DATA PRIVACY NOTICE AND CONSENT

FOR NON-STANDARD BACKGROUND CHECKS

Clients may have specific candidate (employee/vendor) background check requirements which we try to
meet when they are reasonable, proportionate or justified, although such prerequisites may not be
standard Accenture policy or procedure. We will use the results of the background checks to determine
whether you, as candidate, are eligible to perform a role in providing services to such client in accordance
with the latter’s policies, security related or otherwise.

1. Purpose.

You are a candidate for a role in Project Platinum under Client Cigna. This role is subject to specific
background check requirements, as described in this privacy notice, to determine your eligibility. You
are not obliged to undergo these checks to work for Accenture, and you are free, without fear of
reprisal, to refuse to agree to these checks. However, as a consequence of withholding your consent,
you will not be able to work on projects for this particular client. Also, your work assignment or
allocation may be affected, depending on openings available in other projects, and for which you are
eligible or qualified.

2. Description of the personal information to be processed.

Accenture will only collect personal data about you that is necessary to achieve the purposes set out
in this privacy notice.

For this project, in addition to the background checks previously processed you are required to
voluntarily submit to a 10-panel Drug Test for (1) Amphetamines, (2) Barbiturates, (3) Cocaine, (4)
Marijuana/THC (5) Opiates (6) Oxycodone (7) PCP (8) Benzodiazepines (9) Methadone and (10)
MDMA/Ecstasy (“Test”).

3. Scope and method of the personal data processing.

In this regard, you will be required to submit your urine sample for testing and analysis to the
appropriate Department of Health-Accredited substance-testing facility (“Test Facility”). Such Test
Facility shall release, disclose or share to Accenture the Test results which shall be used for purposes
of declaring your fitness for this assignment and for other employment decisions. Clients, however,
will not see detailed screening results.

If you take a drug test and fail, Accenture may seek to have the sample re-tested to confirm results.
Accenture reserves the right to dismiss you if you fail two drug tests or if you refuse to take a

clientrequired drug test and cannot be assigned to an alternative client within a reasonable amount
of time.

Accenture is a global organization and may transfer your data to other countries in which Accenture's
worldwide organization does business and to vendors globally. All such vendors are subject to
contractual obligations in relation to the processing of your personal data. Accenture also has internal
policies in place to ensure an equivalent level of protection is in place across the organization.

In processing your personal information, certain automated processing may be used. However, final
decisions will always be made with meaningful human intervention.

4. Recipients to whom personal information may be disclosed.

Access to your personal data will be limited to those who have a need to know the information for the
purposes described in this privacy notice, which may include the following:

(a) Accenture HRSS Background Check Reviewers and Approvers


(b) Background Check Vendor Personnel
(c) Accenture Background Check Process Owners (d) Project Platinum’s Leads and PMOs.
(e) Client Cigna

Access to the personal data is on a need-to-know basis only. Thus, except for Background Check
Vendor Personnel and Accenture Background Check Process Owners, the rest will only receive the
pass/fail result of these NSBGC.

5. Identity and contact details of the personal data controller.

Accenture shall be the data controller of the personal data to be collected. Any data privacy issues
may be raised by contacting the Data Protection Officer at dataprivacyofficer@accenture.com.

6. Retention period.

All results of the checks and other personal data shall be retained for 3 years from termination of
employment contract with Accenture.

Retention Schedule.

Please always keep your personal data up to date and inform Accenture of any material changes to
your personal data.

7. Rights of the data subject.

Under the Philippines’ Data Privacy Act of 2012, you have rights as a data subject, including the right
to access, correction and object to the processing, has the right to be indemnified for violations of
their rights under the DPA, as well as the right to lodge a complaint before the National Privacy
Commission. Accenture’s Global Data Privacy Policy 0090 and Global Data Privacy Statement further
explains your rights and how Accenture processes your personal data.

If you provide Accenture with any personal data of another person (for instance, a family member),
you are responsible for ensuring that such person is made aware of the information contained in this
privacy statement and that you have obtained express consent from such person to use and process
such information in accordance with this privacy notice.

CONSENT

By signing below, I agree to the processing of my personal and sensitive personal information by Accenture
as described in this privacy notice.

I understand that such use or processing will be carried out in accordance with the Philippines’ Data Privacy
Act of 2012, Accenture’s Policy 90 and Employee Data Privacy Statement, which together regulate the way
in which Accenture collects and uses personal data A copy of Policy 90 and Employee Data Privacy
Statement is available on request.

I also hold harmless Accenture, its officers, directors, employee and agents, free from any harm or damage
to me that might result from the conduct of such testing which is beyond the control of Accenture,
including loss of employment or any adverse or disciplinary action that might arise due to the Test
Facility’s fault or negligence, including but not limited to error or mistake in the administration or analysis
of the Test or the reporting or transmittal of the results.
