Sub: Complaint against Yogesh Kumar Mishra R/o. DDA Flat No.681,
Radhika Apartment, Sector-14, Dwarka, New Delhi-110077 for
committing the offence of criminal breach of trust, cheating
andharassment by lodging false complaint through his wife Mrs.
Aradhana Mishra

Respected sir,

This is to bring in to your kind notice that above named accused


person Yogesh Kumar Mishra being known to the Complainant
represented the Complainant that he was running a company in the
name & style of M/s Connex logistics and requested the Complainant to
give him business. After few days, he again approached the Complainant
and stated that he suffered loss in his business and requested
Complainant to give him job in the company of Complainant.
Considering his representation and needs, the Complainant agreed to
give him part time work/work from home, in August, 2014 vide letter No.
CFPL_ HR_YM_003 dated 01.08.2014. The accused namely Yogesh
Kumar Mishra further requested the Complainant that he was facing
financial crisis and was in dire need of financial help. Yogesh Kumar
Mishra further asked the complainant to provide work from home
facility/part time work to his wife also so that he may be overcome from
the financial crisis. The complainant gave the employment to Ms.
Aaradhana Mishra vide letter dated CFPL_HR_AM_004_2014 dated
16.08.2014. Being engaged in the company of the Complainant, the
Complainant agreed to help him out through financial loan and
advanced him loan of a sum of Rs.2, 25, 000/- in six installments as per
his needs/requirement from August, 2014 to February, 2015 in various
installments through bank account. While availing the above loan,
Yogesh Kumar Mishra assured the Complainant that the above said loan
would be repaid by him as and when he get commission or in alternate,
the same would be adjusted against the salary payable to him. At the
time of joining the company, the Complainant also issued him a laptop
make Sony value approx Rs. 30,000/- for the purpose of company’s work
and storage of company correspondence/data vide letter dated
10.08.2014.

Ms. Aaradhana Mishra left the job on 31.03.2015 and


Yogesh Kumar Mishra left the job on 06.04.2015. From the first week
of April, 2015, Yogesh Kumar Mishra started avoiding the Complainant
and without prior permission, he engaged himself in some other
company and he sent a mail dated 06.04.2015 to the Complainant
asking him that he was in need of experience and salary certificate
from the Complainant. The Complainant asked him to repay the loan
amount which he had availed against his salary /commission. The
Complainant further asked him to deposit the laptop as soon as
possible and reminded him that in case he failed to deposit the said
laptop within 24 hours, the penalty amount of Rs. 1500/- per day
would be charged from him for keeping the said laptop without any
authority. Yogesh Kumar Mishra started to avoid the Complainant on
one pretext or other. The Complainant persuaded him number of times
by making number of calls and by sending SMSs but the accused
Yogesh Kumar Sharma did not complied the demands of the
Complainant. On 30.04.2015, the Complainant persuaded him to meet
the complainant personally and after much persuasion, Yogesh Kumar
Mishra agreed to meet the Complainant at his house. Accordingly the
Complainant went to his house to collect the laptop and to discuss the
repayment schedule of loan amount; however when the complainant
reached at the house of Yogesh Kumar Mishra, he asked the
Complainant to wait at ground floor. The Complainant kept waiting for
several hours but neither Yogesh Kumar Mishra nor his wife bother to
come down and meet with the Complainant and in order to avoid his
liability to repay the loan he misused the provision of law. Yogesh
Kumar Mishra along with his wife hatched conspiracy to implicate the
Complainant in false eve teasing case. As after some time, at about
09:15 PM, police came there and informed the Complainant that a
harassment call has been made by Ms. Aaradhana Mishra against the
Complainant. The Complainant was shocked and surprised and he
was taken to PS Dwarka North for interrogation/inquiry by the police.
The Complainant narrated all true facts to the police officials on which
the Complainant was assured that proper investigation on the said call
would be initiated and in case if the said call was found to be false, a
proper action against Ms. Aaradhana Sharma would be taken. The
Complainant also filed a written complaint against Yogesh Kumar
Mishra and his wife for committing the offence of cheating, criminal
breach of trust, and giving false information to public servant to use
his force but no action has been taken till date.

It is pertinent to mentioned here that on 10.05.2015 wife of


Yogesh Kumar Mishra tendered apology to the Complainant and
informed the Complainant through mail that she had made the said
call/complaint under the pressure of her husband and she was very
regretful for the same and assured the Complainant that the loan
amount would be repaid either by her husband or by her father within
a short period.

You are therefore, requested to take appropriate legal action


against Yogesh Kumar Mishra for committing the offence of
cheating and criminal breach of trust and against his wife for
making false complaint thereby defaming the complainant and
tarnishing his image in the eyes of public. The Complainant has
apprehension that Yogesh Kumar Mishra would misuse the
provision of law as well as cause harm to the complainant in order
to avoid his liability.
