Baraquia, Chief Legal Division, DARPO Sultan Kudarat, the undersigned conducted an ocular inspection of the above-described property on May 16, 2022 and determined the following: 1. CROPS PLANTED. Portions’ of subject landholding is planted with Com crops. At the time of the Ocular Inspection, there appears to be 3 plots of comfields with an area of more ‘orless One (1) hectare each, The rest of the landholding is not cultivated and portions thereof appears to have been utilized for residential purposes comprising of more or less 65 houses Per witnesses account, there are also portions which appears to have been preliminarily subdivided into homelots by the use of improvised markers of blue plastic on a stake. 2. PERSONS ACTUALLY CULTIVATING/ADMINISTRATOR At the time of the Ocular Inspection, these areas planted with Com crops are allegedly cultivated by Bonnie Semoba, Nonito Semoba, and Leon Semoba. Other members of the Semoba family are also allegedly Cultivating some other Portion of the property, but at the time of inspection, only those above- mentioned are planted with com. However, it cannot be accurately determined at the time of inspection on whose derivative Tile from the Borja Title does this areas cultivated by Bonnie Semoba, Nonito Semoba, and Leon Semoba actually belongs, because per claim of the Semoba's in the area, there was no actual or physical survey of the segregated areas of the derivative Titles as they would have opposed the same. if it was ever conducted. ‘maro/tacurong/als/TRS. NUMBER OF YEARS OF THE ACTUAL CULTIVATOR All the members of the Semoba Family which at the time of the Ocular Inspection are comprised primarily of the children and grandchildren, including in-laws, are saying that it was their fathers or father in-laws who were the original Cultivator of portions of the area comprising the Borja landholding. Except for this claim and the fact that they appear to be residing in the area, ‘only Bonnie Semoba, Nonito Semoba, and Leon Semoba have an existing com crops cultivation at the time of ocular inspection which ostensibly were derived by them from their fathers 4. IRRIGATED/NON-IRRIGATED. At the time of OCI, there is no existing irrigation facility in the area, Assessment: During the OCI, it was observed by the team that members of the Semoba Family held on fo the alleged advice of their counsel not to parlicipate in any proceedings, such as survey or signing of documents and even receipt of documents without prior advice from their counsel. That being the reason, the OCI Team found it longer to convince them for the team to proceed with the ocular inspection. It also surfaced later in the inspection, that except for resisting the entry of the registered owners in the subdivided portions which the latter bought from the heir of Borja, they have no formal contact with such registered owners. They are actually arguing that the landholding should have been theirs's already, considering among others, that they have been there for a long time already and have not seen Mr. Borja or his heir who allegedly sold portions of the property to the curent registered owners. All these. despite the explanation of the team that per photocopies of the titles attached to the order, it appears’ that the same are already privately owned individually It was likewise gathered, that a number of the members of the Semoba Family who are allegedly belonging to the portion bought by a certain Ferrer Spouses have already entered into an amicable settlement with the latter.
