AGREED: -

1. The Parties hereby agree that the total outstanding hospital bill
for the treatment of JULIUS KIPKOECH is Kenya
Shillings……………. (Kes………)

2. The Parties hereby agree that the 2 nd Parties are unable to settle
the aforesaid bill on the signing of this understanding.

3. The 2nd Parties have requested the 1 st Party to release the said
JULIUS KIPKOECH the 2nd Parties to enable them to receive
further treatment at KCRH the 1st Party has agreed to release the
patient JULIUS KIPKOECH on the signing of this memorandum
and subject to the payment of the hospital bill.

4. The Parties hereby agree that the total hospital bill of Kenya
Shillings…………… (Kes……………….) shall be settled within four
months of the signing of this memorandum of understanding.

5. The Parties hereby agree that this memorandum of

understanding is entered freely, willingly, without coercion and in
good faith and shall remaining binding until the total hospital bill is
settled in full.
