This refers to the Environmental Compliance Certificate (ECC) application for the
Asset Preservation Program–Rehabilitation/Reconstruction of Roads with Slips,
Slope Collapse and Landslide - Primary Roads Daang Maharlika (LZ) - K0182+350
- K0182+550 located in Brgy. Joson, Carranglan, Nueva Ecija.
After satisfying the requirements of the said application, this Bureau has decided to
grant an ECC for the above-mentioned project.
With the issuance of this ECC, you are expected to implement the measures presented
in the Initial Environmental Examination Checklist (IEEC) that are intended to protect
and mitigate the project’s adverse impacts on community health, welfare and the
environment. Environmental considerations shall be incorporated in all phases and
aspects of the project.
This Certificate does not create any right and should not be used as an authorization
to implement the project. You may proceed with the implementation only after securing
all the necessary and relevant permits from other pertinent government agencies. This
Office shall be monitoring the project periodically to ensure strict compliance with the
stipulations cited in the attached ECC.
SUBJECT ONLY to the conditions and restrictions set in this ECC and in the
attached document labelled as Annexes A and B.

I. ENVIRONMENTAL MANAGEMENT
A. Construction Phase
A.1 Site Development including excavation (Clearing and Grubbing)
Dust emission from site Maintain a misty access road surface 100% no dust
preparation within the project site by sprinkling generation
water at least thrice (3x) a day during

A.3. Construction Installation, and operation of temporary site facilities (field offices
and barracks)
2. That the proponent shall implement an effective Traffic Management Plan and
Spoil Management Program during the road construction activities;
3. That the proponent shall provide temporary sanitary facilities (i,e. Portable
toilets) during construction phase. Septage shall be hauled/transported and
treated by third party licensed hauler and treater;
5. That all permits and clearances shall be secured from concerned national and
local government offices before the project implementation;
6. That the operation of the project shall conform with the applicable provisions
of RA 9003 (Ecological Solid Waste Management Act of 2000) and its
corresponding Implementing Rules and Regulations;
7. That posting of safety warning signs in conspicuous places within the project
site shall be properly observed during the road construction activities to
prevent accident;
8. That should there be any complaint from the community related to traffic, dust
and noise pollution brought about by the road construction activities, the
proponent shall be held responsible to address such problem;
10. This Certificate shall be considered automatically revoked if the project is not
commenced within five (5) years from the date of its issuance or if the project
operation is suspended or stopped for a period of five (5) years or more;
11. That a 2’ X 4’ billboard containing this message: “Notice to the Public: This
Asset Preservation Program–Preventive Maintenance-Primary Roads
Daang Maharlika (LZ) - K0201+000 - K0202+000 of the Department of
Public Works and Highways, DPWH Nueva Ecija 1st District Engineering
Office has been issued an Environmental Compliance Certificate (ECC-OL-
R03-2023-0271) by the Environmental Management Bureau of the
Department of Environment and Natural Resources, Region III, on May 3,
2023.” shall be installed at entry and exit points of the project site visible to
the general public and a picture of compliance with this condition shall be
submitted to this Office thru recordsr3@emb.gov.ph within thirty (30) days from
receipt of the ECC;
IV. RESTRICTIONS
12. That no activities shall be undertaken other than what were stipulated in the
IEEC. Should there be any expansion of the project beyond the project
description or any change in the activity or transfer of location, the same shall
be subject to a new Environmental Impact Assessment;
13. That the proponent shall ensure just compensation of those that will be
affected by the project in accordance with pertinent guidelines on road-right-
of-way;
14. That no cutting of trees shall be undertaken without first securing Permit to
Cut from the DENR-Forest Management Service, Region III. Any cutting of trees
implemented without the Permit to Cut will render this Certificate cancelled or
suspended. In case there are trees to be affected by the project, tree balling
shall be undertaken;
15. That in case of transfer of ownership of this project, these same conditions and
restrictions shall apply and the transferee shall be required to notify this Office
within fifteen (15) days as regards to the transfer of ownership;
16. That the EMB-3 reserves the right to cancel or withdraw this Certificate for any
misrepresentation of facts vital to the issuance of this Certificate and for any
violation of the conditions stipulated hereof; and,
Non-compliance with any of the provisions of this Certificate shall be a sufficient cause for
the cancellation or suspension of this Certificate and/or imposition of a fine in an amount not
to exceed Fifty Thousand Pesos (50,000.00) for every violation thereof.
Annex B
PROJECT ASSESSMENT PLANNING TOOL
For the assistance of the Proponent and the Government agencies concerned in
the management of the Project and for better coordination in mitigation of the impacts
of the Project on its surrounding areas and the environment, and by way of
recommendation, we are forwarding these recommendations to the parties and
authorities concerned for appropriate action.
Environmental Planning Recommendations and Regulatory
Requirements for the Proponent
Local Government Unit (LGU)
1. The proponent shall give priority employment to qualified local residents. Adequate
public information for jobs available to local residents in the affected areas shall be
provided;
2. The proponent shall coordinate with the concerned LGU for the implementation of
Solid Waste Management Plan;
3. The proponent shall comply with the Building Code and Sanitation Code of the
Philippines;
4. The proponent shall maintain the drainage ways along with the road grading;
5. The proponent shall coordinate with the concerned LGU(s) in the implementation
of traffic management plan
6. The host communities will be kept informed of the duration and timing of any noisy
construction
